UM, SO TONIGHT WE HAVE A CONDITIONAL USE PERMIT FOR A PROPERTY LOCATED AT, UH, TWO 50 CHULA HILL DRIVE, WHICH IS IN HAY COMMERCE CENTER.
UM, JUST TO GIVE YOU AN IDEA, IT'S ABOUT 375 FEET BACK FROM THE I 35 FRONTAGE ROAD.
UM, AND IT'S IN HAYES COMMERCE CENTER, WHICH HAS A PUD OR A PLANNED UNIT DEVELOPMENT.
UM, THE USE IS ALLOWED PER THE ZONING AND THEN, UM, THE ELEVATIONS THAT'LL SHOW YOU HERE IN A MOMENT MEET THE REQUIREMENTS OF THE OVERLAY DISTRICT.
UM, SO HERE WE HAVE, IT'S PRIMARILY, UM, TILT WALL CONCRETE, WHICH IS ALLOWED PER THE I 35 OVERLAY AND THE POD.
UM, THERE'S SOME AWNINGS AND OTHER ARCHITECTURAL DETAILS, UM, TO COMPLETE THE DESIGN.
AND THEN WE HAVE A SITE PLAN FOR YOU.
AND THEN THE LANDSCAPE PLAN, SORRY, THE LITTLE HARD TO READ.
UM, JUST WANNA NOTE HERE THAT THE LANDSCAPE PLAN IS APPROVED PER THE PUD.
UM, THIS PUD HAS SOME ADDITIONAL LANDSCAPING REQUIREMENTS THAT ARE A LITTLE BIT DIFFERENT FROM THE I 35 OVERLAY.
UM, SO THIS HAS BEEN REVIEWED AND IS IN COMPLIANCE WITH THE PUD, SO, AND THAT IS IT.
ANY QUESTIONS? YES, COMMISSIONER STEGEL? YES.
UM, I'VE GOT A OF THINGS HERE THAT I DIDN'T QUITE GET THROUGH READING BECAUSE THE DOCUMENTATION IS SO DENSE, BUT I UNDERSTAND THAT THIS WAS DONE UNDER THE 2010 COMPREHENSIVE PLAN AND WAS APPROVED 12 YEARS AGO, ALMOST TO THE WEEK AS A P.
SO THE REASON I WOULD GO THROUGH ALL OF THE DETAILS IS TO SEE EXACTLY WHAT ADDS UP AND AS ORIGINALLY INTENDED IN THE COMP COMPREHENSIVE PLAN, UM, IT WAS NOT RECOMMENDED THAT THIS BE WAREHOUSE.
NOW SUBSEQUENTLY IT WAS APPROVED AS WAREHOUSE, BUT THERE'S NEVERTHELESS BEEN A CONFLICTING OPINION, AT LEAST IN TERMS OF, UH, THE VISION FOR THAT PARTICULAR SITE.
AND WHEN I LOOK AT IT, IT SEEMS THAT A RE THE REGIONAL NODE BUTTS UP AGAINST THAT IF DOES, IF IT DOES NOT INCLUDE IT, AND REALLY CUTS OFF OUR DEVELOPMENT FOR OTHER RETAIL AND OTHER PURPOSES TO THE NORTH.
AND IN FACT, UM, IN THE OLD DOCUMENTS IT TALKS ABOUT BEING CONCERNED ABOUT THIS PROPERTY, THIS PARTICULAR AREA BEING THE GATEWAY TO NORTH KYLE, WHICH I CAN APPRECIATE.
THE QUESTION THEN THAT I HAVE IS, UM, DO YOU

SEE ANY PARTICULAR CONFLICTS BETWEEN THESE DOCUMENTS, BETWEEN THE VARIOUS ORDINANCES AND THEN THE, UH, COMPREHENSIVE PLAN? IT WAS AS IT WAS ENFORCED AT THAT TIME? DID I, NONE OF US HERE ON STAFF WERE HERE AT THAT TIME.UM, I WILL SAY THIS IS PRETTY, IT'S IN LINE WITH WHAT IS EXISTING, WHAT HAS ALREADY BEEN BUILT WITHIN THE HAYES COMMERCE CENTER.
UM, AND IT WAS ENTITLED THROUGH THE ZONING.
SO IT'S, IT, THE ZONING ENTITLED IT AND IT WAS APPROVED.
SO IT'S, IT'S ALLOWED PER THE ZONING.
SO THIS IS MY CONCERN WITH THESE LEGACY, UH, YOU KNOW, WE GET SHACKLED BY NOT ONLY THE CONS COMPREHENSIVE PLAN, BUT SHACKLED BY A PUD THAT'S BEEN AROUND FOR 12 YEARS.
AND THAT DOES NOT SEEM TO ME TO BE, UH, FAIR TO THE COMMUNITY.
A LOT OF THE PRIORITIES AND NEEDS OF THE COMMUNITY HAVE CHANGED.
AND TO MY VISION, UH, FOR THE NORTH END OF KYLE, I GET THAT THERE'S SOME BUSINESS PARKS BEHIND THAT.
BUT A BUILDING AS PICTURED HERE, WHICH I BELIEVE IS A RETAIL WAREHOUSE ACTUALLY, IF I UNDERSTAND THINGS CORRECTLY, UM, IS SHOWS UP IN ROYAL BLUE AND, AND, AND, UH, SOME KIND OF, UH, UH, EARTH COLOR TILT WALL THAT DOESN'T, THAT DOESN'T, THAT DOESN'T SEEM TO FIT THE OVERLAY REQUIREMENTS IN PLACE NOW.
UM, SO IS THERE, UH, SOMETHING YOU COULD TELL ME ABOUT MEETING THE OVERLAY STANDARDS WITH THESE COLORS AND SO FORTH? SO THE CONCRETE TILT WALL IS ALLOWED PER THE I 35 OVERLAY, AND IT IS ALSO ALLOWED PER THE PUD.
AND, UM, WILL, I THINK YOU WERE GETTING READY TO CHIME IN IT, CORRECT ME IF I'M WRONG, BUT WAS THE PUD NOT APPROVED IN 2019 OR WAS IT THERE WAS AN AMENDMENT IN 2019 TO THE PUD.
SO, UH, WILL ATKINSON, THE PLANNING DIRECTOR FOR THE RECORD, SO IN, IN, TO GIVE Y'ALL SOME BACK HISTORY FROM A COMPREHENSIVE PLAN STANDPOINT, UM, PRIOR TO 2017 WHEN THERE WAS A, WE'LL CALL IT A MIDTERM UPDATE TO OUR COMP PLAN WAREHOUSE AND, UM, CONSTRUCTION MANUFACTURING, WHICH IS OUR LIGHT INDUSTRIAL ZONING DISTRICT, THEY WERE ALLOWED ALONG THE I 35 CORRIDOR.
UM, AT THAT TIME, UH, THE CITY COUNCIL DIRECTED THE PLANNING AND ZONING COMMISSION TO LOOK AT THE, THE LAND USE DISTRICTS AND MAKE PROPOSED AMENDMENTS.
AND THEY DID, AND THAT WA ONE OF THOSE AMENDMENTS WAS TO REMOVE THOSE, THOSE TWO ZONING DISTRICTS FROM THE, UH, FROM THE I 35 CORRIDOR IF ESSENTIALLY, BUT THIS PUD ORIGINALLY, AND I DON'T HAVE THE DATE IN FRONT OF ME OR THE ORDINANCE, UH, IT WAS, IT WAS ENTITLED BEFORE 2017, BUT AFTER 2010, SO RIGHT.
BUT YEAH, IT WAS ALMOST TILL THE WEEK AT 12 YEARS AGO.
AND SO THE ZONING OF PLACE IS ALLOWED, BUT THEY'RE ALLOWED TO HAVE WAREHOUSING TYPE BUILDINGS IN THERE.
NOW I KNOW FROM, FROM, AS A, A DESIGN STANDPOINT, UM, THE LOTS THAT ARE BETWEEN THIS LOT AND THE I 35 FURNACE ROAD, THEY ACTUALLY FACE ONTO THE FRONTAGE ROAD.
THOSE ARE SUPPOSED TO BE INTENDED E ESSENTIALLY WHEN IT GETS DOWN TO IT FROM MORE OF A, A POINT OF SALE, MORE RETAIL, MAYBE SOME OFFICE USES TO KIND OF SHIELD THAT IN THE END.
UM, BUT IN THIS CASE, UM, THEY'RE, THEY'RE ALLOWED TO BE, BE THERE.
UH, ONE OF MY CONCERNS, UM, THAT YOU'RE ADDRESSING IN PART IS THAT THERE WAS A CHANGE THERE, THE ORIGINAL VISION THAT INVOLVED MIXED USE IN THAT AREA AS I UNDERSTAND IT, AND WITH THE PICTURES AND DIAGRAMS AND SO FORTH.
AND SO IT SEEMS LIKE, UH, THE ORIGINAL INTENT OF THE PLANNING WAS ABANDONED.
AND, UH, IF NOTHING ELSE, I WOULD JUST LIKE TO POINT OUT THAT THIS IS THE KIND OF THING TO ME AS A, AN EXAMPLE OF EXACTLY WHERE COMP PLANNING AND ZONING AND P AND Z DECISIONS CAN GO AWFULLY WRONG.
UM, BECAUSE WE ARE, WE ARE, WED WITH SOMETHING THAT, UH, PREEXISTS US BY SEVERAL CITY COUNCIL, SEVERAL P AND Z COMMISSIONS, AND WE WIND UP, UH, WITH SOMETHING, I'M NOT SURE I'M COMPLETELY COMFORTABLE WITH GIVING THE, UH, THE APPEARANCE OF THE BUILDING TO BE QUITE FRANK.
SO I'LL JUST LEAVE THAT FOR THE RECORD.

SO WHETHER IT'S RETAIL, SHELL, WAREHOUSE, WAREHOUSE, SHELL,

WHATEVER, IF IT'S, IF WE DON'T HAVE AN END USER IN MIND, UM, IT'S, AND IT'S BASED ON, YOU KNOW, NUMBER OF EMPLOYEES OR THINGS LIKE THAT.UM, IT'S KIND OF BEST GUESS FOR END USERS.
SO YOU KIND OF CONSIDER ALL THE POSSIBLE USERS FOR A WAREHOUSE KIND OF BASED ON SQUARE FOOTAGE AND THE TYPE OF BUSINESS, YOU CAN KIND OF GUESS HOW MANY, UM, EMPLOYEES THERE WILL BE.
UM, AND SO THAT'S WHERE THAT 231 NUMBER CAME FROM.
IT'S THE, UH, 55 REQUIRED PER THE SQUARE FOOTAGE AND THEN ALSO THE ONE FOR EVERY ONE AND A HALF EMPLOYEES.
THAT WAS BEST GUESS AT THE TIME.
AND IN THIS CASE, WE KNOW THE END USER IS GOING TO BE PRO SOURCE, SO WERE THEY ABLE TO, THEY PROVIDED THAT ESTIMATE OR DID THE CITY TELL THEM, HERE'S WHAT WE THINK YOU NEED TO, TO USE? UM, SO THIS WAS PERMITTED, UM, AS A SHELL BUILDING AT THE TIME.
AND SO WHEN IT WENT THROUGH THE SITE DEVELOPMENT PERMIT, IT WAS BEST GUESS, UM, BASED ON POTENTIAL USERS.
WELL, SO THAT'S A DIFFERENT PROCESS THAN THIS ONE.
UM, I DON'T HAVE, WILL, I CAN SEND FOR THE RECORD ONE MORE TIME.
UM, WHEN, WHEN WE ARE TALKING ABOUT BEST GUESSES, IT IS IN COORDINATION WITH THE, WITH THE DEVELOPER AND ALL THAT.
AND THEY USUALLY, THERE'S A, AND I, AGAIN, I DON'T HAVE THAT IN FRONT OF ME, BUT THERE'S AN ENERGY STAR RATING THAT GENERALLY THAT, UM, FROM THE FEDERAL GOVERNMENT BASED ON HOW MANY PEOPLE PER SQUARE FEET AND WHAT HAVE YOU.
AND THAT'S GENERALLY WHERE WE, WHAT WE USE.
AS A RULE OF THUMB, IT'S NOT BUILT INTO THE CODE, BUT WE'VE DONE THAT WITH A FEW OTHER PROJECTS IN TOWN.
UH, A COUPLE OF THEM BEING OVER ON REPUBLIC DRIVE ACROSS THE INTERSTATE.
UM, IT'S A WAREHOUSE OWNED AREA AND THEY'RE BUILDING SOME, A COUPLE SMALLER SHELL BUILDINGS, BUT THEY'VE ACCOUNTED FOR IN THAT MANNER.
UM, AND THERE WAS, THERE WAS AT LEAST ANOTHER ONE SOMEWHERE IN THIS DEVELOPMENT AS WELL THAT WE DID THE SAME THING.

AND I THINK THAT THIS ABSOLUTELY FITS THAT.
I WILL ALSO SAY THAT I THINK THAT, UH, WHEN IT COMES TO PARKING SPACES, WE SHOULD BE REALLY CAREFUL ABOUT NOT, YOU KNOW, YES, THEY WERE ALLOWED 55, BUT WE SHOULDN'T BE LOOKING FOR LESS.
IF THEY'RE WILLING TO GIVE MORE, LET THEM GIVE MORE.
I THINK THAT'S A REALLY IMPORTANT PART OF, WE, WE WANT SPACES IN OUR AREA WHICH PEOPLE CAN PARK TO GO TO AT WORK, ESPECIALLY IF THEY'RE RIGHT THERE AT WORK.
I THINK THAT THESE KIND OF THINGS MIGHT BE A LITTLE EXCESSIVE FOR US TO APPROVE SOMETHING.
SO THAT'S WHY I'M VOTING IN FAVOR OF IT.

UM, IF YOU LOOK AT THE SOUTH ELEVATION, THERE'S QUITE A LARGE AWNING OVER A SINGLE DOORWAY, BUT THEN ON THE SAME WALL THERE ARE WHAT LOOK LIKE THREE KIND OF SETS OF DOUBLE DOORS THAT DON'T HAVE A COVER OVER THEM.
SO I DON'T QUITE UNDERSTAND THAT.
AND THEN THE NORTH ELEVATION, THERE'S A LARGE AWNING OVER NOTHING.
UM, SO I DO SUPPORT THE USE OF AWNINGS ON THIS BUILDING.
I THINK IT'S AN APPROPRIATE ARCHITECTURAL FEATURE WHEN IT'S PRACTICAL AND IT'S SCALED THE RIGHT WAY AND IT'S SERVING A PURPOSE.
