IT IS THURSDAY, DECEMBER 16TH, AND I'M GONNA CALL THIS SPECIAL CITY COUNCIL MEETING TO ORDER WITH THE CITY SECRETARY, PLEASE CALL ROLL MITCHELL ELLISON FLORES, KALE HERE, RIZZO BRADSHAW HERE, PARSLEY TRIVIA.

AT THIS TIME WE ASK ANYONE IN THE AUDIENCE WHO WISHES TO COME FORWARD AND SPEAK ON AI.

PLEASE DO.

SO WE ASK THAT YOU LIMIT YOUR COMMENTS TO THREE MINUTES AND THAT YOU DIRECT THOSE COMMENTS TO THE MAYOR AND COUNCIL.

UH, FIRST UP I HAVE MS. LAILA NIGHT.

MY NAME IS LAILA NIGHT AND I HAVE SEVERAL THINGS I WANTED TO SPEAK TO YOU ABOUT TONIGHT.

UH, FIRST I NOTICED ON NEXT DOOR FOR THE LAST COUPLE OF DAYS.

UM, THERE'S A SMALL MEMORIAL FOR SARAH DAHLSTROM WHO WAS KILLED IN A TRAFFIC ACCIDENT IN 1996 AT ONE 15, UH, 2270, WHERE I THINK IS NOW GOING TO BE THE SIDE OF A GAS STATION.

AND THERE WAS A LOT OF CONCERN ABOUT HOW THAT GAS STATION MIGHT IMPACT, UH, THAT LITTLE MARKER.

AND SO I JUST THOUGHT I'D BRING THAT TO YOUR ATTENTION AND MAYBE SOMEONE FROM PLANNING OR SOMETHING CAN LOOK INTO THAT.

SECONDLY, I HAVE A QUESTION ABOUT, AND THIS'LL BE THE THIRD AGENDA.

UH, THE EMPLOYEE BENEFITS TRUST, UH, IT INCLUDES SOME CITY OFFICERS AS WELL AS EMPLOYEES.

AND I DIDN'T KNOW WHAT CITY OFFICERS REFERRED TO.

AND I WAS CURIOUS IF THAT MEANT THE CITY COUNCIL, BECAUSE GENERALLY I'M EVEN THE CITY MANAGER WHO'S GONE IS A CITY EMPLOYEE.

SO I THINK IT'D BE NICE TO HAVE SOME CLARIFICATION ON, UH, EMPLOYEE BENEFITS FOR CITY OFFICERS, WHOEVER THEY MIGHT BE.

AND LASTLY, BUT CERTAINLY NOT LEAST I'M CONCERNED ABOUT THE TWO DEVELOPMENT AGREEMENTS THAT ARE ON THE AGENDA TONIGHT.

THE ONE FOR KYLE MARKETPLACE AND PRAIRIE LAKES, I'D REALLY LIKE TO KNOW WHERE PERIOD HE LIKES IS NUMBER ONE, THERE WAS NO BACKUP.

SO I HAVE NO IDEA WHAT THESE DEVELOPMENT AGREEMENTS CONTAIN.

I DON'T KNOW IF IT'S GOING TO COST THE TAXPAYERS MONEY GENERALLY THEY DO.

AND THERE'S THERE'S, THERE ARE MANY, MANY, MANY TIMES WHEN THERE IS JUST NO BACKUP WHATSOEVER ON YOUR AGENDA ITEMS. AND IT'S VERY DIFFICULT FOR THE CITIZENS TO GIVE YOU THEIR FEEDBACK BEFORE YOU MAKE A VOTE WHEN WE DON'T KNOW WHAT IT IS.

AND I REALLY WISH THAT YOU WOULD IMPROVE YOUR, YOUR SENSE OF TRANSPARENCY AND REALLY DROP THE PATERNALISTIC APPROACH TO GOVERNMENT, UH, WHICH REALLY EXCLUDES YOUR CITIZENS FROM HAVING SOME SORT OF MEANINGFUL INPUT INTO YOUR DECISION MAKING.

UP EXECUTIVE SESSION CUSTOMER FLOURISH, SKIP PURSUANT TO CHAPTER 5, 5 1, THE TEXAS GOVERNMENT CODE.

THE CITY COUNCIL RESERVES THE RIGHT TO CONVENE AND TO EXECUTIVE SESSION FROM TIME TO TIME AS DEEMED NECESSARY.

DURING THIS MEETING, THE CITY COUNCIL MAY CONVENE INTO EXECUTIVE SESSION PURSUANT TO ANY LAWFUL EXCEPTION CONTAINED IN CHAPTER 5, 5, 1 OF THE TEXAS GOVERNMENT CODE, INCLUDING ANY OR ALL OF THE FOLLOWING TOPICS, PAINTING OR CONTEMPLATING LITIGATION, OR TO SEEK THE ADVICE OF THE CITY ATTORNEY PURSUANT TO SECTION 5, 5, 1 0.071 SAVANNAH DEVELOPMENT AGREEMENT HERO'S MEMORIAL PARK DETENTION, PRAIRIE LAKES, CONSENT AND DEVELOPMENT AGREEMENT POSSIBLE PURCHASE EXCHANGE, LEASE OR VALUE OF REAL ESTATE PURSUANT TO SECTION 5, 5, 1 0.072 PERSONNEL MATTERS PURSUANT TO SECTION 5, 5, 1 0.07, FOUR CONVENIENT TO EXECUTIVE SESSION PURSUANT TO SECTION 5 51 0.087 TEXAS GOVERNMENT CODE TO DELIBERATE REGARDING THE OFFER OF ECONOMIC INCENTIVES TO WANT TO MORE BUSINESS PROSPECTS THAT THE CITY SEEKS TO HAVE LOCATE STAY OR EXPAND IN OR NEAR THE CITY PROJECT.

ITEM NUMBER FOUR ON THIS, UH, SPECIAL, UH, AGENDA, UH, APPROVE IT.

CHAPTER THREE 80 D UH, ECONOMIC DEVELOPMENT AGREEMENT FOR PROJECT WILD STRAWBERRY DINOSAURS.

GOOD EVENING, MAYOR AND COUNCIL DIANA TORRES, DIRECTOR OF ECONOMIC DEVELOPMENT FOR THE RECORD I AM BEFORE YOU THIS EVENING TO ASK FOR ACTION

ON THE THREE 80 AGREEMENT FOR KYLE MARKETPLACE PROJECT, UM, THE GRANT WOULD BE FOR THE EARLIER TO OCCUR OF 15 YEARS, OR THE DATE OF THE MAXIMUM GRANT IS REACHED AND EQUIVALENT OF 50% OF PROPERTY TAXES, 50% SALES TAX REBATE AND PERMIT PERMIT FEES.

THE MAXIMUM GRANT AMOUNT WOULD BE $13 MILLION.

IF THE COUNTY DECIDES TO PARTICIPATE IN THEY'LL VOTE ON THIS PROJECT NEXT TUESDAY, IF THEY DO NOT, THEN THE TOTAL WILL DROP DOWN TO $9 MILLION.

AND THEN, UM, PART OF THE PERFORMANCE CRITERIA INCLUDES THE BUILDING OF A BRIDGE.

IF THE BRIDGE IS NOT BUILT, THEN THAT TOTAL WILL DROP DOWN TO 6 MILLION.

SOME OF THE PERFORMANCE CRITERIA FOR THIS AGREEMENT IS THAT THE DEVELOPER OBTAIN A CEO FOR 14,000 SQUARE FEET OF COMMERCIAL SPACE WITHIN 24 MONTHS OF THE EFFECTIVE DATE OF THE AGREEMENT THAT THE DEVELOPER COMPLETES THE COURTYARD THAT THE DELL DEVELOPER DEDICATES 3.6 ACRES TO THE CITY BY THE PERFORMANCE DEADLINE, THAT THE DEVELOPER CAN NOT BE DELINQUENT IN ANY PROPERTY TAXES TO THE COUNTY CITY OR SCHOOL.

THE DEVELOPER PAYS THE $3 MILLION DEPOSIT FOR THE BRIDGE CONSTRUCTION WHEN REQUESTED AND THE DEVELOPER BUILDS THE PROJECT IN COMPLIANCE WITH THE DEVELOPMENT AGREEMENT.

THAT WAS OUR, AH, THANK YOU, DONNA, DOES ANYBODY HAVE ANY QUESTIONS, COMMENTS, CUSTOMER FLOOR SCALE.

I JUST WANT TO SAY YOU ARE ONE OF MY FAVORITES AND I APPRECIATE ALL YOUR HARD WORK BECAUSE AS, AS EASILY, AS YOU SAID, THAT THESE ARE COMPLICATED DOCUMENTS.

I WANT TO THANK SCOTT AND OUR C ATTORNEY WHO WORKED SO HARD TO GET THESE DONE, AND THOSE NUMBERS SOUND BIG, BUT THE TRUTH IS WE KNOW WHAT THE RESIDENTS WANT AND WHAT THEY ASK FOR.

AND SO WE ARE TRYING HARD TO GET THAT TO THEM.

AND SOMETIMES WE HAVE TO OFFER THESE KINDS OF, UM, GIFTS, GRANTS, INCENTIVES.

I DON'T KNOW HOW TO SAY I'M TRYING TO BE REALISTIC, RIGHT? PUBLIC PRIVATE PARTNERSHIP.

THERE YOU GO.

JUST, YOU KNOW, JUST TO SHOW THAT WE, WE WANT TO INCENTIVIZE SO WE CAN GET THE COMPANIES HERE.

SO THANK YOU SO MUCH.

YOU ALWAYS WORKED SO HARD AND I APPRECIATE IT.

IT'S GOING TO GENERATE A LOT OF, UM, OPPORTUNITIES FOR A LOT OF AMENITIES THAT HAVE BEEN DEMANDED BY THE COMMUNITY FOR QUITE A WHILE, RIGHT? 'CAUSE WE'RE GETTING , BUT JUST IN CASE THEY DIDN'T HEAR THAT.

COULD YOU REPEAT IT LOUDER? AND SOME OF THE, UH, YOU KNOW, FUTURE LAND USES THAT ARE BEING PROPOSED HERE ARE MULTIPLE SIT-DOWN RESTAURANTS, VERTICAL MIXED USE, UM, UH, GREAT AMENITY SPACES, TRAILS SPACES, UH, IT INCLUDES THREE AND A HALF ACRES OF VERY PRIME LAND WHERE WE COULD POTENTIALLY CREATE A PARK FOR THAT AREA DOWN THE ROAD AND LOTS OF OPPORTUNITIES.

AND THEN THERE IS A DEVELOPMENT AGREEMENT THAT CODIFIES THE STANDARDS THAT THEY'RE WILLING TO MEET.

BUT, UH, MY UNDERSTANDING IS THAT WE'RE GOING TO TAKE ACTION ON THAT AT THE FOLLOWING MEETING, IN WHICH THEY WILL BE SUBJECT TO ANY FURTHER DISCUSSION MOTIONS.

MAYOR, I'D LIKE TO MAKE A MOTION TO APPROVE SO SPECIAL MEETING AGENDA ITEMS. IS THAT GOOD? ALL RIGHT.
