UH, NEXT UP CITIZEN COMMENTS PERIOD.AT THIS TIME WE ASK ANYONE IN THE AUDIENCE WHO WISHES TO COME FORWARD AND SPEAK ON ANY ITEM TO PLEASE DO.

I LIVE HERE IN KYLE AND I NOTICED ON THE AGENDA THAT CITY COUNCIL IS DISCUSSING THE GLOBAL OPIOID SETTLEMENT FUNDS.
SO I'M HERE TO INTRODUCE MYSELF AND OFFER TO BE A RESOURCE ON WAYS TO SPEND THOSE FUNDS.
I'VE BEEN WORKING WITH THE NATIONAL COUNCIL ON INDEPENDENT LIVING, WHICH IS THE NATION'S LONGEST RUNNING DISABILITY RIGHTS GROUP PAIN AND ADDICTION CAN BE DISABILITIES.
I ALSO VOLUNTEER WITH THE NATIONAL PAIN ADVOCACY CENTER, WHICH IS A NEW NONPROFIT THAT TAKES NO INDUSTRY FUNDING.
AND I WAS THE PUBLIC REPRESENTATIVE ON THE TEXAS MEDICAL BOARDS OPIOID WORK GROUP IN 2020.
SO YOU'LL NOTICE IN THE STATE OF BATEMAN PLAN, YOU'LL SEE A RECOMMENDATION THAT SAYS TO ALIGN PRESCRIBING OF OPIOID PAIN MEDICATION WITH CDC GUIDELINES.
SO WHAT I CAN SAY IS THAT HAS ALREADY HAPPENED.
AND THEN SOME, UM, TEXAS HAS DEFINITELY SEEN ITS SHARE OF PRESCRIPTION FRAUD ALONG WITH ILLICIT COUNTERFEIT DRUGS.
THESE DAYS, MEDICAL PRESCRIBING IS BACK DOWN TO 2001 LEVELS.
IT'S PLUMMETED SO FAR SO FAST THAT CDC IS NOW REVISING THEIR GUIDELINE.
ACKNOWLEDGING THERE'S BEEN SERIOUS HARM DONE TO PEOPLE WITH PAINFUL AND INCURABLE MEDICAL CONDITIONS.
IT'S, YOU KNOW, THESE ARE MEDICALLY NECESSARY MEDICATIONS, NOT JUST FOR CANCER.
SO I'VE BEEN ADVOCATING FOR PATIENTS WHO WERE WORKING, CARING FOR THEIR FAMILIES.
AND THEN WITH ALL THESE NEW WELL-INTENDED POLICIES INTENDED TO PUNISH PHARMA COMPANIES, PEOPLE ARE LEFT INCAPACITATED WITHOUT THE ONE MEDICATION THAT EVER HELPED.
UM, ADDICTION IS TREATABLE AND MANY PEOPLE WITH ADDICTION CAN RECOVER.
WHAT LOCAL GOVERNMENT NEEDS IS FUNDS TO EQUIP AND TRAIN FIRST RESPONDERS.
UM, A GOOD EXAMPLE IS ALL OVER THE COUNTRY.
WE KEEP SEEING THIS MYTH THAT FIRST RESPONDERS CAN OVERDOSE ON ILLICIT FENTANYL JUST BY TOUCHING IT.
AND THAT MYTH IS KEEPING DRUG USERS FROM GETTING HEALTHY NEED.
UM, KYLE NEEDS ACCESS TO ADDICTION TREATMENT, INCLUDING MEDICATION TREATMENT FOR THOSE WHO CHOOSE IT.
AND IN PUBLIC MESSAGING, THERE'S A LOT THAT LOCAL GOVERNMENT CAN DO TO HELP TEXANS AFFECTED BY ADDICTION WITHOUT STIGMATIZING TEXANS WITH PAIN.
SO I JUST WANTED TO INTRODUCE MYSELF.

UH, WHILE I WORKED OUT WHILE I WAS HERE, I VOLUNTEERED AT THE KYLE FIRE DEPARTMENT FOR SEVEN YEARS UNTIL THEY WENT TO A, UH, PROFESSIONAL FIRE FIRE DEPARTMENT.
UH, IN 2016, WE PURCHASED A LOT 400 GIRLS ARE SUPPOSED TO RETIRE THERE.
AND WE, UH, WE BEGAN PLANNING FOR THAT.
WE, WE FOUND A, WE SECURED A BUILDER, UH, PICKED OUT A FLOOR PLAN THAT WAS CONSISTENT WITH THE AREA.
AND I SAW A RANCH-STYLE HOUSE, SMALL, NOT OVERSTATED.
UM, EVERYTHING WAS A GO, WE WERE, UH, SCHEDULED TO CLOSE ON THE HOUSE AND BREAK DIRT IN, IN APRIL AND LITERALLY THE WEEK WE'RE SUPPOSED TO CLOSE.
WE GOT A CALL FROM CITY PLANNER AT CONSENT, ADVISING US.
THERE'S A PROBLEM WITH THE PLANNING, UH, IMMEDIATELY BEGAN TO SCRAMBLE, UH, BEEN WORKING WITH THE CITY WE'VE BEEN WORKING WITH WILL NONSTOP RESTAURANT

TO GET SOMETHING TO COME.AND BASICALLY WE'VE BEEN GOING IN CIRCLES.
AND AT ONE POINT, UH, SHOULD WE FIND OUR ATKINSON POINTED OUT THAT THERE IS A, UM, UH, AND SECTION 41 10 OF THE CITY ORDINANCES OR AS AN EXEMPTION FROM PLANNING CLAUSE.
AND IT SEEMS DESIGNED ALMOST PERFECTLY FOR SOMEONE IN MY SITUATION.
I'M NOT GOING TO READ IT TO YOU.
IT JUST SAYS IT CAN BE GRANTED WHEN IT WILL CREATE AN UNDUE HARDSHIP.
FINANCIAL HARDSHIP IS ONE OF THE THINGS LISTED.
THE NEXT SUB BULLET TALKS ABOUT THE THINGS THAT WOULD NOT MAKE IT A BOOKABLE TO, UH, EXEMPTION.

I SAID THAT TO HIM, WE WERE PLANNED TO GO IN ON THE PLANNING AND ZONING COMMITTEE MEETING, AND WE DO HAVE COUNSEL LISTENING.
UM, SO IF YOU COULD JUST ON THE MICROPHONE, BECAUSE OTHERWISE THEY WON'T BE ABLE TO HEAR, YOU CAN HAND THEM OUT.
I'M JUST SAYING, WHENEVER YOU, WHENEVER YOU KEEP SPEAKING, I JUST WANT TO MAKE SURE THEY CAN HEAR YOU.
SO ON THE EIGHTH, WE WERE PLANNING TO HAVE A MEETING AND, UH, THEY WERE GOING TO VOTE ON, ON THE ISSUE.
WE WERE ADVISED THAT THEY WERE UNABLE TO CONTACT ONE OF THE LANDOWNERS.
THERE WERE THREE PEOPLE INVOLVED.
THERE'S, THERE'S A PLOT OF LAND THAT HAS THREE LOTS, UH, ATTACHED.
AND THERE WAS A PLANNING ISSUE.
AND THE PROBLEM IS ALL THREE LOTS ARE KIND OF COMBINED.
SO WE WERE TRYING TO SEPARATE THEM LEGALLY, SEPARATE THEM A LOT THAT WE BOUGHT AS ON THE CORNER OVER HERE, UM, THEY WERE NOT ABLE TO GET AHOLD OF ONE OF THE LANDOWNERS THAT, UH, AND IT REQUIRED ALL THREE LAND OWNERS TO PARTICIPATE.
SO WE, UH, WE HAD TO CANCEL IT.
I RECEIVED A, AN EMAIL FROM THE CITY SAYING, DAVID, AS YOU LIKELY KNOW, WE HAD TO DELAY THEIR REQUEST TO NOT PLAT.
ONE OF THE LANDOWNERS DID NOT GIVE CONSENT.
UM, AND I'M GONNA, I, MY WIFE HAS SIGNED UP.
SO IF I RUN OUT OF TIME, I'M GONNA USE HER TIME AS WELL.
UM, AGAIN, UH, THROUGHOUT THE PROCESS, I'M NOT GOING TO GET INTO MUCH DETAIL.
I HAVE A LOT OF, UH, NOT MUCH TIME, BUT, UH, TWO OF THE LANDOWNERS HAVE BEEN COOPERATING.
UH, THERE IS AN EX DECLINED, NOT ONLY REFUSES TO COOPERATE, BUT IT HAS EXPRESSLY DENIED, UH, TO BE INVOLVED IN THIS.
SHE IS THE ONE PROPERTY THAT HAS A HOUSE ON IT VIA TO JASON.
MY LOT WAS BOUGHT AND SOLD AT ITS CURRENT CONFIGURATION.
THREE TIMES PRIOR TO MY BUYING IT, WE WERE NEVER MADE AWARE OF ANY PLANNING ISSUES UNTIL WE WENT TO CLOSE.
WE'VE COME IN SEVERAL TIMES TO TALK ABOUT PLANTING A BUILDING IN THE FUTURE, DOWN THE ROAD.
AND WE WERE NEVER, IT WAS NEVER BROUGHT TO OUR ATTENTION THAT THAT WAS GOING TO BE AN ISSUE UNTIL WE WENT TO CLOSE.
AND SINCE THEN, UH, IT'S JUST BEEN A NIGHTMARE.
SO I, I SUBMITTED AND ONE OF THE HANDOUTS THEY GAVE YOU IS MY LETTER TO THE CITY REQUESTING THAT MY LOT BE, UH, EXEMPT FROM PLANNING, UH, ON THE 21ST OF MAY, I RECEIVED AN EMAIL EMAIL FROM THE CITY SAYING THAT WE DO NOT NEED TO HAVE THE OTHER TWO PROPERTY OWNERS PERMISSION, AND YOU HAVE THIS, IT STATES THAT I CAN GO AHEAD AND GET IT PLANTED AT MY EXPENSE.
IT'S NOT CHEAP, BUT AT MY EXPENSE, I CAN GET IT PLANTED.
UM, AND THAT WOULD BE GOOD IF I WERE TO RETRACT MY LETTER, REQUESTING THE PLANNING REDEMPTION I DID.
I SUBSEQUENTLY RECEIVED A LETTER FROM THE CITY STATING THAT THEY'D REVERSED THEIR POSITION.
THIS IS AFTER I RETRACTED MY LADDER, THEY WERE NOT GOING TO ALLOW ME TO HAVE MY LOT PLANTED.
ALL THREE LOTS WOULD HAVE TO BE PLANTED TOGETHER.
AND ALL THE CONDITIONS THAT THEY GAVE, IT WAS A SIX STEP PROCESS.
AND ALL THREE LANDOWNERS WERE GOING TO HAVE TO PARTICIPATE IN.
AND AGAIN, THAT, THAT IS NOT SOMETHING THAT, UH, IS THAT I CAN DO BECAUSE THE ONE LANDOWNER REFUSES TO PARTICIPATE.
IN FACT, EXPLICITLY 18, I GOT A LETTER EMAIL, MR. SHEEDY, MRS. MOTHERLAND OWNER HAS SPECIFICALLY GIVEN PERMISSION FOR A PROPERTY, NOT HAS SPECIFICALLY NOT GIVEN PERMISSION.
AND THAT WAS ONE OF SEVERAL EMAILS THAT SHE SAID.
SO I'M HERE BECAUSE I KNOW THE CITY HAS DONE A LOT OF INVESTMENT IN THE INFRASTRUCTURE.
THE DOWNTOWN LOOKS GREAT COMPARED TO WHEN I MOVED HERE, WE HAVE A BEAUTIFUL NEW CITY HALL.
IT'S LEAPS AND BOUNDS AHEAD OF ANYTHING THAT I, THAT THE CITY OF AUSTIN HAS AGAINST THE UNPARTIAL THAT I WORKED THERE FOR 32 YEARS, WE'VE GOT THE LIBRARY AND THE SWIMMING POOL AND ALL THE INFRASTRUCTURE THAT'S GOING AROUND AND INVESTMENT IN DOWNTOWN.

AND THEN WE HAVE ONE BLOCK OFF THE CITY, OFF THE FIRE STATION.WE HAVE MULTIPLE VACANT, LOTS.
I OWN ONE OF THOSE, AND I WANT TO PUT A HOUSE ON IT AND I WANT TO MAKE IT NICE.
AND THE CITY'S DENYING ME INDIRECTLY BY, BY PUTTING THEY'VE BEEN BOLD AND ONE CITIZEN WITH THE, WITH THE ULTIMATE, RIGHT, TO DETERMINE WHETHER I CAN BUILD THERE'S NOTHING AT THIS POINT, I CAN DO EVERY OPTION.
THE CITY HAS GIVEN ME HAS REQUIRED THAT I GET COORDINATION WITH ALL THREE.
AND THE ONE PERSON SAYS I DON'T WANT TO DO IT.
THEY CURRENTLY OWN A NICE, BIG LOT.
THEY DON'T HAVE NEIGHBORS ON EITHER SIDE OF THEM WHO WOULDN'T LIKE THAT.
THEY GOT BASICALLY A THREE QUARTER LOT TO THEMSELVES, BUT IT'S NOT RIGHT BECAUSE I'M NOT BEING MY WIFE AND I CAN'T BUILD ON OUR PROPERTY THAT WE BOUGHT OWNED.
WE HIRED A TITLE COMPANY AND NOTHING WAS BROUGHT UP UNTIL I WENT TO CLOSE.
SO I KNOW THIS IS NOT THE FORUM THAT CAN SOLVE THAT, BUT I'VE GONE THROUGH THE OTHER CHANNELS.
AND I JUST NEED TO MAKE AS MANY PEOPLE AWARE OF IT AS POSSIBLE.
