AND NOW THAT WE DO THE NEW RECOMMENDATION FROM A STAFF PERSPECTIVE IS TO POSTPONE UNTIL THE 1128 PLANNING AND ZONING COMMISSION MEETING FOR CONSIDERATION.

SO, UM, WE ARE, WE ARE MAKING A LOT OF SIGNIFICANT PROGRESS WITH ALL PARTIES AT THIS TIME.

WE ARE PRETTY, WE ARE FAIRLY CONFIDENT.

BUT WE DON'T HAVE A, A FINALIZED AGREEMENT SETTING ASIDE THAT THE, THE, THE OTHER, UH, UH, LEGISLATION DO WE HAVE A FINALIZED AGREEMENT ON TAX BREAKS AND SO FORTH BETWEEN THE CITY AND THE, AND THE DEVELOPERS.

UM, IT'S A NOT, WE HAVE THE TERM SHEETS, BUT, UM, THAT IS SOMETHING THAT CITY COUNCIL SPECIFICALLY WILL, UM, CONSIDER, UH, STARTING ON 12 FIVE AND POSSIBLY ALSO ON 1219 AS WELL.

UH, WHEN IT COMES TO THOSE TERMS FROM A, ANY SORT OF TERMS IN A DEVELOPMENT AGREEMENT LIKE THAT, THAT IS SOMETHING CITY COUNCIL HAS.

UM, THEY'RE THE ONES THAT DO CONSIDER THOSE ULTIMATELY.

SO THE DEVELOPMENT AGREEMENT IN ITSELF WILL NOT COME TO Y'ALL FROM A CONSIDERATION STANDPOINT.

DOES THAT MAKE SENSE? IT DOES.

UM, SO A BIG FOCUS ON THE DEVELOPMENT AGREEMENT WILL BE ANY SPECIAL FINANCING THEY'RE GONNA BE CONSIDERED.

UM, ALSO, UM, ELEVATION APPROVALS AND STUFF LIKE THAT ABOVE AND BEYOND THE I 35 OVERLAY REQUIREMENTS.

SO WE HAVE TO MAKE SURE THAT THOSE ARE INTO A, IN A, UH, A MUTUALLY AGREED UPON DEVELOPMENT AGREEMENT.

SO THEY'RE NOT VIOLATING STATE LAW.

AND SO THE PUT ITSELF WILL INCLUDE, UM, DEVELOPMENT STANDARDS FROM SETBACKS AND PREVIOUS COVER.

UM, HOW MANY, HOW MUCH SQUARE FOOTAGE AT MINIMUM FOR THE RETAIL.

UM, IF THERE'S ANY, UM, YOU KNOW, HOW MANY UNITS FOR MULTIFAMILY AND WHAT HAVE YOU ON THERE.

SO THERE'S GONNA BE SOME SPECIFICS RELATED TO THAT, THAT ARE NOT SPECIFICALLY, UM, THAT NEED TO BE SPECIFICALLY PUT INTO THE DEVELOPMENT AGREEMENT.

UH, WHAT HAS BEEN THE DISCUSSION AS REGARDS THE ADVANTAGE OF HAVING A PUD FOR THAT PARTICULAR PARCEL PLAN? THE BIGGEST ADVANTAGES ON THAT PERSPECTIVE IS, UM, COORDINATING A, A PROJECT THAT FUNCTIONS BETTER OVERALL THAN OUR CURRENT ZONING CODE ALLOWS, UM, WITH, UH, WITH VARIANCES AND WAIVERS BUILT INTO THE PUD TO MAKE SURE IT HAS A SMOOTHER, UH, DEVELOPMENT PROCESS.

YEAH, RIGHT.

SO, UM, YOU KNOW, MY CONCERN IS COMPARING WHAT, WHAT MIGHT BE IMAGINED FOR THIS TO ANOTHER PROJECT THEY HAVE.

I DON'T KNOW IF IT'S A PUT, I WOULD HAVE TO ASK THEM, I SUPPOSE, UM, WHICH WAS UNIMPRESSIVE, BUT NEVERTHELESS, UM, REGARDING THE I 35 AND THE P, WOULD THEY BE, CAN THEY SEEK VARIANCES UNDER OUR CURRENT TERMS? CAN THEY SEEK A VARIANCE FROM I 35 OVERLAY? THE PLANNING AND ZONING COMMISSION HAS THE AUTHORITY TO CONSIDER, UM, I'M NOT GONNA SAY VARIANCES, BUT MAYBE EXCEPTIONS AND CONDITIONS, UM, ON THE I 35 OVERLAY STANDARDS WHERE Y'ALL FE WHERE Y'ALL FEEL THE, UM, THE APPLICANT WHEN A C U P COMES TO Y'ALL, UH, MEETS THE INTENT, BUT DOESN'T QUITE MEET THOSE STANDARDS OR THEY'RE EXCEEDING 'EM.

BUT THERE'S SOMETHING ABOUT IT THAT DOESN'T QUITE MEET WORD FOR WORD IN THE I 35 OVERLAY.

BUT WHEN THIS PROJECT COMES FORWARD, IF THERE'S ANY OF THOSE STANDARDS THAT ARE BUILT INTO IT, THEN THOSE WOULD POTENTIALLY SUPERSEDE THE, UM, THE I 35 OVERLAY REQUIREMENTS.

WHAT IS THE RATIONALE ON DOING IT AT THAT TIME VERSUS DOING IT, UM, AT THE FIRST PART OF DECEMBER? OTHER THAN COUNSEL, THE GOAL IS, UM, BASED ON DIRECTION FROM OUR ADMINISTRATION, IS WE ARE GOING TO HAVE THIS PROJECT FROM AN ENTITLEMENT PERSPECTIVE WRAPPED UP BY THE END OF THE YEAR.

SO, UM, WE WENT, WE BACKTRACKED FROM THERE FROM A TIMING PERSPECTIVE AND A SCHEDULING OF THOSE MEETINGS.

SO THAT'S WHY IT'S GOING TO BE ON THE 28TH AND THEN THE FIFTH AND THE 19TH AT CITY COUNCIL.

SO WE HAD TO DO THAT SO WE CAN MAKE SURE WE MET THE, UH, WE MET ALL THE REQUIREMENTS FROM GETTING ALL THE, OUR INTERNAL SCHEDULE AND EVERYTHING LIKE THAT KNOCKED OUT.

SO WE HAD A SUFFICIENT AMOUNT OF TIME AS A FOLLOW UP TO THAT.

SO WE ARE GONNA, GONNA BE LOOKING AT THAT STARTING SOON.

UM, I NEED TO COORDINATE WITH MY STAFF TO MAKE SURE WE ARE READY TO GO, BUT I'M HOPING WE CAN, UM,

UH, SECOND PUBLIC HEARING AND FIRST CONSIDERATION OR AND CONSIDERATION ON THE JANUARY 9TH MEETING.

AND THEN CITY COUNCIL ON ONE 16 REGARDING THE, UH, LANDSCAPING AND THE ZERO SCAPING, UH, STANDARDS.

UH, WHO ARE, IS STAFF COMING UP WITH A, THE VARIOUS, ESSENTIALLY THE CONTENT FOR SUCH A, A PLAN A CODE.

SO WE, WE UPDATED THE LANDSCAPING CODE IN AUGUST, THE, THE AMENDMENT TO IT, AND IT, IT DRAMATICALLY INCREASED THE AMOUNT OF ZERO ESCAPING THAT WE ALLOWED AND ENCOURAGED AND WHAT HAVE YOU, UH, BASED ON COUNCIL'S, UM, UM, DISCUSSION POINTS ON THE MEETING A COUPLE TIMES AGO.

THEY WANTED US TO LOOK AT IT AGAIN TO SEE IF WE CAN DO MORE AND ALSO WORK TOGETHER FOR, UM, INCENTIVES AND A PROGRAM FOR THAT AS WELL.

TO CLARIFY WHAT WOULD MORE BE TO DO MORE? THAT'S GOOD QUESTION.

SO, UM, THAT'S WHY IT'S GOING TO BE A DISCUSSION TOPIC FOR SURE.

YEAH.

AND THE, THE REASON IT'S OF CONCERN TO ME IS, UH, FOR, FOR ALL OF US REALLY IS THAT, UH, ZERO ESCAPING PERMACULTURE.

THOSE KINDS OF TOPICS ARE REALLY RATHER SPECIALIZED TO A LARGE EXTENT.

A LOT OF PEOPLE THINK ZERO ESCAPING IS GRANITE GRAVEL OR SOMETHING AND, AND A COUPLE OF ESPERANZA ORANA PLANTS AND IT'S MORE THAN THAT.

UM, AND SO IT'S REALLY RATHER COMPLEX IN MY VIEW.

AND UH, FRANKLY, I DON'T KNOW UNLESS SOMEBODY HERE IS A HORTICULTURIST OR SOMETHING, I DON'T KNOW IF WE HAVE THE COLLECTIVE, UH, UH, EXPERTISE BETWEEN COUNCIL OURSELVES AND STAFF TO ACTUALLY ADDRESS ZERO ESCAPING.

UM, AND THERE'S ALSO A CONFLICT IN THE COMMUNITY BETWEEN THE DEVELOPERS IN THE CITY.

OBVIOUSLY IF YOU GO TO ZERO ESCAPING STANDARDS WHEN THEY KEEP REQUIRING ALL TURF LAWNS CORRECT.

, IT CAN BE A CONFLICT.

SO WE HAVE TO BE CAREFUL ABOUT THAT.
