CALL THE REGULARLY[I. Call Meeting to Order]
SCHEDULED CITY COUNCIL MEETING TO ORDER.THE TIME IS 7:03 PM IT IS TUESDAY, FEBRUARY THE FIFTH, AND I'M GONNA CALL THIS REGULARLY SCHEDULED CITY COUNCIL MEETING TO ORDER WOULD ALL PLEASE RISE TO THE PLEDGE OF ALLEGIANCE.
I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND INJUSTICE FOR ALL.
WOULD THE CITY SECRETARY PLEASE CALL THE RULE MITCHELL? HERE.
[II. Approval of Minutes]
THE MINUTES.PARSLEY, DID YOU CALL ME? OH, OKAY.
ALRIGHT, MAYOR, I'D LIKE TO GO AHEAD AND MAKE A MOTION TO APPROVE THE MINUTES FOR SPECIAL COUNCIL MEETING FOR AUGUST THE 10TH, SPECIAL MEETING FOR AUGUST 15TH AND REGULAR MEETING FOR AUGUST THE 15TH, INCLUDING THE, UH, SPECIAL CITY COUNCIL MEETING FOR THE 29TH AND INCLUDING THE SPECIAL MEETING ON THE 29TH AS WELL FOR THOSE DAYS.
SECOND BY COUNCIL MEMBER PARSLEY THAT WE APPROVE.
AGENDA ITEMS ONE THROUGH FIVE ON THE MINUTES.
IS THERE DISCUSSION ON THE MOTION? ALL THOSE IN FAVOR SAY AYE.
ALL OPPOSED? MOTION CARRIES SEVEN TO ZERO.
ALRIGHT, NEXT UP IS OUR CITIZEN
[III. Citizen Comment Period with City Council]
COMMENTS PERIOD.AT THIS TIME, WE ASK ANYONE IN THE AUDIENCE WHO WISHES TO COME FORWARD AND SPEAK ON ANY ITEM, PLEASE DO SO.
UH, WE DO ASK THAT YOU LIMIT YOUR COMMENTS TO THREE MINUTES AND THAT DIRECT YOU DIRECT THOSE COMMENTS TO THE MAYOR AND COUNCIL.
WE ALSO ASK THAT YOU FILL OUT A CITIZEN COMMENTS FORM AND SUBMIT THAT TO EITHER MYSELF OR THE CITY SECRETARY.
I HAVE ONE REGISTERED TO SPEAK.
UH, MR. DOMINGO, CAST MAYORS CITY COUNCIL.
MY NAME IS DOMINGO ROCA CAST AND MY COMMENTS HAVE TO DO WITH THE UPCOMING ELECTION.
I SEE THE SIGNS ALREADY ALL OVER THE PLACE AND WHAT I LIKE TO RECOMMEND IS, ONCE AGAIN, WHAT I RECOMMEND LAST TIME IS AN OPEN FORUM VERY SIMILAR TO WHAT YOU HAVE RIGHT NOW IN THE CITY COUNCIL, WHERE ALL THE PROSPECTIVE CANDIDATES ARE UP IN FRONT AND LIVESTREAM ALSO, SO IT CAN REACH A GREATER AUDIENCE THAN KYLE.
'CAUSE RIGHT NOW, I WOULD IMAGINE AT THE MOST 5% OF THE PEOPLE IN CITY OF KYLE KNOW WHO THE CANDIDATES ARE, WHAT THEY'RE RUNNING FOR, WHAT THEIR BACKGROUNDS ARE.
I THINK THE CITIZENS OF KYLE, UH, HAVE THE RIGHT TO UNDERSTAND ALL THE CANDIDATES, THEIR BACKGROUNDS, AND HOW THEY PLAN TO SPEND ALL THE MILLIONS DOLLARS THAT ARE BEING, UH, COLLECTED VIA OTHER PROPERTY TAXES.
ALRIGHT, THAT IS ALL OF THE COMMENTS FORMS THAT I HAVE.
IS THERE ANYONE ELSE IN THE AUDIENCE WHO WISHES TO COME FORWARD AND SPEAK? ALRIGHT, SEEING NONE, I'M GONNA CLOSE.
CITIZEN COMMENTS, IT'S NOW CLOSED.
[6. Agenda Order per Rules of Council Sec. B1. ~ Travis Mitchell, Mayor]
REQUESTS TO MOVE ANY OF THE ITEMS AROUND ON THE AGENDA? COUNCILOR KEL.I WOULD LIKE TO, UM, MOVE AGENDA ITEM 36 UP TO PRESENTATION AND DISCUSSION.
ALRIGHT, DOES ANYBODY HAVE ANY OBJECTION TO MOVING AGENDA ITEM 36 TO, UH, REPORTS AND PRESENTATIONS? ALL RIGHT.
[7.
Consider appointments to the Planning & Zoning Commission to fill current vacancies for terms expiring on September 30, 2023 and to continuing to serve a following term beginning October 1, 2023 and expiring September 30, 2025. ~ Will Atkinson, Director of Planning
I'M SORRY, IS APPOINTMENTS CONSIDER APPOINTMENTS TO THE PLANNING AND ZONING COMMISSION TO FILL CURRENT VACANCIES FOR TERMS EXPIRING ON SEPTEMBER 30TH, 2023, AND TO CONTINUING TO SERVE, UH, FOLLOWING TERM, BEGINNING OCTOBER 1ST, 2023 AND EXPIRING SEPTEMBER 30TH, 2025.
ALL RIGHT, UH, WILL ATKINSON, PLANNING DIRECTOR FOR THE RECORD, UH, BEFORE YOU, WE HAVE TWO, UH, APPOINTMENTS TO FILL FOR SEATS FIVE AND SEAT NUMBER SEVEN, UH, CURRENTLY, UM, UM, ALEX WAS OUR PREVIOUS, UH, PLANNING AND ZONING CHAIR.
HE HAS SINCE MOVED OUT OF THE CITY SO HE CAN NO LONGER BE THAT AND THE CHAIR.
SO HE, UH, HE HAD STEPPED DOWN.
AND THEN ALSO, UM, WE HAVE THE APPOINTMENT FOR, FROM MATT CHASE.
UH, HIS WORK DUTIES HAVE BECOME SO HIGH AND STRINGENT AT THIS POINT THAT HE HAS ALSO STEPPED DOWN.
SO WE'RE LOOKING TO REPLACE THOSE.
SO WE HAD TWO, UM, TWO INTERVIEWS.
UM, ONE WAS FOR TRACY SHIELD FOR SEAT FIVE.
UH, SHE'S A FORMER CITY COUNCIL MEMBER FROM NOVEMBER 27TH TO NOVEMBER, 2020.
AND SHE WAS A CITY OF KYLE PARD BOARD
[00:05:01]
MEMBER FROM OCTOBER, 2015 AND OCT THROUGH OCTOBER, 2017.SHE'S CURRENTLY ON THE WATER LEAF, H O A BOARD AND ALSO ON THE COUNTY LINE S U D BOARD.
AND WE DO RECOMMEND APPROVING THIS APPOINTMENT.
THE OTHER ONE IS DANIEL SERRATO.
UM, HE, UM, BOTH OF THESE TWO TERMS ACTUALLY, UM, WE ARE ASKING TO FILL THE FINISH OUT TERMS FOR SEPTEMBER 30TH AND ALSO TO THE FOLLOW UP TWO, YOUR APPOINTMENT, JUST SO Y'ALL ARE AWARE.
UH, BUT DANIEL SERATO, HE MOVED TO KYLE ALMOST TWO YEARS AGO FROM HOUSTON.
HE'S AN EXPERIENCE, HAS EXPERIENCE AS A SALES EXECUTIVE AND ACCOUNT MANAGER, AND HE IS VERY MUCH INTERESTED IN HOW DEVELOPMENT OCCURS AND WANTS TO HELP GUIDE IT THROUGH THE CITY WITH OUR GOLD STANDARD.
UH, SO WE ALSO RECOMMEND APPROVING THAT APPOINTMENT AS WELL.
DOES ANYBODY HAVE ANY QUESTIONS OR COMMENTS? MAYOR PRO TEMP, HOW MANY, UM, APPLICANTS SUPPLIED FOR THESE TWO SEATS? YES, SIR.
ONE OF THEM WAS NOT, UH, QUALIFIED TO BE ON THE, UM, PLANNING HIS ZONING MACHINE 'CAUSE HE DOES NOT LIVE WITHIN THE CITY OF KYLE THAT THE APPLICANT LIVES IN DELL VALLEY.
SO HE WAS NOT ABLE TO, SO WE HAD A TOTAL OF THREE.
SO TOTAL OF THREE, BUT JUST THEN WE CAME DOWN TO THESE TWO.
HOW LONG WERE THE APPLICATIONS OPEN FOR? I BELIEVE FOR ABOUT A MONTH.
DO WE USUALLY LEAVE IT OPEN FOR A LITTLE BIT LONGER? I THOUGHT IT WAS SIX WEEKS, BUT I COULD BE MISTAKEN.
IT DEPENDS ON THE, THE URGENCY OF THE NEED TO GET THE, THE SEATS FILLED AND WHAT HAVE YOU, DEPENDING ON THE SITUATION.
UM, AND UH, WE WERE WORKING TO TRY TO GET THOSE FILLED PRETTY QUICKLY.
UM, MOSTLY BECAUSE WE WANTED, UM, THE OPPORTUNITY FOR THE PEOPLE WHO HAD STEPPED DOWN TO BE ABLE TO ACTUALLY STEP DOWN SPECIFICALLY IN MATT CHASE'S CASE.
UM, BUT UM, THERE WAS A LOT OF PUBLIC OUTREACH ON SOCIAL MEDIA AND WHAT HAVE YOU.
UM, AND ALSO ON THE CITY'S WEBSITE, WE DID TRY TO MAKE SURE THAT THE GENERAL PUBLIC WAS AWARE THAT THERE WERE TWO OPENINGS AVAILABLE.
BUT, AND THERE'S NO WAY THAT YOU GUYS ARE WILLING TO OPEN IT BACK UP FOR ANOTHER FEW WEEKS TO GET, UH, MORE APPLICANTS IF, IF THAT IS COUNSEL'S, UH, WISH WE CAN ABSOLUTELY DO THAT.
WELL, MY, IS THERE QUORUM? IS QUORUM MET CURRENTLY? CURRENTLY QUORUM IS MET, BUT THERE ARE OCCASIONS TO WHERE, FOR EXAMPLE, IF IN A P AND Z COMMISSIONER FOR WHATEVER REASON, IS NOT ABLE TO MAKE THE MEETING IF THEY'RE SICK OR THEY HAVE SOME OTHER ISSUE THAT THEY CAN'T MAKE, SOMETIMES THAT DOES CAUSE ISSUES.
WE, WE, UH, EXPERIENCED THAT LAST YEAR WHEN WE WERE TRYING TO GET THE CURRENT BOARD UP TO UP TO PAR AND, UH, WE'D LIKE TO AVOID THAT.
UH, DO WE KNOW HOW THE CANDIDATE FOUND OUT IN VALLEY, FOUND OUT ABOUT THE APPLICATION HERE IN KYLE? NOT SPECIFICALLY, NO.
I WOULD LIKE TO KEEP THIS OPEN FOR ANOTHER TWO WEEKS.
COLLECT MORE APPLICATIONS IF POSSIBLE.
I DON'T KNOW IF ANYBODY'S AMENABLE TO IT.
I JUST, ACTUALLY, IF YOU DON'T MIND, I HAVE ONE MORE QUESTION.
IF I CAN HAVE TRACY SHIELD COME UP PLEASE? TRACY SHIELD FOR THE RECORD.
I KNOW YOU'VE BEEN ON COUNCIL BEFORE AND YOU'VE GIVEN SOME OF YOUR EXPERTISE ON HERE.
WHAT IS YOUR MOTIVATION TO COME BACK TO PLANNING AND ZONING? WHY ARE YOU DOING THIS AGAIN? APPARENTLY, UM, I HAVE THIS INSANE INEXCUSABLE OR JUST
UM, IN 2003, AS A 35 YEAR OLD SINGLE FEMALE, THERE WAS ONLY REALLY ONE PLACE I COULD AFFORD TO BUY A HOUSE ON MY OWN.
KYLE GAVE ME THE CHANCE TO BE ABLE TO LIVE IN A CITY, BE A PART OF A CITY, AND, UM, BE ABLE TO HAVE MY OWN HOME AND BE ABLE TO SAY, THIS IS MINE AS A SINGLE FEMALE.
AND I JUST, I WANNA GIVE BACK TO THE CITY.
I KNOW THERE MAY HAVE BEEN SOME SITUATIONS WHERE, UM, HOW DO I PUT THIS? I, NOT TO TO TO BRING SOMETHING IN LIGHT, BUT, UM, WE HAVE A VERY DIVERSE COMMUNITY HERE.
WHERE WE HAVE A LOT OF PEOPLE THAT COME FROM DIFFERENT BACKGROUNDS MM-HMM.
SO IF WE'RE LOOKING AT ANY PLANNING AND ZONING KIND OF CAPACITY BEING ON A COMMISSION MM-HMM.
[00:10:01]
HOW CAN I MAKE SURE THAT THE DECISIONS THAT YOU'RE MAKING GOING FORWARD INTO THIS VERY DIVERSE COMMUNITY IS GOING TO BENEFIT THE CITY AS A WHOLE? ALL I CAN GIVE YOU IS MY WORD AND I FEEL MY WORD IS MY BOND.UM, I DON'T HAVE ANY, UH, ANY DISCRIMINATIONS OR ANYTHING AGAINST ANY, ANY CULTURES.
UM, YOU KNOW, I CAN'T SAY ANYTHING MORE THAN THAT.
AND LIKE I SAID, YOU, YOU'VE BEEN ON COUNCIL MM-HMM.
AND WE'VE, IT IS BEEN VERY RESPECTED, YOUR WORK AND, UH, A LOT OF IT HAS DONE SHOWN IN YOUR NAME OR, OR IS ON SOME LANDMARKS HERE.
UH, JUST IF WE GO THROUGH WITH YOUR NOMINATION, I JUST WANNA MAKE SURE THAT WE ARE LOOKING AT THE WORK THAT YOU'RE DOING IS IN A VERY POSITIVE WAY FOR OUR COMMUNITY AND, AND BRINGING FORTH TO WHERE WE CAN IF WE HAVE TO LOOK AT DEVELOPMENTS, ESPECIALLY WEST AND EAST OF KYLE MM-HMM.
I'D LIKE TO MAKE A MOTION TO APPROVE AGENDA ITEM NUMBER SEVEN, SECOND MOTION BY THE MAYOR, SECONDED BY COUNCIL MEMBER, UH, ZUNIGA IS THEIR DISCUSSION ON THAT MOTION.
I JUST WANTED TO SAY CUSTOMER, UH, THANK YOU FOR STEPPING UP TO SERVE ON P N Z AS A CANDIDATE.
UM, WHAT YOU, ARE YOU STILL GONNA REMAIN ON THE, UH, ARAWA COUNTY LINE BOARD AGAIN? TRACY SHIELD FOR THE RECORD? YES.
UM, I AM ON COUNTY LINE, UH, THE SPECIAL UTILITY DISTRICT BOARD.
THAT REALLY DOESN'T TAKE TOO MUCH OF MY TIME.
THAT JUST TAKES SOME RESEARCH PRIOR TO THE BOARD MEETING.
SAME WITH, AND I'M NOT ON ARAWA, BUT I AM ON CAN CANYON REGIONAL WATER AUTHORITY, WHICH IS ONE NIGHT A WEEK.
AGAIN, IT'S JUST MAKING SURE I DO MY RESEARCH PRIOR TO THE MEETING.
TRACY, I, I KNOW YOU PERSONALLY FROM THE, UM, NEIGHBORHOOD MM-HMM.
AND, UH, THANK YOU FOR BEING SUCH AN INVOLVED AND ENGAGED, UH, PERSON, UM, AND ALWAYS DOING THE BEST YOU CAN FOR THIS COMMUNITY.
SO I APPRECIATE SEEING, APPRECIATE THAT.
ALRIGHT, COUNCIL MEMBER FLOKI, IS IT POSSIBLE TO MAKE THE MOTION TO TWO DIFFERENT VOTES, PLEASE.
UM, WELL I, UM, I FOUND THE MOST EFFICIENT WAY TO HANDLE A DIFFICULT SITUATION IS NOT TO GO AROUND IT, BUT TO WALK RIGHT THROUGH IT.
UH, WHICH IS HOW I WILL CHOOSE TO HANDLE THIS DISCUSSION.
I'VE HAD SEVERAL SOCIAL INTERACTIONS WITH APPLICANT FOR SEAT FIVE, WHICH I FOUND TO BE DEROGATORY AND DEMEANING TO ME AS A MINORITY, AS A LEADER FOR THE CITY OF KYLE, I FIND IT TO BE MY DUTY TO ENSURE ALL REPRESENTATIVES OF THE CITY ARE HELD TO THE HIGHEST STANDARD, INCLUDING VOLUNTEERS, BOARD MEMBERS, AND COMMISSIONERS.
IT IS NOT MY INTENT TO OVERSTATE MY FEELINGS BEING TOLD THAT I WON MY ELECTED SEAT BECAUSE OF MY LAST NAME.
SINCE MEXICANS DUNNO HOW TO VOTE WAS HARD TO HEAR.
I FELT A WAY THAT I'D NEVER WANT ANOTHER PERSON, ESPECIALLY A RESIDENT, TO FEEL I HAVE MADE A POINT TO CONTINUE TO BE PROFESSIONAL AND KIND IN EVERY INTERACTION WITH THE APPLICANT SINCE THE INCIDENT.
HOWEVER, THIS IS NOT THE ONLY INCIDENT THAT HAS OCCURRED.
BESIDES MY PERSONAL INTERACTIONS WITH THE APPLICANT, I HAVE RECEIVED NUMEROUS OTHER COMPLAINTS REGARDING THE SAME ISSUES.
MOST NOTABLY DURING THE KYLE FAIR.
I NEED TO STATE THAT ALMOST EVERYONE ON THE COUNCIL EITHER KNOWS OR WAS PRESENT DURING MY ORIGINAL INTERACTION EACH TIME THE APPLICANT APPLIES.
AND I MUST CONSIDER THEM FOR A VOLUNTEER POSITION.
I FEEL LIKE I'M BEING PLACED IN A BAD POSITION IF ANYONE FEELS I'M BEING CRITICAL, HARSH, OR JUDGMENTAL.
MY QUESTION TO YOU IS, HOW DO YOU THINK I FELT? I KNOW I COME ACROSS AS BEING ABLE TO HANDLE THIS TYPE OF INTERACTION, BUT I'M HUMAN AND I HAVE FEELINGS.
I CANNOT KNOWINGLY ALLOW AN OPPORTUNITY FOR ANYONE ELSE TO BE AFFECTED THE WAY I HAVE BEEN.
I WANT TO EXPRESS MY APPRECIATION FOR ANYONE WHO WANTS TO VOLUNTEER THEIR TIME TO SERVE OUR COMMUNITY.
HOWEVER, I CANNOT IN GOOD FAITH VOTE YES FOR ANYONE WHO I FEEL DOES NOT REPRESENT THE VALUES OF THE CITY.
ANYONE ELSE? I'LL SAY MY COMMENTS.

I BELIEVE IT'LL BE READY OR IF IT'S LIT UP GREEN.
UH, I THINK THE GREATEST PART ABOUT MY PROJECT IS THAT IT'S BEING USED.
I'VE ALREADY SEEN PEOPLE USING IT.
'CAUSE MY MOM WORKS AT THE PORTABLES, LIKE HIGH ELEMENTARY.
AND SO YOU CAN SEE THAT IT'S ALREADY BEING USED AND CHILDREN IN LIKE ELEMENTARY SCHOOLERS ARE ABLE TO ENJOY THAT.
SO I FEEL LIKE MY PROJECT IS ACTUALLY BEING USED.
DOES ANYBODY HAVE ANY COMMENTS FOR NOAH? MAYOR POTENT, YOU ARE AN SHINING EXAMPLE OF OUR YOUTH TODAY.

UH, WE WORK WITH STAFF, WE WORK WITH THE CITY'S FINANCIAL ADVISOR, SAMCO CAPITAL MARKETS, AND WE ALSO WORKED WITH, UH, CITY ATTORNEY AND, UH, P THREE, WHICH IS THE CITY'S PIT AND TOURISM ADMINISTRATOR.
WE HAVE REPRESENTATIVES FROM BOTH SAMCO AND P THREE, UH, WITH ME TONIGHT IN CASE YOU
[00:35:01]
ALL HAVE ANY QUESTIONS AS WE MOVE THROUGH THIS PRESENTATION.FOR THE PRESENTATION ITSELF, IT'S REALLY JUST DESIGNED TO PROVIDE YOU ALL WITH AN OVERVIEW OF THE VARIOUS TYPES OF FINANCINGS OR TOOLS THAT ARE AVAILABLE TO INCENTIVIZE ECONOMIC DEVELOPMENT WITHIN THE CITY.
UM, SO THIS PRESENTATION IS REALLY INTENDED TO BE HIGH LEVEL, BUT TO THE EXTENT THAT YOU HAVE ANY QUESTIONS OR YOU'D LIKE FOR US TO GO IN DEPTH, UH, ANY TO, TO ANY DEGREE THROUGH WHICH THE PRESENTATION'S NOT CURRENTLY DRAFTED, WE'RE HAPPY TO DO THAT AS WE WALK THROUGH, UH, AS WE WALK THROUGH THE PRESENTATION.
SO, FOR ECONOMIC DEVELOPMENT, WHEN WE USE ECONOMIC DEVELOPMENT, UH, DISCUSSIONS, WE'RE REALLY INTENDING TO CAPTURE PROGRAMS, PROJECTS, AND ACTIVITIES THAT ARE INTENDED TO PROVE, IMPROVE THE ECONOMIC WELLBEING AND QUALITY OF LIFE FOR RESIDENTS WITHIN THE CITY.
SO VARIOUS TYPES OF ECONOMIC DEVELOPMENT TOOLS THAT WE'LL WALK THROUGH THIS EVENING.
SOME OF THEM YOU ALL WILL BE FAMILIAR WITH FROM PREVIOUS FINANCINGS THAT THE CITY'S DONE.
AND SOME WILL BE, UH, CONCEPTS THAT MAY BE INTRODUCED FOR THIS FIRST TIME.
SO WE'LL BRIEFLY TOUCH ON PITS TURDS, PITS OVERLAYS, CHAPTER THREE 80, ECONOMIC DEVELOPMENT PROGRAMS, HOTEL OCCUPANCY, TAX VENUE PROJECTS, MUNICIPAL MANAGEMENT DISTRICTS, MUNICIPAL UTILITY DISTRICTS, ECONOMIC DEVELOPMENT CORPORATIONS, AND THEN LOCAL GOVERNMENT CORPORATIONS, PUBLIC FACILITY CORPORATIONS, AND THEN OTHER TYPES OF SPECIAL LEGISLATION.
SO THE CITY AND CITY COUNCIL IS GONNA BE WELL VERSED WITH PUBLIC IMPROVEMENT DISTRICTS BECAUSE THERE HAVE BEEN A NUMBER OF PUBLIC IMPROVEMENT DISTRICTS THAT HAVE, UH, FUNDED PUBLIC INFRASTRUCTURE IN THE CITY OF KYLE IN RECENT HISTORY.
SO THE PITTS THEMSELVES ARE GOVERNED BY CHAPTER 3 72 OF THE LOCAL GOVERNMENT CODE.
AND THERE ARE DEFINED AREAS CREATED WITHIN THE CITY, NOT SEPARATE POLITICAL SUBDIVISIONS, BUT A COMPONENT PART OF THE CITY.
AND THEY'RE USED TO FINANCE A WIDE ARRAY OF PUBLIC IMPROVEMENTS, WHICH CONFER A SPECIAL BENEFIT ON AREAS WITHIN THE DISTRICT.
THROUGH THE PUBLIC IMPROVEMENT DISTRICTS REVENUE BONDS CAN BE ISSUED THAT ARE SECURED BY SPECIAL ASSESSMENTS LEVIED WITHIN THE DISTRICT ITSELF, WHICH MEANS THAT THE DISTRICTS ARE INTENDED TO BE SELF-SUPPORTING.
SO NO OTHER CITY TAXES OR OTHER REVENUES ARE PLEDGED TO SUPPORT THOSE BONDS.
AND YOU CAN YOU CREATE A CONCEPT THROUGH WHICH DEVELOPMENT CAN PAY FOR ITSELF.
CITIES CAN USE PS TO LEVERAGE OR INCENTIVIZE DEVELOPMENT THAT THE CITY INTENDS TO SEE A DESIRES TO SEE WITHIN ITS BOUNDARIES.
NEXT, WE'LL TALK ABOUT, UH, TAX INCREMENT ZONES.
TAX INCREMENT ZONES ARE GOVERNED BY CHAPTER THREE 11 OF THE TEXAS TAX CODE.
AND AGAIN, A TAX INCREMENT ZONE IS A DEFINED AREA DISTRICT WITHIN THE CITY'S CORPORATE LIMITS, WHERE COURT, WHERE A CITY OR OTHER LOCAL GOVERNMENT CAN CONTRIBUTE ALL OR A PORTION OF TAX REVENUES THAT ARE GENERATED WITHIN THAT ZONE.
CONTRIBUTIONS CAN BE EITHER FROM AVALOR TAXES OR SALES TAXES THROUGH THE CREATION OF A TAX INCREMENT AND REINVESTMENT ZONE.
IT'S POSSIBLE FOR OTHER LOCAL GOVERNMENTS THAT ALSO LEVY AND COLLECT TAXES WITHIN THE ZONE TO CREATE OR TO PARTICIPATE IN A ZONE THAT HAS BEEN CREATED BY THE CITY.
AGAIN, THE CITY MAY ISSUE TOURISM REVENUE BONDS TO FINANCE PUBLIC IMPROVEMENTS WHICH BENEFIT PROPERTY WITHIN THE ZONE.
NEXT WE'LL JUST WALK THROUGH A CONCEPT THAT I THINK, THINK THE CITY HAS HAS SEEN A COUPLE OF TIMES, AND THAT'S KIND OF A PIT TURS OVERLAY.
AND THAT'S WHERE YOU TAKE THE FINANCING POWER OF THE PIT AND THE FINANCING POWER OF A TS AND YOU USE THOSE IN CONJUNCTION WITH EACH OTHER SO THAT A PIT ASSESSMENT IS LEVIED OVER THE PROPERTY TO PAY FOR PUBLIC IMPROVEMENTS.
BUT THEN TOURS, REVENUES CAN BE USED TO BUY DOWN THAT PIT PIT ASSESSMENT ON AN ANNUAL BASIS.
SO WHAT YOU DO THERE IS BASICALLY YOU INCENTIVIZE THE PUBLIC IMPROVEMENT, YOU ALLOW FOR THE INFRASTRUCTURE TO BE PLACED IN SERVICE SOONER THAN WHAT MAY OTHERWISE BE INTENDED WITH THET.
BUT THE NET EFFECT TO THE ULTIMATE PROPERTY OWNER IS, UM, IS REDUCED BECAUSE A PORTION OF WHAT THEY PAY IN THEIR CITY, AVALARA TAXES IS USED TO BUY DOWN THEIR PIT ASSESSMENT ON AN ANNUAL BASIS.
WE HAVE A COUPLE OF SLIDES THAT COME OVER INTENDED TO SHOW FROM A FINANCIAL STANDPOINT HOW THE P TOURS WORK IN CONJUNCTION WITH EACH OTHER, AND I'M SURE EITHER JOHN OR ANDREW WOULD BE HAPPY TO ANSWER ANY FINANCIAL QUESTIONS THAT YOU GUYS HAVE ABOUT THAT.
NEXT WE'LL MOVE ON TO CHAPTER THREE 80 PROGRAMS. CHAPTER THREE 80 IS AN ECONOMIC DEVELOPMENT PROGRAM WHERE THE CITY IS PROVIDING ECONOMIC DEVELOPMENT GRANTS.
SO IN ESSENCE, TURNING OVER PUBLIC DOLLARS TO A PRIVATE DEVELOPER IN EXCHANGE FOR
[00:40:01]
JOB CREATION OR OTHER TYPES OF ECONOMIC DEVELOPMENT PROGRAMS. THREE 80 IN AND OF ITSELF DOES NOT PROVIDE AN INDEPENDENT REVENUE SOURCE TO PAY FOR THAT PROGRAM.SO TO THE EXTENT THE CITY INTENDED TO CREATE A THREE 80 PROGRAM OR PROVIDE A THREE 80 GRANT TO A PRIVATE DEVELOPER, A SOURCE OF REVENUES FOR THAT GRANT WOULD HAVE TO BE IDENTIFIED.
CERTAIN HOME RULE CITIES, INCLUDING THE CITY OF KYLE, DO HAVE THE ABILITY TO VOTE GENERAL OBLIGATION BONDS.
SO YOU'D PUT A BOND PROPOSITION OUT TO THE VOTERS TO SPECIFICALLY ASK THEM FOR THE AUTHORITY TO ISSUE, UH, GENERAL OBLIGATION BONDS, WHICH THEN COULD IN TURN BE USED TO FUND ECONOMIC DEVELOPMENT GRANTS WITHIN THE CITY.
UM, NEXT WE'LL MOVE ON TO HOTEL OCCUPANCY TAXES.
HOTEL OCCUPANCY TAXES ARE GOVERNED BY 3 51 OF THE TEXAS TAX CODE.
WHEN THE CITY HAS SUFFICIENT NUMBERS OF, UH, HOTELS WITHIN ITS, UM, WITHIN ITS JURISDICTION, THOSE HOTEL OCCUPANCY TAXES CAN BE USED TO UNDERTAKE PROJECTS THAT PROMOTE TOURISM CONVENTIONS AND HOTEL INDUSTRIES WITHIN THE STATE.
SO THERE ARE LIMITS THROUGH WHICH, OR THAT SPECIFY HOW THOSE INCREMENTS OR HOW THE HOTEL OCCUPANCY TAX CAN BE UTILIZED.
SO AGAIN, UH, YOU CAN FINANCE CONVENTIONS, CENTER FACILITIES, HISTORICAL RES RESTORATION OR PRESERVATION PROJECTS, CERTAIN SPORTING EVENTS OR VENUES.
AND THEN THERE'S ALSO MONIES THAT CAN BE USED FOR, UH, ADVERTISING AND OTHER MECHANICS TO ACTUALLY, UM, INCENTIVIZE CONVENTIONS TO COME INTO THE CITY.
SIMILAR TO HOTEL OCCUPANCY TAXES AND HOTEL OCCUPANCY TAX BONDS.
THE CITY WOULD ALSO HAVE THE ABILITY TO VOTE VENUE PROJECTS UNDER CHAPTER 3 34, THE LOCAL GOVERNMENT CODE, AGAIN, TO DO A VENUE PROJECT.
THE CITY WOULD GO OUT TO THE VOTERS WITH A BOND PROPOSITION TO SEEK APPROVAL TO FINANCE, UH, A VENUE PROJECT.
CERTAIN TYPES OF VENUE PROJECTS OR VENUE PROJECTS ARE DEFINED TO INCLUDE STADIUMS AND ARENAS, CONVENTION CENTERS, UH, TOURIST DEVELOPMENT AREAS, MUNICIPAL PARKS AND RECREATION SYSTEMS, ECONOMIC DEVELOPMENT PROJECTS, AND THEN WATERSHED PROTECTION.
UM, WITHIN OR WHEN YOU VOTE THE VENUE PROJECT, YOU ALSO VOTE FOR THE TYPE OF REVENUE THAT WOULD BE USED TO SUPPORT THAT PROJECT.
AVAILABLE SOURCES OF FUNDS INCLUDE SALES TAX, HOTEL OCCUPANCY TAXES, CAR RENTAL TAXES, ADMISSION TAXES, AND PARKING TAXES TO THE EXTENT THAT YOU'RE VOTING AN ACTUAL, UH, VENUE OR CONVENTION CENTER PROJECT.
NEXT, WE'LL TALK ABOUT MMDS AND BUD S COMBINED.
UM, THERE ARE TWO SEPARATE TYPES OF POLITICAL SUBDIVISIONS, BUT IN A LOT OF WAYS THEY HAVE THE SAME TYPES OF POWERS.
UM, UNLIKE A PIT OR AURS, THE CREATION OF AN M M D OR A MUD IS THE CREATION OF A SEPARATE POLITICAL SUBDIVISION OF THE STATE OF TEXAS.
AND SO MDS AND MUDS HAVE US HAVE THE ABILITY, UM, TO LEVY AN AVALOR TAX, MUCH LIKE THE WAY THE CITY LEVIES AN AVALOR TAX ON RESIDENTS WITHIN THE DISTRICT.
AND M M D AND MUD ALSO BOTH HAVE THE ABILITY TO ISSUE BONDS THAT ARE PAYABLE FROM THAT, UH, AVALOR TAX IF THERE'S A SUCCESSFUL BOND ELECTION THAT'S BEEN APPROVED BY THEIR, UH, VOTERS.
MMDS AND MUDS ARE GOVERNED BY SEPARATE BOARD OF ELECT BOARD OF DIRECTORS THAT ARE ELECTED BY RESIDENTS WITHIN THE DISTRICT.
AND THEN FOR AN M M D PROJECTS THAT THEY CAN FINANCE ARE SIMILAR TO THOSE THAT ARE FINANCED BY A PIT.
UH, FOR MUDS, MUDS ARE GENERALLY MORE LIMITED AND THAT THEY ARE GENERALLY USED TO FINANCE WATER, SEWER ROADS, AND IN CERTAIN COUNTIES, INCLUDING HAYES COUNTY PARKS, UH, UNLIKE A P FUNDING MAY NOT BE PROVIDED PRIOR TO THE COMPLETION OF M M D PROJECTS OR MUD PROJECTS.
SO THERE ARE CERTAIN T C E Q RULES AND REGULATIONS THAT GOVERN BUDS AND MMDS, AND THEY GENERALLY REQUIRE THAT ALL PROJECTS ARE IN THE GROUND BEFORE A BOND ISSUANCE CAN OCCUR.
MOVING ON TO ECONOMIC DEVELOPMENT CORPORATIONS, ECONOMIC DEVELOPMENT CORPORATIONS, UH, ARE REFERRED TO AS EITHER TYPE A OR TYPE B CORPORATIONS BASED ON THE ORIGINAL STATUTE THROUGH WHICH THEY WERE ENACTED.
AND THESE CORPORATIONS ARE INTENDED TO FINANCE PROJECTS WHICH PROMOTE WELFARE OF THE RESIDENTS AND THE STATE BY SECURING AND RETAINING BUSINESS ENTERPRISES.
UNEMPLOYMENT OR EMPLOYMENT, ECONOMIC, UH, ACTIVITY AND STABILITY.
SO LIKE A THREE 80 GRANT THROUGH WHICH YOU'RE PROVIDING PUBLIC FUNDS, UH, SIMILAR TO THREE 80, YOU CAN PROVIDE GRANTS AND FUNDS THROUGH THE USE OF FOUR A AND FOUR B CORPORATIONS.
AND THEY ARE AUTHORIZED, UH, TO LIVE IN VALOREM TAX, OR SORRY, THEY'RE AUTHORIZED TO LIVE A SALES TAX, UM, TO SUPPORT AUTHORIZED PROJECTS BY THEIR STATUTE CORPORATION
[00:45:01]
IS CREATED BY THE CITY, ITS BOARD OF DIRECTORS WOULD BE APPOINTED BY THE CITY.THE CITY RETAINS OVERSIGHT OF THE CORPORATION, APPOINTS THE BOARD MEMBERS AND APPROVES ITS EXPENDITURES THROUGH AN ANNUAL BUDGET.
CITY ALSO HAS THE ABILITY TO ALTER OR LIMIT THE POWER STRUCTURE AND ORGANIZATION AND THE TYPES OF PROGRAMS THAT THE CORPORATIONS THEMSELVES PROVIDE.
THE CORPORATION IS AUTHORIZED TO ISSUE BONDS INDEPENDENT OF THE CITY.
THE CITY CAN SET IT UP SO THAT CITY CONSENT FOR BOND ISSUANCE WOULD BE REQUIRED, BUT THAT'S NOT A STATUTORY REQUIREMENT.
LOCAL GOVERNMENT CORPORATIONS ARE GOVERNED BY SUBCHAPTER D 4 31 OF THE TRANSPORTATION CODE.
CITIES CREATE LOCAL GOVERNMENT CORPORATIONS IN A LOT OF WAYS TO CREATE OFF BALANCE SHEET FINANCINGS.
MOST COMMON FINANCING STRUCTURE ASSOCIATED WITH A LOCAL GOVERNMENT CORPORATION IS A LEASE PURCHASE STRUCTURE WHEREIN A CORPORATION WOULD BE CREATED TO ISSUE REVENUE BONDS, UH, TO FINANCE A FACILITY THROUGH WHICH, UH, THROUGH WHICH THE CITY WOULD LEASE FROM THE CORPORATION.
THOSE LEASE PAYMENTS WOULD BE USED TO SECURE, UH, THE BONDS PUBLIC FACILITY.
CORPORATIONS ARE ALSO NON-PROFIT CORPORATIONS THAT CAN BE CREATED BY THE CITY, UH, TO FINANCE, ACQUIRE, CONSTRUCT, RENOVATOR REPAIR PUBLIC FACILITIES.
PUBLIC FACILITY CORPORATIONS ARE MOST COMMONLY USED, UH, TO EITHER FINANCE PUBLIC INFRASTRUCTURE OR FOR HOUSING DEVELOPMENTS.
LOW INCOME HOUSING DEVELOPMENTS, UH, PROPERTY OWNED BY PUBLIC FACILITY CORPORATIONS CAN BE EXEMPT FROM AVALOR TAXES.
AND SO THAT PROVIDES SOME EXTRA ECONOMIC INCENTIVES, ESPECIALLY FOR LOW INCOME HOUSING.
PFCS, AGAIN, CAN ISSUE REVENUE BONDS THAT ARE PAID BY A SPECIFIC REVENUE SOURCE.
SO IN THE CASE OF LOW INCOME HOUSING, UM, THE P F C BONDS WOULD BE REPAID THROUGH, UH, PROPERTY PAYMENTS OR PAYMENTS FROM RENTALS.
PUBLIC-PRIVATE PARTNERSHIPS IS KIND OF IN SOME WAYS AN ALTERNATIVE TO TAX-EXEMPT BOND FINANCING.
AND PUBLIC-PRIVATE PARTNERSHIPS CAN ALSO BE USED, UH, TO MANAGE CONSTRUCTION AND DEVELOPMENT RISK AS PROJECTS ARE COMING ONLINE.
SO THERE ARE DIFFERENT WAYS THROUGH PUBLIC-PRIVATE PARTNERSHIPS THAT CITY CAN BUNDLE, UM, SAY CONSTRUCTION DESIGN AND ENGINEERING SERVICES FOR A PUBLIC INFRASTRUCTURE PROJECT, OR HAVE CONSTRUCTION MANAGER AT RISK KIND OF ASSUME, UH, RISK ASSOCIATED WITH, UH, THE FINANCING OF A PART OF A PUBLIC INFRASTRUCTURE PROJECT, UH, BEFORE THE CITY ULTIMATELY ISSUES BONDS TO ACQUIRE THAT FACILITY.
SO THE NEXT SLIDE'S JUST KIND OF WALK THROUGH PROS AND CONS OF EACH TYPE OF DEVELOPMENT.
I DON'T THINK THAT WE NEED TO GO THROUGH PROS AND CONS OF EACH, BUT I'M HAPPY TO DO SO TO THE EXTENT THAT ANYONE HAS ANY QUESTIONS OR WOULD LIKE TO DIG DEEPER INTO, UM, EITHER OF THE ENTITIES THAT WE SPOKE ABOUT THIS EVENING.
I'M NOT REALLY SURE WHY WE JUST DID THAT, SO MM-HMM.
I JUST WANNA SAY YOU DID GOOD.
THAT WAS A LOT AND YOU GOT THROUGH IT PRETTY QUICK, SO THANK YOU.
[36. Presentation and discussion regarding the status and updates of the ARWA transmission lines. ~ Yvonne Flores-Cale, Council Member]
ITEM NUMBER 36.PRESENTATION AND DISCUSSION REGARDING THE STATUS AND UPDATES OF THE R O TRANSMISSION LINES, MS. FLO.
I KNOW IT WAS LAST MINUTE, BUT WITH, WE HAD A DISCUSSION ABOUT WATER TALK OR WATER ISSUES LAST WEEK, AND SO I THOUGHT IT WOULD BE A GREAT O OPPORTUNITY TO FOLLOW UP AND FIGURE OUT WHAT WE NEED TO DO AS A CITY TO GET ON BOARD.
SO WHEN YOU GUYS, UH, BRING YOUR WATER AND YOUR WATER LINES THAT WE'RE READY.
WELL, FOR THE RECORD, MY NAME'S GRAHAM MOORE.
I'M THE EXECUTIVE DIRECTOR OF THE ALLIANCE REGIONAL WATER AUTHORITY, AS COULD BE BEFORE YOU AGAIN, UH, I DID WANNA GIVE YOU AN UPDATE AS TO WHERE WE STAND IN THE DEVELOPMENT OF OUR PROJECT.
UM, I'LL TRY AND GO THROUGH THIS RELATIVELY QUICKLY AND THEN LEAVE TIME AT THE END FOR ANY QUESTIONS THAT YOU MAY HAVE.
UH, IF WE'LL GO TO THE NEXT SLIDE.
DO I HAVE CONTROL HERE? OKAY, SORRY.
I THOUGHT MAYBE THERE'S SOME MAGIC BUTTON I'M MISSING.
UH, THIS IS OUR OVERALL, UH, MAP OF OUR CONSTRUCTION THAT WE'RE IN THE MIDDLE OF.
ON THE RIGHT SIDE IS THE WATER TREATMENT PLANT.
IT'S LOCATED IN, UM, DELHI, TEXAS.
IT'S A SMALL COMMUNITY HALFWAY BETWEEN BASTROP AND GONZALEZ.
OUR WELL FIELD IS IN THAT SAME AREA WHERE THE WATER COMES FROM THE CARRIZO AQUIFER THERE.
AND THEN WE HAVE, UM, FIVE DIFFERENT PIPELINES, WHICH WE'VE LABELED A, B, C, D, AND E.
UH, WE'VE SPLIT THEM INTO DIFFERENT DESIGN PACKAGES
[00:50:01]
AND CONSTRUCTION PACKAGES TO DELIVER THE WATER TO ALL OF OUR CUSTOMERS.UM, MANY OF THOSE ARE, ARE UNDER CONSTRUCTION RIGHT NOW.
IT TOTALS ABOUT 90 MILES OF PIPELINES THEY'RE BEING BUILT.
SO YOU CAN SEE IT'S A, IT'S A LONG STRETCH AT THE FAR NORTH END OF THE PAGE, THERE IS BUTA ON THE FAR SOUTH END IS NEW BRAMBLES.
AND SO YOU CAN IMAGINE THAT COVERS A BIG SPAN OF THE I 35 CORRIDOR HERE IN THE REGION.
UH, WE ALSO HAVE A BOOSTER PUMP STATION, KIND OF IN THE MIDDLE, IN THE MAXWELL AREA EAST OF SAN MARCUS, WHERE WE REPRESSURIZE THE WATER AND THEN SEND IT, UH, ON ITS WAY TO THE WEST, TO SAN MARCO TO THE SOUTHWEST, DOWN TO SOME OF OUR KING REGIONAL WATER AUTHORITY CUSTOMERS.
AND THEN ULTIMATELY TO THE NORTH, WHICH IS THE LINE SEGMENT C THAT FEEDS WILL FEED THE CITY OF KYLE.
AND YOU CAN SEE WE'VE GOT DIFFERENT DELIVERY POINTS ALONG THE WAY.
AND WE ALSO HAVE ELEVATED STORAGE TANKS IN THE SYSTEM TO HELP BALANCE AND PROVIDE PRESSURE AT A CONSISTENT LEVEL THROUGHOUT THE ENTIRETY OF THE SYSTEM.
SO IT'S A LOT OF INFRASTRUCTURE THAT WE'RE IN THE MIDDLE OF, UH, COMPLETING RIGHT NOW.
WE KEEP UPDATED ON OUR WEBSITE, KIND OF GIVING EVERYBODY AN UPDATE AS TO WHERE WE'RE AT IN THE SCHEDULE OF EACH OF THESE PROJECTS.
AND YOU CAN SEE WE'VE COMPLETED THE WELL DRILLING.
THAT'S THE ONLY PROJECT SO FAR THAT WE HAVE COMPLETED.
AND WE HAVE A NUM NUMBER OF THE OTHER PROJECTS ARE, UM, UNDERWAY AND IN CONSTRUCTION.
WE WILL NOTE THAT FOR THE WATER TREATMENT PLANT AND THE TWO SEGMENT A AND SEGMENT B PIPELINES, THEY, WE HAVE HAD SOME DELAYS WITH THAT, PARTICULARLY AT THE WATER TREATMENT PLANT.
UM, OUR LARGE ELECTRICAL SWITCH GEAR HAS BEEN DELAYED, WHICH IS CAUSING THAT TO LIKELY NOT BE ONLINE UNTIL FEBRUARY OF 2024.
SO IT'S A COUPLE OF MONTH DELAY VERSUS WHAT WE WERE HOPING TO SEE.
BUT, UM, THEY ARE, THE CONTRACTOR IS PROCEEDING QUICKLY WITH ALL THE OTHER WORK OUT THERE.
AND THEN THE THIRD FROM THE BOTTOM THERE IS SEGMENT C, WHICH I'LL TOUCH ON IN A LITTLE BIT MORE DETAIL, UM, AND A COUPLE OF SLIDES COMING UP.
BUT YOU CAN SEE THAT WE ARE ABOUT TO START THE BIDDING PHASE ON THAT PROCESS.
AND THEN WE WILL GO THROUGH CONSTRUCTION IN 2024 AND 2025 FOR THAT PIPELINE.
AND THAT'LL INCLUDE DELIVERIES TO THE CITY OF KYLE.
I WANTED TO GIVE YOU JUST SOME VISUAL REPRESENTATIONS OF SOME OF THE CONSTRUCTION THAT ARE HAPPENING OUT THERE.
WAS ABLE TO, UH, AFFORD A TOUR TO A FEW OF THE REPRESENTATIVES HERE AT THE CITY RECENTLY, AND THAT WAS NICE TO GET THEM OUT THERE TO, TO SEE SOME OF THAT.
THIS IS THE WIRE TREATMENT PLANT.
UH, YOU CAN SEE ON THE TOP SLIDE THE OVERALL PICTURE OF THE ENTIRETY OF THE FACILITIES.
THE BOTTOM LEFT IS THE FILTER AREA AND THE RIGHT SIDE ARE SOME OF THE CHEMICAL ADDITIONS.
UH, THERE'S BEEN A LOT OF UPDATES SINCE THIS PICTURE, EVEN IN JULY, CONTRACTORS MAKING GOOD PROGRESS.
WE'LL GO TO THE NEXT SLIDE WILL BE THE BOOSTER PUMP STATION THERE IN, UM, IN MAXWELL THAT IS A 5 MILLION GALLON GROUND STORAGE TANK.
SO IT'S A, IT'S A SIZABLE TANK THERE.
WE'VE GOT ROOM TO EXPAND WITHIN THIS SITE TO BRING ON ADDITIONAL WATER SUPPLIES TO THE AREA AS THAT NEED ARISES.
THE BOTTOM PICTURE IS, UH, SOME OF THE PUMPS THAT WILL BE SET TO, UH, TO PRESSURIZE THAT WATER AND SEND IT ON ITS WAY TO ALL THE CUSTOMERS.
THEN I THINK THE NEXT SLIDE WILL BE OUR SOUTH INLINE ELEVATED STORAGE TANK.
UH, THIS IS A, A PRETTY STANDARD, UM, TANK WITH A CONCRETE PEDESTAL AND A STEEL DOME TOP TO IT.
UH, THAT ACTUALLY SINCE THIS PICTURE'S BEEN TAKEN, THE PEDESTAL IS BASICALLY COMPLETE AND THEY'RE ABOUT TO START, UH, ERECTING THE, THE STEEL DOME AND, AND WE WILL RAISE THAT HERE LATER THIS YEAR.
SO THEY'RE MAKING GOOD PROGRESS ON THAT PROJECT.
AND THEN FINALLY, THE NEXT SLIDE, JUST SOME REPRESENTATIVE PICTURES OF THE PIPELINES.
THE PIPELINES RANGE IN SIZE AS WE LEAVE THE WATER PLANT.
THEY'RE ABOUT A 48 INCH DIAMETER.
MOST OF THE, UH, NETWORK IS BETWEEN 42 AND 36 ER PIPELINE DIAMETER PIPELINES.
UH, AND AS YOU GET OUT TO THE OUTER ENDS OF THE SYSTEM, IT REDUCES DOWN JUST A LITTLE BIT.
UM, WE HAVE LOTS OF MAJOR CROSSINGS, PLUM CREEK, S SH ONE 30, WE'VE GOT ACROSS I 35 AND A COUPLE OF LOCATIONS.
SAN MARCO RIVER, THE GUADALUPE RIVER RAILROAD, THREE DIFFERENT TIMES.
SO THERE'S LOTS OF EFFORT TO BE UNDERTAKEN TO GET ALL THE PIPELINES IN PLACE, UH, AND GET THE WATER DELIVERED TO ALL OF OUR CUSTOMERS.
SO I THINK THEN, UH, HAVE A COUPLE SLIDES HERE TO TALK A LITTLE BIT MORE ABOUT SPECIFICS ON SEGMENT C.
FIRST, I WANNA TALK ABOUT FINANCING.
WE, WE HAVE HAD SOME OVERRUN IN OUR OVERALL PROGRAM TO THE TUNE OF ABOUT $46 MILLION.
KYLE SHARED THAT BEING ABOUT 13 MILLION.
AND SO WE ARE IDENTIFYING RIGHT NOW DIFFERENT FUNDING OPTIONS THAT WE CAN PUT IN PLACE TO, UH, TO MAKE UP THAT GAP.
AND MOST IMPORTANTLY, NOT TO FURTHER DELAY ANY OF THE PROJECTS.
SO THAT'S SOMETHING WE'RE WORKING CURRENTLY WITH, WITH OUR BOARD.
WE'VE GIVEN A PRESENTATION OVER THE LAST COUPLE OF MEETINGS ABOUT THAT AND SOMETHING WE'RE LOOKING TO GET LINED UP HERE BY THE END OF THE YEAR SO THAT WE CAN HAVE THAT IN PLACE.
AND THE OTHER PIECE WITH, UH, WITH SEGMENT C, WHICH I'M SURE YOU'LL ALL UNDERSTAND VERY WELL, WE KNEW WHEN WE SET THIS ONE UP THAT IT WAS PROBABLY GONNA BE OUR MOST CHALLENGING PIPELINE SEGMENT DUE TO ALL THE DEVELOPMENT THAT IS OCCURRING IN THIS AREA.
[00:55:01]
ENOUGH, EVERY TIME WE LOOK AT A PIECE OF PROPERTY, THERE'S A NEW DEVELOPMENT BEING PLANNED FOR IT.AND SO WE'VE COORDINATED WITH THOSE LANDOWNERS TO TRY AND FIND A, A ROUTE THROUGH THERE THAT ALLOWS US TO GET THE EASEMENT THAT WE NEED TO NOT ONLY INSTALL THE PIPELINE, BUT MAINTAIN IT.
UM, AND THEN ULTIMATELY DOESN'T HINDER THE DEVELOPMENT IN ANY GREAT EXTENT.
YOU KNOW, WE WANNA WORK WITH THEM AND, AND BE GOOD PARTNERS.
AND SO, UH, I'M, I'M HAPPY TO SAY WE'RE MOSTLY THROUGH THAT PROCESS.
WE DO HAVE A LITTLE BIT LEFT TO WORK ON.
WE, UH, WE ARE COORDINATING CLOSELY AS WELL, UM, WITH THE CITY ON THE ROAD BOND PROJECTS, UH, PARTICULARLY HERE IN THE AREA OF LAYMAN HIGH SCHOOL WHERE WE ARE TRYING TO COORDINATE, UH, WHERE THE ROUTES WILL GO SO THAT WE CAN COORDINATE, UH, AND, AND MAKE THE MOST SENSE THROUGH THAT AREA.
AND THEN FINALLY, I THINK THE, THE NEXT SLIDE IS JUST KIND OF A SCHEDULE OVERVIEW AS TO WHERE WE'RE AT.
AGAIN, THIS SHOWS OUR OVERALL SEGMENT C PIPELINE THERE AND MAGENTA ON THIS PAGE.
UM, WE ARE FULLY FUNDED THROUGH THE TEXAS WATER DEVELOPMENT BOARD, SO WE HAVE TO GET THAT APPROVAL OF OUR PLANS.
AND SO WE ANTICIPATE HAVING THAT BY HALLOWEEN.
UH, WE ANTICIPATE RIGHT NOW, UH, UH, SECURING THE ADDITIONAL FUNDING BY MID-JANUARY OF 24, AND THEN AWARDING THE CONSTRUCTION CONTRACT SHORTLY AFTER THAT.
SO YOU CAN SEE THERE'LL BE SOME OVERLAP AS WE'RE GOING THROUGH THE, UM, THE FUNDING ASPECT THAT WE'LL BE WORKING TOWARDS PROCURING OUR CONTRACTOR.
THEY WILL THEN ACTUALLY MOBILIZE ON THE SITE BY MID-MAY.
UH, AND THEN WE ARE PROJECTING THAT THE FIRST PORTION WILL BE COMPLETED BY JANUARY 15TH, 2025.
AND I'VE OUTLINED HERE ON THE MAP THE FIRST PORTION, SO THAT'S FROM MAXWELL TO, UH, COUNTY ROAD 1 58 THERE.
UH, AND THAT INCLUDES THE NEW WATERSTONE, UH, DELIVERY POINT THAT THE CITY IS LOOKING AT ADDING A PUMP STATION IN STORAGE TANKS.
AND THEN THE REST OF SEGMENT C THE ENTIRETY OF IT WILL BE COMPLETED BY, UM, HALLOWEEN OF 2025.
AND THAT WILL INCLUDE WATER DELIVERY TO THE, UH, FM 1626 PUMP STATION, UH, BY THE H E B.
USED TO BE THE GREEN TANK IS NOW THE WHITE TANK AS OF A COUPLE YEARS AGO.
SO, UH, THAT'S ALL THE SLIDES I HAVE.
I AM CERTAINLY HAPPY TO TAKE ANY QUESTIONS THAT, THAT ANYONE MAY HAVE REGARDING OUR OVERALL EFFORTS TIMING, SARAH, CUSTOMER FIRST COUNT.
SO, UM, YOU GUYS ARE GONNA BRING THE PIPES TO KYLE.
DO, IS THERE SOMETHING THAT WE NEED TO DO IN ORDER TO BE READY TO, UM, ACCEPT THAT WATER? SO THE, IN THE CASE OF THE WATERSTONE DELIVERY POINT, THAT IS A NEW FACILITY.
SO THERE WILL NEED TO BE A STORAGE TANK BUILT AND PUMPS IN PLACE TO BE ABLE TO PUSH THAT WATER OUT.
IN TERMS OF THE 1626 PUMP STATION, THERE'S ALREADY A TANK THERE.
SO WE COULD, WE COULD, UH, START TO FILL THAT TANK.
I UNDERSTAND THERE'S ALSO PROJECT UNDERWAY TO EXPAND THAT STATION, NOT ONLY THE STORAGE VOLUME, BUT ALSO THE PUMPING CAPACITY OUT OF THAT.
SO I BELIEVE THOSE, THOSE EFFORTS ARE CURRENTLY UNDERWAY BY THE CITY ON BOTH OF THOSE AREAS WHERE THE WATER WILL BE DELIVERED.
AND ARE YOU GUYS DELIVERING IT TO, UM, EXISTING LINES? WE ARE BUILDING ALL NEW LINES AND THEN WE WILL, UM, BASICALLY TERMINATE AT THE TANKS.
AND THEN FROM, AT THAT POINT ON, IT'S THE RESPONSIBILITY OF THE CITY TO GET THAT WATER TO THE REST OF THE, THE SYSTEM AND YOUR AND THE CITY'S CUSTOMERS.
SO YOU GUYS ARE TAKING IT TO THE TANKS AND THEN FROM THE TANKS, THE CITY'S RESPONSIBLE FOR THE REST? YES, MA'AM.
ALRIGHT, ANYONE ELSE? ALL RIGHT.
THANK YOU FOR MOVING ME UP TOO.
[VII. Consent Agenda]
IS AGENDA ITEM NUMBER, UH, CONTENT AGENDA[VIII. Items Pulled from Consent Agenda]
ANYBODY HAVE ANY ITEMS THEY WANNA PULL ON THE CONSENT AGENDA? I'D JUST LIKE TO MAKE A COMMENT ON ONE, IF YOU DON'T MIND.UH, LEON, MR. BARRA, WANNA SAY THANK YOU FOR BRINGING THIS FORWARD.
I KNOW WE WENT, UH, WE HAD A RESIDENCE REACH OUT AND I WORKED WITH THE PREVIOUS CITY MANAGER TO TRY TO LOOK AT THIS AND I KNOW WE CAME THROUGH A ROADBLOCK, SO THANK YOU FOR BRINGING THIS FORWARD.
REFERENCING THE, UH, REGULATING TRAFFIC AND AUTHORIZING DIRECTING, UH, REMOVAL, UH, TO PUT SOME STOP SIGNS FOR CONTROLLED AREA INTERSECTION AT KYLE CENTER DRIVE IN PHYSICIAN'S WAY THAT'S OVER THERE.
EVERYBODY KNOWS WHERE CHICKEN EXPRESS IS, RIGHT OVER THERE BY TARGET, WHERE EVERYBODY KIND OF RUNS THROUGH AND IT'S LIKE A FREE, IT'S LIKE A RACETRACK.
SO THAT'S UMM, GLAD WE'RE, WE'RE REALLY, UM, TAKING NOTE OF THAT.
NUMBER 16, I'D LIKE TO PULL AGENDA ITEM 16 FOR DISCUSSION.
I JUST HAVE A QUICK QUESTION ON 23 FOR CLARIFICATION.
MY QUESTION IS, UM, SO THE CITY RECEIVED THESE BONDS, THEY BONDED OUT, IS THAT CORRECT? AND THEN THE CITY IS PAYING W G I THROUGH THE BONDS.
IS THAT WHAT THIS IS DOING? UH, COUNCIL MEMBER FLORES CA PAIGE SIGNS CITY ATTORNEY FOR THE RECORD? UH,
[01:00:01]
YES, THE TURS BONDS HAVE BEEN RECEIVED AND THE SOURCE OF THE FUNDS TO PAY WGI I'S CONTRACT.ANYONE ELSE? COUNCIL MEMBER PARSLEY.
OKAY, I HAVE SOME QUESTIONS ABOUT ITEM 24.
I WOULD LIKE TO PULL THAT OUT.
ANYONE ELSE? I HAD A QUESTION BACK TO NUMBER 23.
AND THEN A QUESTION ABOUT NUMBER 22.
ANYONE ELSE? ALL I'D LIKE TO MAKE A MOTION TO APPROVE AGENDA ITEMS 13 THROUGH 15, 17 THROUGH 21.
SECOND MOTION BY THE MAYOR, SECONDED BY COUNCIL MEMBER FLORES KELLER.
DISCUSSION ON THE MOTION? ALL IN FAVOR SAY AYE.
NEXT UP, AGENDA ITEM 16, APPROVE A RESOLUTION AUTHORIZING CITY MANAGER TO, UH, EXECUTE TWO AFAS BETWEEN THE CITY OF KYLE TDOT FOR PROJECTS, UH, RELATED TO THE ROAD BOND.
MR. UH, ZUNIGA, I BELIEVE, PULLED THIS.
JOE, I JUST HAD A QUESTION AGAIN ABOUT, UH, THE REASONING.
IF YOU COULD GIVE US A KIND OF A BRIEF ANALYSIS OF THE I 35 KOHLERS.
I THINK THIS IS WHAT THIS PERTAINS TO THE FUNDING MECHANISM, THE WORK WITH TXDOT, AND THAT WHY THAT WAS SELECTED.
I REMEMBER THERE WAS A VERY GOOD REASON FOR IT.
BUT JUST TO REMIND US, IS THERE ANOTHER BRIDGE BEING BUILT, GOING TO BE BUILT OR AN UNDERPASS, UM, ON THIS ROAD PROJECT? SO A LOT OF QUESTIONS, BUT I WANNA KIND OF REALLY UNDERSTAND THIS ONE.
UH, FOR YOUR RECORD, I'M JOE CANTA LUPO.
I WORK FOR CAREFREE AND ASSOCIATES, AND I AM, UH, THE MANAGER OF YOUR, UH, G E C TEAM HELPING YOU IMPLEMENT, UH, THE ROAD BOMB PROGRAM.
UH, COUNCIL MEMBER, UH, TO ANSWER THE QUESTION, THERE ARE TWO ADVANCED FUNDING AGREEMENTS.
ONE IS FOR THE KOHLERS PROJECT, UM, AND THE OTHER IS FOR THE CENTER CITY PROJECT.
UM, THE, THE PROJECT IS, UH, IF, IF YOU LOOK AT THE RESOLUTION, IT TALKS ABOUT A BRIDGE, BUT THE DETERMINATION AS TO WHETHER 35 GOES OVER KOHLS OR KOHLS GOES OVER 35.
NOW WE HAVE OUR PREFERENCES, RIGHT? MANY OF US HAVE OUR PREFERENCES, BUT WHAT TDOT HAS ASKED US, ASKED THE CITY TO DO IS TO LET THE SCHEMATIC PROCESS, UM, YOU KNOW, TAKE IT ITS COURSE.
I MEAN, WE'RE CONFIDENT, UM, YOU KNOW, THAT IT'LL LEAD THE RESULT
UM, WE ARE, UM, I THINK AS A TEAM LEANING TOWARD, UH, HOPING THAT 35 GOES OVER KOHLERS AND WE THINK THAT'S THE DIRECTION WE'LL GO.
BUT FOR THE PURPOSES OF THE A F A, YOU HAVE TO LEAVE IT OPEN.
THE OTHER NOTE I'LL MAKE ABOUT THE A F A, UH, A FFA IS BOTH OF THEM, IS THAT THEY'RE CALLED ADVANCED FUNDING AGREEMENTS, BUT THEY DO NOT INVOLVE, UH, ANY EXCHANGE OF MONEY BETWEEN THE CITY OR TXDOT.
WHAT THEY SIMPLY DO IS ALLOW TXDOT TO FORMALLY ACKNOWLEDGE THOSE PROJECTS, AND IT ALLOWS THEM, UH, TO ENGAGE WITH THE CITY AND WITH OUR TEAM TO GET THEM, UH, DESIGNED AND, AND REVIEWED PROPERLY.
SO WE DON'T KNOW YET WHAT IS GOING TO BE THE FINAL AUGUST, THE IMPACT ON THE 35, WHETHER, UH, WHETHER THERE'LL BE AN OVERPASS OR AN UNDERPASS.
AGAIN, WE HAVE, UM, OUR RECOMMENDATION AND WE HAVE OUR PREFERENCE AND WE KNOW WHAT WE'RE GONNA, YOU KNOW, LOOK AT.
BUT WE HAVE TO, WE'RE OBLIGATED TO LOOK AT BOTH OPTIONS.
AND THAT'S EITHER 35 GOING OVER KOHLER'S OR KOHLER'S GOING OVER 35.
AND, AND THAT IS JUST THE WAY THE PROCESS WORKS.
UM, WE WILL LOOK AT TWO OPTIONS IN GREATER DETAIL.
WE'LL DO THE PROS AND CONS, WHICH INCLUDE WHAT THE CITY WOULD LIKE TO SEE WITH, UH, THE OWNERS, LIKE TO SEE WHAT DEVELOPERS LIKE TO SEE, AND, AND WHOEVER ELSE WANTS TO WEIGH IN ON IT.
AND THEN THAT'LL HELP MAKE THE DECISION WITH, IN CONJUNCTION WITH TXDOT.
THE THING TO REMEMBER IS 35 IS THEIR ROAD, AND WHETHER WE TOUCH 35 OR NOT, WHETHER WE 35 GOES OVER COLORS OR THE OTHER WAY AROUND, UM, WE HAVE TO SEEK THEIR REVIEW AND APPROVAL OF, OF THE PLANS.
AND AGAIN, THE A F A JUST SIMPLY LETS TXDOT KNOW THAT THIS IS SOMETHING THE CITY WANTS TO DO AND IT ALLOWS TXDOT TO FORMALLY ENGAGE WITH THE PROCESS.
I DO HAVE, UM, A QUESTION BECAUSE NORMALLY WE'LL SEE SEVERAL OF THESE ROADS AT ONE TIME, AND SO I THINK WE'RE GETTING TO THE POINT WHERE WE'RE TRYING TO BE A LITTLE BIT MORE SPECIFIC WITH THEM.
AND SO I JUST WANNA MAKE SURE THAT WE'RE FOCUSING ON
[01:05:01]
EXISTING ROADS THAT NEED TO BE UPDATED.ALTHOUGH I UNDERSTAND THIS ONE IS GONNA BE A LONGER PROCESS BECAUSE WE HAVE TO GET TDOT PERMISSION.
AND, UM, AND THE OKAY FROM TXDOT, I JUST WANNA MAKE SURE GOING FORWARD THAT WE'RE ALSO LOOKING AT THE ROADS, UH, ON THE INSIDE.
'CAUSE I FEEL LIKE THE EASEMENTS FOR THAT ARE GONNA TAKE A REALLY LONG TIME AS WELL.
SO, UM, WE'RE JUST MOVING EVERYTHING SIMULTANEOUSLY AND THERE'S NO ONE ROAD PUT ABOVE THE OTHER THAT, THAT MAYBE CAN WAIT A LITTLE BIT LONGER.
THIS IS JUST, UM, A PROCESS THAT IS NECESSARY FOR THESE TWO ROADS BECAUSE THE CITY IS WORKING ON, ON A TXO FACILITY.
THERE IS ANOTHER PROCESS THAT WE USE FOR WHERE, UH, A BOND PROJECT SIMPLY CONNECTS TO A T SIDE FACILITY.
AND THEN THERE IS NO PROCESS WITH TDO FOR ROADS THAT ARE SIMPLY CITY OR COUNTY ROADS.
BUT I CAN ASSURE THAT ALL THE PROJECTS ARE MOVING, UH, SIMULTANEOUSLY AND WE'RE TAKING THEM AS QUICKLY AS, UH, AND AS EFFICIENTLY AS WE POSSIBLY CAN.
I JUST HAVE ONE LITTLE COMMENT ON THAT AS WE'RE TALKING ABOUT THESE ROADS AND WHETHER IT'S WHAT'S COMING OR NOT, I WANT THE RESIDENTS AND THE PEOPLE TO UNDERSTAND START GETTING READY FOR A LOT OF ROAD CONSTRUCTION FROM SOMEBODY WHO DRIVES EVERY MORNING, FOUR O'CLOCK IN THE MORNING TO AUSTIN AND ALL THAT ROAD CONSTRUCTION.
SO LET'S GET READY FOR THAT RIGHT NOW.
COUNCILMAN ZUNIGA, WE DON'T KNOW THE SPECIFICS.
I KNOW THAT'S WHERE THE ENGINEERING COMES FROM, BUT AS WE'RE TALKING ABOUT THESE ROAD BONDS, I NEED EVERYBODY TO UNDERSTAND THAT WE NEED TO START PREPARING FOR CONSTRUCTION, DETOURS, ROAD CLOSURES, AND SO FORTH AS WHAT MS. COPLAN IS TELLING US.
JOE'S SAYING WE'RE MOVING REALLY, REALLY FAST, SO LET'S JUST KEEP THAT IN MIND.
THIS ROAD WILL HAVE SIDEWALKS, JOE, AND GOOD VISIBILITY AT NIGHT.
WOULD, WOULD HAVE ENOUGH LIGHTING AND SIDEWALKS.
OH, IT, IT, WHATEVER THE, WHATEVER THE PLANTS GO FOR.
IF, IF, IF WE'RE REQUIRED TO PUT LIGHTING, WE'LL PUT LIGHTING IF THERE'S SIDEWALKS AND PEDESTRIAN FACILITIES, YES.
BUT REMEMBER, THIS IS THAT DETERMINATION, THE EXACTNESS OF THOSE FEATURES WILL BE DETERMINED WHETHER, AGAIN, 35 GOES OVER.
I'D LIKE TO MAKE A MORE, I'D LIKE TO MAKE A MOTION TO APPROVE SECOND JOE'S AGENDA.
TIM, IS THERE A DISCUSSION ON THE MOTION? ALL US IN FAVOR SAY AYE.
NEXT UP IS AGENDA ITEM 22, APPROVE OF RESOLUTION AUTHORIZING THE RETURN OF DONATIONS DEPOSITED WITH THE CITY OF KYLE IN THE AMOUNT OF $55,850 FOR CASS, UH, MR. HENDRICKS, UM, I DON'T KNOW WHO PULLED THESE.
THE LAST ITEM I, COUNCILOR ZUNIGA.
SO, I JUST WANTED TO ASK, UH, WHEN WAS THE MONEY DEPOSITED? HOW LONG HAVE WE BEEN HOLDING IT? AND WHAT WAS THE DEPOSIT FOR MAYOR COUNCIL FOR THE RECORD, JERRY HENDRICKS, ASSISTANT CITY MANAGER, COUNCIL MEMBER OF THE FIRST DEPOSIT WAS MADE IN LATE DECEMBER OF 21.
UH, A TOTAL OF FOUR OTHER DEPOSITS WERE SUBSEQUENTLY MADE.
THOSE DEPOSITS WERE HELD, UH, IN A SPECIAL ACCOUNT WITH THE CITY OF KYLE TO, TO USE SPECIFICALLY TOWARDS THE PROJECT, TO BUILDING A REC CENTER OR, UH, PAYING FOR THE DESIRE OF A REC CENTER.
AND SO WHY, WHY IS THE DEPOSIT BEING RETURNED NOW? CSS HAS ASKED THAT WE RETURN THAT MONEY TO THEM AS COUNCIL'S, UM, SENT US ON ANOTHER DIRECTION ON HOW TO ACHIEVE A REC CENTER.
AND SOME OF THEIR MEMBERS HAVE ASKED FOR REFUNDS OF THAT DONATION MOTION.
LIKE, CO MAKE A MOTION TO APPROVE AGENDA ITEM NUMBER 22, PLEASE.
SECOND MOTION BY MAYOR PRO TEM SECONDED BY COUNCILOR KEL.
THERE, DISCUSSION ON THE MOTION? ALL IN FAVOR SAY AYE.
APPROVAL OF THE ASSIGNMENT OF, UH, P S A BETWEEN PLUM CREEK DEVELOPMENT PARTNERS, THE CITY OF KYLE, UH, UH, ASSIGNING THAT P S A BETWEEN PLUM CREEK DEVELOPMENT PARTNERS AND W G I, UH, I DO NOT KNOW WHO PULLED THIS ONE.
SO WHEN I WAS LOOKING AT THE RECEIPTS, I REMEMBER WHEN I APPROVED, WHEN I THIS WITH COUNSEL, UH, WE, THERE WAS A LIMIT.
THERE WAS A SPENDING LIMIT, A A CAP OR WHATEVER.
AND IN, IN THE RECEIPTS IT SAYS THAT WE WILL BE NOTIFIED WHEN 65% HAS BEEN REACHED OF THE ALLOCATED AMOUNT.
UH, WHAT WAS THAT ALLOCATED AMOUNT? THE, THE THRESHOLD OF THE W G I PARTNERSHIP WITH PLUM CREEK DEVELOPERS PAGE SIGNED CITY ATTORNEY FOR THE RECORD.
[01:10:01]
NO, NO.SO THE, THE AGREEMENT BETWEEN THE, THE CITY AND PLUM CREEK, PLUM CREEK DEVELOPMENT PARTNERS WAS THAT, UH, PLUM CREEK DEVELOPMENT PARTNERS WOULD ENGAGE THE CONSULTANTS FOR THE PROJECT AND THEY WENT AHEAD AND DID THAT.
AND THE CITY APPROVED W G I, BOTH THE, UH, TSS BOARD AND THE CITY DID.
AND, UH, IN DOING SO, IT WAS RECOGNIZED THAT W G I WAS ENGAGED, UM, SHORTLY AFTER THE CITY APPROVED THE RETAIL ROADS AGREEMENTS IN APRIL OF LAST YEAR.
SO THEY WERE ENGAGED BY THE DEVELOPER TO START, START THE WORK SO THAT THERE'D BE NO TIME LOST.
'CAUSE THERE WERE STILL SOME FINANCING TERMS TO WORK THROUGH.
AND SO THAT THE CITY WAS NOT THE PARTY TO THE CONTRACT WHEN THAT NOTICE WOULD'VE BEEN GIVEN AS TO WHEN IT WAS GOING TO HIT A CERTAIN PERCENTAGE OF THE, OF THE CONTRACT.
SO AT THIS POINT, AFTER THE, IT'S COME TIME TO HAVE THE W G I CONTRACT CON ASSIGNED TO THE CITY UNDER THE TERMS OF THE AGREEMENTS WITH THE DEVELOPER, AND THEY ARE, UH, THE BACKGROUND MATERIAL HAS THAT INFORMATION THAT SAYS WHAT THE CONTRACT AMOUNT IS.
I BELIEVE IT'S 612,000 OR 621,000, IF I'M RECALLING CORRECTLY.
UM, DID THAT ANSWER YOUR QUESTION? SO THE ANSWER IS YOU DIDN'T GET A NOTICE BECAUSE YOU WEREN'T A PARTY TO THE CONTRACT YET? MM-HMM.
SO THE CITY APPROVED, UH, BOND PROCEEDS IN THE AMOUNT OF $8 MILLION.
AND SO THAT'S INCLUSIVE OF DESIGN PLUS CONSTRUCTION.
SO THIS PARK THAT IS IN FRONT OF YOU TONIGHT IS FOR DESIGN COSTS.
BUT THE, I MEAN, THE DESIGN COSTS HAVE A CERTAIN LIMIT.
THE, THE AGREEMENT HAS THAT LIMIT AT, IT'S, AGAIN, IT'S IN YOUR BACKUP MATERIAL.
THERE'S, THERE'S PROBABLY SOME, UH, PROVISIONS IN THERE IN CASE THERE'S SOME UNFORESEEN CIRCUMSTANCES AND THERE ARE ADDITIONAL SERVICES REQUESTED.
BUT FOR THE SCOPE OF THE WORK DEFINED, WHICH IS TO CONSTRUCT, TO DESIGN THE RETAIL ROADS PROJECTS, IT'S THAT AMOUNT THAT'S SET OUT IN YOUR BACKUP MATERIAL.
I'D LIKE TO MAKE A MOTION THEN TO APPROVE THE, UH, AGENDA.
ITEM 23 SECOND MOTION BY COUNCILOR ZUNIGA, SECONDED BY MAYOR PRO TEM.
IS THERE DISCUSSION ON THE MOTION? ALL IN FAVOR SAY AYE.
CONSIDER APPROVAL OF REQUEST TO WAIVE SECTION 41 1 36.
MINIMUM LOT WI TO ALL ALLOW FOR SUBDIVISION OF PROPERTY LOCATED AT 200.
WILL, IS THERE ANY REASON WHY WE HAVE SET THE MINIMUM WIDTH TO A CERTAIN AMOUNT? AND WHAT WOULD BE THE DISADVANTAGE FOR HAVING IT IF WE DO WAIVE THAT REQUIREMENT? SO I'LL START OUT BY SAYING THAT I WAS NOT HERE WHEN THE CODE WENT INTO PLACE FOR THE MINIMUM 130 FOOT WAT LOT WIDTH.
HOWEVER, UM, FOR LOTS THAT ARE, UH, THAT ARE ON SEPTIC, WHICH, WHICH WILL BE THE CASE IN THIS CASE, UM, THEY HAVE TO HAVE A MINIMUM AREA PERSPECTIVE THAT'S USABLE FOR THEIR SEPTIC FIELDS.
AND IN CONJUNCTION WITH HAYES COUNTY, IN CONVERSATIONS WITH THEM ON THE SITE, THEY DIDN'T HAVE AN ISSUE WITH A, WITH A EACH LOT BEING 125 FEET WIDE.
OCCASIONALLY THERE IS ISSUES WITH DRIVEWAY SPACING, BUT IN THIS CASE IT'S NOT A LARGE FACTOR.
IS THIS SEWN AS RESIDENTIAL OR WHAT IS IT ZONED FOR? THIS IS IN THE E T J.
SO THERE IS NO ZONING OUT THERE AS FAR AS I UNDERSTAND IT.
THEY ARE GONNA BE USING, UH, IT FOR RESIDENTIAL PURPOSES, BUT IN THE END WE DON'T HAVE AUTHORITY OVER WHAT THEY CAN USE IT FOR.
THE COUNTY ULTIMATELY DOES HAVE SOME CONTROL BASED ON THE, UH, THE SEPTIC PERMITS.
SO WE DON'T APPROVE SEPTIC WATER.
WASTEWATER WILL BE THROUGH THE COUNTY.
SO, UH, THERE'S NO WASTEWATER OUT THERE.
THERE'S NO SEWER, SO SEPTIC, BUT WATER IS GO FORTH IN THE END.
WE DON'T REALLY HAVE A PROBLEM WITH A A EACH LOT BEING FIVE FOOT LESS THAN THE MINIMUM.
I'D LIKE TO MAKE A MOTION TO APPROVE ITEM 24 SECOND MOTION BY COUNCIL MEMBER PARSLEY, SECOND BY COUNCILMAN FLOS.
KALE, DID WE APPROVE JAN ITEM 24? IS THE DISCUSSION ON THE MOTION? UH, JUST A QUICK ASK.
[01:15:01]
WILL, DID THEY ALREADY DO THEIR OWN RETTING, UH, THEIR OWN EXPENSE? IF THEY'RE GONNA GO AHEAD AND BREAK UP INTO TWO ACRES, THEY, THEY WILL BE, THEY NEED THIS.UH, THAT'S WHY WE HAVE THE WAIVER REQUEST IN FRONT OF YOU, UM, BEFORE THEY GO AND SPEND THE MONEY TO, WITH A SURVEYOR TO DO ALL THAT WORK, THEY WANTED TO MAKE SURE THEY COULD ACTUALLY DO IT FIRST.
ALRIGHT, ANYONE ELSE? ALL IN FAVOR SAY AYE.
ALL OPPOSED? MOTION CARRIES SEVEN TO ZERO.
UH, JENNIFER, ARE THERE ANY ITEMS IN CONSENT THAT CAN BE FINALLY PASSED? LIKE NUMBER 17, 15, 14, 13? CAN YOU TAKE A LOOK? CAN ALL OF THOSE BE FINALLY PASSED? ARE THERE ANY OBJECTIONS TO FINALLY PASSING AGENDA ITEM 13, 14, 15, AND 17.
SEEING NONE, THOSE ITEMS ARE FINALLY PASSED.

MOHE.
AND SHOULD WE ADOPT THE BUDGET BEFORE WE ADOPT THE TAX RATE? SHOULDN'T WE DO THE TAX RATE FIRST? THESE MAYOR, THIS IS THE PUBLIC HEARING.
IF THERE ARE NO OBJECTIONS, I'M GONNA OPEN THE PUBLIC HEARING.
IS THERE ANYONE WHO WISHES TO COME FORWARD AND SPEAK ON THIS ITEM? ALRIGHT, SEEING NONE, I'M GONNA CLOSE THE PUBLIC HEARING.
PUBLIC HEARING IS NOW, NOW CLOSED, SO I WAS RIGHT IN.

Conduct a public hearing to obtain comments on the proposal to set the City's ad valorem tax rate (property tax rate) at $0.4693 per $100 of taxable assessed valuation for Fiscal Year 2023-2024 (Tax Year 2023). ~ Perwez A. Moheet, CPA, Director of Finance (RELATED ITEM 2 OF 4)
]GEN ITEM 26 AND INDUC THE PUBLIC HEARING TO OBTAIN COMMENTS ON THE PROPOSED PROPOSAL TO SET THE CITYUH, ARE THERE ANY OBJECTIONS TO OPEN THE PUBLIC HEARING? PUBLIC HEARING IS NOW OPEN.
IS THERE ANYONE WHO'D LIKE TO COME FORWARD AND SPEAK ON THE TAX RATE? MAYOR, ON THIS ITEM, I NEED TO SPEAK AND PUT INTO RECORD CERTAIN THINGS THAT'S REQUIRED.
COUNCIL MEMBERS FOR THE RECORD, I'M PERVE CITY'S DIRECTOR OF FINANCE.
UH, THIS PUBLIC HEARING IS ON THE PROPOSED PROPERTY TAX RATES.
THE CITY COUNCIL IS SCHEDULED TO CONSIDER A PROPOSAL TO SET THE TAX RATE AT 46.93 CENTS PER $100 OF TAXABLE ASSESSED VALUATION FOR TAX YEAR 2023.
THIS IS THE FIRST OF TWO PUBLIC HEARINGS SCHEDULED IN THE CITY'S PROPOSED A VALOREM TAX RATES FOR TAX.
THE SECOND PUBLIC HEARING ON THE CITY'S PROPOSED A VALOREM TAX RATES WILL BE HEAD AT 7:00 PM ON SEPTEMBER 19TH AS CITY HALL 100 WEST CENTER STREET, KYLE, TEXAS 7 8 6 4 0.
THE CITY'S AVAL TAX RATES FOR TAX YEAR 2023 ARE AS FOLLOWS, NO NEW REVENUE TAX RATE 0.4474 PER 100.
VOTER APPROVAL TAX RATE 0.4693 PER 100.
AND THE PROPOSED TAX RATE AT 0.4693.
THE PROPOSED ADVIL TAX RATE OF 0.4693 PER $100 IS A DECREASE OF 0.0389 OR 7.65% FROM THE CITY'S CURRENT ADOPTED TAX RATE OF 0.5082 PER $100.
THE CITY'S PROPOSED, OH, THE CITY'S PROPOSED ADVIL TAX RATE OF 0.4693 IS ABOVE THE KNOWN NEW REVENUE TAX RATE OF 0.4474 PER $100.
THIS IS AN INCREASE OF 0.02 CENTS, OR 4.89% FROM THE KNOWN NEW REVENUE TAX RATE FOR TAX YEAR 2023.
THE PROPOSED TAX RATE OF 0.4693 PER $100 IS THE SAME TAX RATE AS THE VOTER APPROVAL TAX RATE OF 0.4693 PER $100.
DURING TODAY'S COUNCIL MEETING, THE CITY COUNCIL IS POSTED TO VOTE ON THE ADVIL ERM TAX RATE.
ON FIRST READING OF THE TAX RATE ORDINANCE, ALL KYLE TAX BASE RESIDENTS, MEMBERS OF THE PUBLIC ARE INVITED TO ATTEND AND EXPRESS THEIR VIEWS AT THE PUBLIC HEARINGS AND CITY COUNCIL MEETINGS SCHEDULED ON THE CITY'S PROPOSED PROPERTY TAX RATES.
AND MAYOR, THAT CONCLUDES MY PRESENTATION.
THIS IS STILL IN A PUBLIC HEARING FOR, UH, FORMAT.
[01:20:01]
SO IS THERE ANYONE, UH, ELSE WHO WISHES TO COME FORWARD? ALRIGHT, SEEING NONE, I'M GONNA CLOSE THE PUBLIC HEARING.SO IN MY MIND, WE SHOULD TAKE UP AGENDA ITEM 28 AHEAD OF 27 BECAUSE IF WE APPROVE THE BUDGET AND THEN DON'T APPROVE THE TAX RATE, THEN WE FIND OURSELVES IN THE SAME BIND THAT WE'VE BEEN DISCUSSING.
MAYOR, WITH ALL DUE RESPECT, THE STATE LAW REQUIRES THAT THE COUNCIL VOTE ON THE BUDGET FIRST AND THEN THE TAX RETURN.
WELL, THAT DOESN'T MAKE ME WRONG.
THE STATE, STATE LAW HAS A LOT OF CRAZY THINGS.
[27.
(First Reading) Approve an Ordinance of the City of Kyle, Texas, adopting a budget totaling $272.5 million for all City Funds for the ensuing Fiscal Year beginning October 1, 2023 and ending September 30, 2024; appropriating revenue and expenditure amounts thereof for all City Funds, authorizing no changes in water service rates, no changes in wastewater service rates, no changes in storm drainage fees, a 2.52 percent increase in solid waste services per contract terms with TDS, all other fees and charges for various City services as provided for in the fee schedule, capital improvement plan expenditures, addition of 38.0 new full-time positions for a total of 395.0 full-time equivalent positions, carryover of encumbrances, all associated schedules and documents; and repealing all Ordinances in conflict herewith; and providing for an effective date. ~ Perwez A. Moheet, CPA, Director of Finance (RELATED ITEM 3 OF 4)
]NEXT UP IS AGENDA ITEM 27.FIRST READING A PROVEN ORDINANCE OF THE CITY OF CAL, TEXAS, ADOPTING A BUDGET TOTALING $272.5 MILLION FOR ALL CITY FUNDS FOR THE ENSUING FISCAL YEAR, BEGINNING OCTOBER 1ST, 2023, AND ENDING SEPTEMBER 30TH, 2024.
APPROPRIATING REVENUE AND EXPENDITURE AMOUNTS THEREOF FOR ALL CITY FUNDS AUTHORIZING NO CHANGES IN WATER SERVICE RATES, NO CHANGES IN WASTEWATER SERVICE RATES, NO CHANGES IN STORM DRAINAGE FEES.
2.52% INCREASE IN SOLID WASTE SERVICES PER CONTRACT TERMS TO T D SS ALL OF THE FEES AND, AND CHARGES FOR VARIOUS CITY SERVICES AS PROVIDED FOR IN THE FEE SCHEDULE.
CAPITAL IMPROVEMENT PLAN EXPENDITURES, ADDITION OF 38, UH, NEW FTES FOR A TOTAL OF 395 FTES.
UH, UH, CARRYOVER OF ENCUMBRANCES, ALL ASSOCIATED SCHEDULES AND DOCUMENTS AND REPEALING ALL ORDINANCES AND CONFLICT, UH, HERE WITH AND PROVIDING FOR AN EFFECTIVE DATE.
SO MAYOR AND COUNCIL, UNDER THIS AGENDA ITEM, THE CITY COUNCIL HAS PO POSTED TO ADOPT THE CITY'S BUDGET FOR FISCAL YEAR 2023 DASH 24.
ON FIRST READING, THE FIRST OF TWO PUBLIC HEARINGS SCHEDULED ON THE PROPOSED BUDGET WAS HELD EARLIER THIS EVENING.
A VERY QUICK HIGHLIGHT, A FEW KEY HIGHLIGHTS OF THE CITY'S BUDGET FOR FISCAL YEAR 23 DASH 24 TOTAL FOR ALL CITY FUNDS.
272.5 MILLION, WHICH INCLUDES C I P SPENDING GENERAL FUND OF TOTALS, 55.8 MILLION CAPITAL IMPROVEMENTS PLAN.
OUR SPENDING FOR OUR FISCAL YEAR 24 IS 176.4 MILLION NEW POSITIONS BEING ADDED IN THE BUDGET.
38 POSITIONS FOR A TOTAL NET POSITION OF 3 95.
THE PROPERTY TAX RATE IS BEING REDUCED BY 7.65%.
THERE'S NO CHANGE IN WATER SERVICE RATES, NO CHANGE IN WASTEWATER SERVICE RATES, NO CHANGE IN STORM DRAINAGE FEES, A 2.52% INCREASE IN SOLID WASTE SERVICE CHARGE PER CONTRACT WITH TEXAS DISPOSAL SYSTEMS. AND WITH THAT, IF Y'ALL HAVE ANY QUESTIONS FOR CITY STAFF COUNCILOR ZUNIGA? YES, I THINK, UH, WE SHOULD HAVE DONE 28 BEFORE 27.
YOU AGREE WITH ME? HERE'S WHY.
SO I THINK THAT THE BUDGET NUMBERS ARE PRETTY GOOD.
UM, I HAVE BEEN ASKING FOR MORE FOR OLD MAINTENANCE AND REPAIR OF ROADS TO INCLUDE MORE SIDEWALKS BECAUSE I SEE MANY ROADS AND THEY'RE STILL, UM, WITHOUT ANY SIDEWALKS.
SO MR. LANGLEY, WE INCREASED THE ROAD MAINTENANCE AMOUNT IN OUR CIPS.
UH, WHAT, WHAT WAS THAT FINAL AMOUNT? SO, IF I REMEMBER CORRECTLY, THE ROAD MAINTENANCE BUDGET WAS INCREASED FROM $750,000 PER YEAR TO 1 MILLION.
WE ALSO ADDED, UH, TWO INDIVIDUAL PROJECTS, UH, TO BE RECONSTRUCTED AS WELL.
AND HIDEN RECH, THAT WAS ANOTHER 2.3 MILLION THAT WAS INCLUDED IN THE BUDGET FOR JUST THOSE PROJECTS ALONE.
SO WHAT DO WE HAVE GOING INTO THE ROAD REPAIR MAINTENANCE, UM, BUDGET FOR THESE, FOR ROADS.
SO I BELIEVE ROAD MAINTENANCE IS THE MILLION DOLLARS.
AND THAT'S THE AMOUNT THAT WE HAVE.
UH, YOU ALSO HAVE THE ROAD BOND PACKAGE, WHICH WAS $294 MILLION.
SO THAT'S OVER A FIVE YEAR PERIOD.
UM, I DON'T KNOW WHAT THE AMOUNT IS OVER, UH, THE FIVE YEARS FOR C I P.
SO YOU PROVIDE, SO WE ALSO HAVE, UH, HALF A MILLION DOLLARS A YEAR FOR CHIP SEALING OUR STREET PROGRAM.
WE ALSO HAVE CURBING, UH, CURB PAINTING PROGRAM FOR STREETS.
SO, SO WHAT I DON'T WANNA GET INTO IS IN THE MIDDLE OF NEXT YEAR, WE'RE ASKING FOR AMENDMENTS OR REMOVING MONEY TO ADD SIDEWALKS OR LIGHTS ON SOME OF OUR OLDER ROADS.
I'M NOT CONCERNED WITH THE NEW BOND ROADS.
I JUST THINK THAT OUR DEBIL, OUR DE D REPAIR, THE ROADS THAT NEED A LOT OF REPAIR ALSO ARE THE MOST NARROWEST ROADS.
THEY, THEY HAVE NO, UM, THEY'RE NOT WIDE ENOUGH.
SO IS IT TOO LATE PEREZ TO STILL INCREASE THE ROAD REPAIR RECONSTRUCTION BUDGET AT THIS POINT? UH, MAYOR AND COUNCIL, WHAT MY RECOMMENDATION WOULD BE, AND
[01:25:01]
I DON'T KNOW WHAT THE CITY MANAGER HAS TO SAY, I'M NOT LOOKING HIS WAY,UM, AND I DON'T WANNA BE A NO, DON'T MAKE EYE CONTACT, BUT I JUST, BUT AT THIS POINT, WE ARE SO FAR INTO THE PROCESS MM-HMM.
SO ANY IN INCREASE THAT COUNCIL WANTS TO MAKE AS AN AMENDMENT, THERE SHOULD ALSO BE AN EQUIVALENT AMOUNT OF DECREASE.
SO THERE IS A NET NEUTRAL IMPACT TO THE BUDGET.
SO JUST ANOTHER THOUGHT FOR, UM, COUNCIL MEMBER ZUNIGA AND THE, AND THE COUNCIL TO CONSIDER.
IT'S, I, I UNDERSTAND, UH, THE CONCERN ABOUT ROADS AND ONE OF THE THINGS THAT WE'RE DOING THIS YEAR IS DOING A, A ANALYTICAL ASSESSMENT OF EVERY ROAD THAT WE HAVE IN THE COMMUNITY.
WE'LL GET A QUANTITATIVE SCORE OF THE QUALITY OF THAT ROAD, AND THEN FROM THAT WE CAN COME BACK WITH A PRIORITIZED LIST OF ALL THE ROADS THAT NEED TO BE RESURFACED, REPAIRED, WHAT THOSE ARE, AND TRY TO GIVE YOU SOME TYPE OF, OF, UH, LIST THAT YOU COULD CONSIDER AS A COUNCIL FOR WHAT YOU'D WANNA FUND.
THEY ALSO, THEY ALSO, UM, THE ISSUE WITH SIDEWALKS IS YOU NEED THE RIGHT OF WAY OR THE EASEMENT, UH, TO DO THAT.
AND THAT'S PROBLEMATIC IN SOME LOCATIONS, UH, TO GET THAT RIGHT OF WAY.
SO WE COULD TRY TO DETERMINE WHERE IT WOULD BE THE BEST CONNECTIONS THAT WE COULD HAVE FOR SIDEWALKS.
SO YOU WANT A SIDEWALK THAT ACTUALLY GOES SOMEWHERE, YOU KNOW, PRIORITIZING SCHOOLS, AREAS THAT YOU SEE MORE PEDESTRIAN ACTIVITY IN.
WE COULD TRY TO COME BACK WITH A LIST FOR THAT.
I WOULDN'T HAVE THAT FOR YOU THIS EVENING, BUT THAT'S SOMETHING WE CAN DO OVER THE NEXT FEW MONTHS.
WE COULD BRING THAT INFORMATION BACK IF THERE'S AN AMENDMENT THAT YOU WANTED TO MAKE IN THE FUTURE BASED ON THAT, WE COULD LOOK AT IT.
UM, BUT I DON'T REALLY HAVE AN AMOUNT OR A PARTICULAR SET OF ROADS TO RECOMMEND TO YOU RIGHT NOW, UNLESS THE COUNCIL WANTED TO TAKE THAT UP INDIVIDUALLY.
BUT COUNCIL MEMBER, TO ASSURE YOU, THE BUDGET FOR NEXT FISCAL YEAR HAS MORE THAN ADEQUATE FUNDING FOR STREET MAINTENANCE AND REPAIRS THAT OUR PUBLIC WORKS CAN KEEP UP WITH.
UH, WE HAVE ADDED A LOT MORE MONEY THAN BEFORE.
AS THE CITY MANAGER WENT OVER, UH, DURING THE BUDGET PROCESS, WE WENT OVER THE DIFFERENT STREETS AND ROADS THAT THE PUBLIC WORKS DEPARTMENT HAS IDENTIFIED THAT THEY WILL BE TARGETING NEXT YEAR.
IN ADDITION TO, TO TWO MAJOR ROADWAYS GO FORTH IN HIDE AND RI.
UH, WE'VE ADDED 2.6 MILLION ON JUST THOSE TWO MAIN ROADS.
WE'VE ALSO ADDED, UH, INCREASED THE ANNUAL BUDGET FOR STREET REPAIRS FROM SEVEN 50 TO A MILLION DOLLARS A YEAR.
SO YOU HAVE $5 MILLION OVER THE FIVE YEAR PERIOD.
AND PUBLIC WORKS HAS A LIST OF PROJECTS THAT THEY WILL BE WORKING ON NEXT YEAR.
UM, THAT, THAT WAS MY QUESTION.
COUNCILOR? PARTIALLY, I JUST WANTED TO ADD A LITTLE BIT TO WHAT MIGUEL WAS SAYING.
I THINK THAT LAST YEAR, UM, YOU KNOW, WE HAD BIG FOCUS ON ROADS, WHICH I AM SO PLEASED TO SEE THAT WE HAVE IT ON THE BUDGET THIS YEAR.
SO I DON'T KNOW IF THERE IS A WAY FOR US THAT DOES NOT INCREASE OUR BUDGET TO DO AN ANALYSIS OF ALL THE ROADS THAT MATTER FOR, YOU KNOW, THE COUNCIL AND THE RESIDENTS THAT WE CAN START WORKING ON TO PUT A PLAN TOGETHER TO BE PRESENTED FOR THE FOLLOWING YEAR'S BUDGET TO EVEN INCLUDE THE SIDEWALKS.
I'M, I'M PRETTY SURE THAT HARPER HAS HIS PRIORITY LIST, BUT I THINK IT WILL BE A GOOD WAY FOR US TO START, YOU KNOW, DRIVING ROADS AND SEEING WHAT ROADS I NEED, TALKING TO THE RESIDENTS TO SEE WHAT, YOU KNOW, ROADS THEY FIND THAT MATTER AND THEN START WORKING ON ALSO, I DON'T KNOW IF WE HAVE A STANDARD OF WHAT WE WANT THE ROADS TO LOOK LIKE TO INCLUDE SIDEWALKS.
IT'S PROBABLY NOT THE RIGHT TIME TO, UH, ALSO BRING UP THE FACT THAT WE NEED, NEED TO PLAN FOR THE ARWA.
UM, AND SO I DON'T KNOW WHAT KIND OF MONEY HAS BEEN BUDGETED.
I, FROM TONIGHT'S PRESENTATION, IT SEEMS LIKE IT'S GONNA BE READY IN 2025 AND THE CITY IS GONNA HAVE TO LAY LINES IN ORDER TO ACCEPT THAT WATER.
AND I DON'T THINK I'VE EVER HAD A DISCUSSION WITH ANYBODY, UH, BUDGETARY WISE ABOUT HOW THAT'S GONNA HAPPEN.
SO, UH, WE'VE BEEN PREPARED FOR THE R O I TO BE, UH, COMING ONLINE IN 2025.
SO THAT'S PART OF OUR C I P THAT WE HAVE FOR THE WATER AND WASTEWATER FUNDS.
SO WE HAVE THAT LINE BUDGETED FOR, LIKE, THESE PIPES ARE GONNA GO TO THIS AND IT'S GONNA EXTEND FROM THERE.
I MEAN, I KNOW WE HAVE A C I P A LIST.
AGAIN, I DON'T THINK I'VE EVER SEEN ANYTHING SPECIFIC FOR THE R O R O LINES TO, TO TAKE OUT, TO, TO, TO THE RESIDENCE.
SO THE TWO DELIVERY POINTS THAT GRAHAM TALKED ABOUT, 1626 AND THE
[01:30:01]
WATERSTONE PROJECT, BOTH OF THOSE ARE IN OUR FIVE YEAR SPENDING PLAN.SO WHAT ABOUT TO GET TO THE RESIDENCE? ARE WE GONNA HOOK 'EM UP TO TWO EXISTING LINES? I MEAN, I GET WE'RE GONNA HAVE, IT'S GONNA GO UP TO THE TWO MAIN POINTS ONCE WE GET THERE.
HOW DO WE GET IT TO EVERYBODY ELSE? SO, HARPER WILDER, PUBLIC WORKS DIRECTOR BUCKET, UM,
THAT'S WHERE OUR WILL HIT FIRST.
UM, WE'RE HAVING INFRASTRUCTURE BUILT THERE.
UM, STORAGES WILL BE PLACED THERE TO RECEIVE THAT WATER, AND THEN IT'LL GO DIRECTLY INTO OUR EXISTING INFRASTRUCTURE.
ARWA IS CONTINUING TO MOVE NORTHWEST, UH, IN A FASHION THROUGH THE CITY.
AND WE WILL REACH 1626 PUMP STATION AT THAT PUMP STATION.
UM, THERE'S INFRASTRUCTURE THAT WE'RE HAVING BUILT THERE TO RECEIVE THEM.
LIKE GRAHAM SAID, WE DO HAVE AN EXISTING GROUND STORAGE, BUT THERE'S ANOTHER GROUND STORAGE.
THERE'S, THERE'S ADDITIONAL STORAGE CAPACITIES THAT ARE GONNA BE PLACED THERE ON TOP OF, THERE'S GONNA BE A TRUE TRANSMISSION LINE.
THAT'S THE CITY OF KYLE'S THAT'S BEING DESIGNED RIGHT NOW THAT LEON'S GOT A FIRM DOING.
UH, THAT'LL GO FROM THE 1626 SUBSTATION SITE TO, UH, WELL FOUR, WHICH IS ON KOHLER'S, THEY ELEVATED ON KOHLER'S.
UM, THAT'LL GIVE US A DIRECT LINE TO THAT AREA, UM, SO THAT HE CAN CONTINUE SO THAT TIM CAN CONTINUE TO FEED PRESSURE PLANE TWO.
SO IT'S USING EXISTING INFRASTRUCTURE.
THE ONLY TWO THINGS THAT YOU'RE REALLY WAITING ON IS ARWA TO BRING THEIR LINES.
AND THEN FOR US TO BUILD THAT LINE FROM THE 1626 PUMP STATION UP TO KOHLERS AND DOWN KOHLERS TO WELL, FOUR SITE.
UH, THE DESIGN'S BEING WORKED ON RIGHT NOW.
OH NO, THE DESIGNS, THE PIPES, LEON IS A, OR IT MIGHT BE BUCKETS THE MONEY WAS ALREADY IN OR WHAT'S NOT.
NO, THE MONEY'S ALREADY IN C I P UNDER C I P.
ALL, I JUST WANNA MAKE SURE, 'CAUSE I KNOW OUR WAS GONNA BE A BIG RELIEF FOR US, BUT IF WE CAN'T GET IT OUT TO THE RESIDENTS, IT'S NOT GONNA DO US ANY GOOD.
AND ALL THAT'LL GO TO EXISTING INFRASTRUCTURE, SO, OKAY.
IF I COULD JUST ADD JUST ONE LITTLE TIDBIT, COUNCILMAN ZUNIGA, WHEN HE, WHEN WE'RE TALKING ABOUT THE BUDGETING FOR THE SIDEWALKS AND EVERYTHING LIKE THAT, WE ALL KNOW THAT WE WANT OUR ENTIRE CITY TO HAVE THAT.
NOW, IF YOU PROBABLY SAW A LOT OF MY FACEBOOK POSTINGS ABOUT DAISY AND SO FORTH.
WE GOT THE, THE SIDEWALKS UP, STREET LIGHTS ARE WORKING, BUT THAT TOOK THREE YEARS.
THAT TOOK ABOUT TWO TO THREE YEARS TO GET TO WHERE WE'RE AT.
SO WE HAVE TO START WITH THE PLAN.
AND THIS GOES BACK TO WHERE WE START LOOKING AT THE CITY AS IN REGIONS OR AS IN SOUTHWEST, EAST WEST.
SO THAT WAY WE CAN BREAK IT UP INTO DISTRICTS.
'CAUSE THERE'S SO MANY ROADS AND SO MANY STREETS OUT HERE IN THIS SMALL LITTLE TOWN THAT'S NOW A CITY.
AND WE CAN GO ON AND SAY, YES, OUR ROAD BOND'S GONNA COME HERE.
WE'RE GONNA CONSTRUCT A SIDEWALK HERE ON THIS, IN THE THIS IN OVER HERE, BUT WE'RE NEGLECTING A CERTAIN NEIGHBORHOOD THAT'S BEEN SCREAMING FOR 'EM FOR 30 YEARS.
IT ALL HAS TO BE STRATEGICALLY PLANNED.
WE'VE GOTTA REALLY LOOK AT THAT.
I, WE CAN SAY, WELL, LET'S GET A MILLION DOLLARS AND LET'S JUST GO BUILD THESE SIDEWALKS.
IT WOULD BE NICE IN THE REAL WORLD WE COULD DO THAT, BUT WE WOULD BE ALSO INFRINGING ON SOMEBODY'S PROPERTY.
WE WOULD ALSO HAVE TO LOOK TO SEE IF THE EASEMENT WOULD WORK.
WE'D ALSO SEE ABOUT HOW WIDE OR HOW NARROW THE ACTUAL ROAD OR STREET IS.
SO IT IS A GOOD PLAN THAT WE START LOOKING AT THESE SIDEWALKS, BUT WE GOTTA DO IT STRATEGICALLY.
IF IT DOESN'T GET IN THE BUDGET THIS YEAR, WE'RE STARTING TO SEE THAT THE MONEY'S COMING IN TO WHERE WE CAN START PLANNING THAT AND DIVIDE THE CITY UP INTO NEIGHBORHOODS IF WE HAVE TO, SECTIONS OF THE CITY, GET THOSE STUDIES DONE, LIKE MS. PARSLEY'S ASKING, SEE WHAT'S REALLY CRITICAL, WHETHER IT'S AN OLDER NEIGHBORHOOD WHERE HER AND I MET WITH SOME RESIDENTS YESTERDAY SAYING, WE NEED SIDEWALKS OVER HERE.
WE'VE BEEN LIVING HERE FOR 40 YEARS.
I UNDERSTAND THEY SHOULD, THEY SHOULD HAVE BEEN THE FIRST ONES.
BUT IT HAS TO BE DESIGNED STRATEGICALLY IN THE FUNDING AND TO SEE HOW WIDE WE'RE GONNA NEED 'EM AND SO FORTH ON THAT END.
MAYOR TOBYS, YOU'RE, YOU'RE CORRECT ON THAT.
AND I UNDERSTAND AS WELL, COUNCIL MEMBER MAYOR, COUNCIL MEMBER TOBYS, I'M SORRY.
AND COUNCIL MEMBER ZUNIGA, YOU, YOU, UH, I UNDERSTAND WHAT YOU'RE ASKING FOR AS WELL.
YOU WANT THESE SIDEWALKS ALONG WITH THE STREETLIGHTS AND ALL THAT MM-HMM.
RIGHT? THE PROBLEM WITH THAT, AND I'M JUST TELLING YOU KNOW, THAT, THAT HERE'S THE THINGS THAT GO ALONG WITH THAT, IS THAT A LOT OF THOSE HAVE OPEN DITCH DRAINAGE
[01:35:01]
ON THE, EACH SIDE OF THOSE ROADWAYS.AND SO NOW, OKAY, WHERE DO WE PUT THOSE SIDEWALKS? WE'VE EITHER GOT TO MOVE THAT DITCH OR WE'RE GOING TO CURB AND GUTTER, AND NOW THAT PRICE JUST GOT SUBSTANTIAL.
SO THEN WE HAVE TO WORK ALONG WITH ENGINEERING OR A FIRM TO COME IN NOW, AND NOW WE'RE GONNA DESIGN SOMETHING.
WE, WE DON'T GET THAT BACK TILL THE END OF THE YEAR.
SO NOW YOU'RE NOT WORKING ON IT TILL THE FOLLOWING YEAR.
UH, WHEREAS WHAT YOU'RE ASKING OF US IS TO GO IN HERE AND DO THE, DO YOUR JOB AND REPAIR THESE ROADS AND MAKE 'EM NICE RIGHT NOW.
THAT'S WHAT OUR STAFF IS TRYING TO DO.
WE CAN DO OTHER THINGS AS WELL, BUT IT'S MORE THAN JUST GIVING US MORE MONEY AND SAYING, HEY, ADD SIDEWALKS IN THIS TO IT.
AT LEAST ON THE PUBLIC WORKS ASPECT, WE'LL DO WHATEVER Y'ALL WANT.
I JUST AM GONNA NEED ENGINEERING AND DESIGNS FOR EACH ONE OF THOSE AHEAD OF TIME IF WE'RE GONNA DO TO THE EXTENT OF WHAT YOU'RE TALKING ABOUT FOR EACH ONE.
AND, AND I WANNA ADD ON, I MEAN, DEAR, EVERYBODY'S BRINGING UP VERY VALID, VERY, VERY GREAT POINTS.
BUT WHEN I LISTEN TO THE RESIDENTS OF THEIR COMMUNITY AS A COUNCIL MEMBER, I HAVE TO EXPLAIN TO THEM WHEN THEY ASK ME, WHY AREN'T I GETTING MY FAIR SHARE? UNDERSTAND WHY ISN'T MY, MY SECTOR NOT GETTING THE SIDEWALKS? AND THEN I HAVE TO HAVE THAT ANSWER.
AND I, AND, AND I'M, AND THANK YOU FOR, FOR RAISING UP THAT MAYBE WE NEED GUTTERS AND I AGREE, THERE'S AREAS LIKE AROUND SCHOOLS, AROUND SOME RETAIL THAT PROBABLY NEED SIDEWALKS FIRST.
BUT LET'S NOT FORGET ABOUT THE OLDER COMMUNITY NEIGHBORHOODS, UM, THAT DON'T HAVE THOSE SIDEWALKS YET AND AND HAVE NOT HAD THEM SINCE, SINCE THE TOWN WAS, WAS CREATED.
AND I, I'M NOT, I'M NOT DISCOURAGING SIDEWALKS AT ALL.
ANYONE ELSE? I'D LIKE TO MAKE A MOTION TO APPROVE AGENDA ITEM 27.
MOTION BY THE MAYOR, SECONDED BY COUNCIL MEMBER FLORES KEL.
IS THERE DISCUSSION ON THE MOTION ROLL CALL VOTE BRADSHAW.
[28.
(First Reading) Approve an Ordinance of the City of Kyle, Texas, fixing the ad valorem tax rate (property tax rate) for Fiscal Year 2023-2024 (Tax Year 2023) at $0.4693 per $100 of taxable assessed valuation; providing for the levying of ad valorem taxes for use and support of the municipal government of the City of Kyle for the Fiscal Year beginning October 1, 2023 and ending September 30, 2024; providing for apportioning each tax levy for specific purposes; and providing when ad valorem taxes shall become due and when same shall become delinquent if not paid. ~ Perwez A. Moheet, CPA, Director of Finance (RELATED ITEM 4 OF 4)
]28.PROVEN ORDINANCE OF THE CITY OF KYLE, TEXAS FIXING THE A VALOREM TAX RATE, UH, FOR FISCAL YEAR 2023, UH, AT 4.4693 PER $100 OF TAXABLE ASSESSED VALUATION, PROVIDING FOR THE LEVYING OF AVALOR TAX RATES FOR THE USE OF, UH, IN SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY OF KYLE FOR THE FISCAL YEAR, BEGINNING OCTOBER 1ST, 2023, AND ENDING SEPTEMBER 30TH, 2024.
PROVIDING FOR, UH, APPORTIONING EACH TAX LEVY FOR SPECIFIC PURPOSES, PROVIDING WHEN VALOR TAXES SHALL BE DUE AND WHEN, UH, SAME SHALL BECOME DELINQUENT IF NOT PAID.
THIS IS THE TAX RATE THAT CORRESPONDS TO THE BUDGET THAT WE JUST VOTED FOR.
UH, UH, MR. MOHE READ ALL THE INFORMATION OUT ABOUT THE NO NEW REVENUE RATE, THE VOTER APPROVED RATE, THE REDUCTION FROM OUR CURRENT RATE.
UH, AND SO THERE'S NO NEED TO READ THAT BACK IN, BUT I DO HAVE TO MAKE A SPECIFIC TYPE OF MOTION ACCORDING TO STATE LAW.
I MO MOVE THAT THE PROPERTY TAX RATE BE INCREASED BY THE ADOPTION OF A TAX RATE AT 0.4693, WHICH IS EFFECTIVELY A 4.89% INCREASE IN THE TAX RATE.
SECOND MOTION BY THE MAYOR, SECONDED BY COUNCILOR FLORES KALE.
IS THERE A DISCUSSION ON THAT? MOTION? ROLL CALL.
ALRIGHT, THE NEXT TWO ITEMS ARE THE, AT THE REQUEST OF THE DEVELOPER BEING, UH, POSTPONED, THEY'RE RELATED TO THE CAREWAY TRACT.

CAN WE HAVE IT COME BACK IN TWO MEETINGS? WHICH IS WHEN I BELIEVE THE SCHEDULE IS THE, UH, THE RECOMMENDED ACTION IS TO POSTPONE UNTIL AUGUST THE SECOND.
ALRIGHT, I'D LIKE, I'D LIKE TO, UH, OH.
AGENDA ITEM NUMBER 31 DOES NOT WAIT.

(Second Reading) An Ordinance of the City of Kyle, Texas, for the Purpose of Amending Chapter 8, Building Regulations, Article VII, Building Regulations and Permitting involving Pipelines and City’s Rights-of-Way, Roadway and Utility Infrastructure, Section 8-251 Technical Provisions for Building around Pipelines, to Amend the Restricted Pipeline Area from 200 Feet to the Area within the Boundaries of the Easement for a Natural Gas Transmission Pipeline; Providing a Severability Clause, Effective Date, Open Meetings Clause, and Providing for other related matters. ~ Paige Saenz, City Attorney
City Council voted 4-3 to approve on First Reading, with amendments, on 8/15/2023.
]UH, SECOND READING IN ORDINANCE OF THE CITY OF KYLE, TEXAS FOR THE PURPOSE OF AMENDING CHAPTER EIGHT, BUILDING REGULATIONS.ARTICLE SEVEN, BUILDING REGULATIONS AND PERMITTING INVOLVING PIPELINES AND CITY'S RIGHTS OF WAY, ROADWAY AND UTILITY INFRASTRUCTURE.
SECTION 8, 2 51, TECHNICAL PROVISIONS FOR BUILDING AROUND PIPELINES TO AMEND THE RESTRICTED PIPELINE AREA FROM 200 FEET TO THE AREA WITHIN THE BOUNDARIES OF THE EASEMENT FOR A NATURAL GAS, UH, TRANSMISSION PIPELINE, ET CETERA.
UH, THIS SECOND, READING MS. SIGNS HEARING COUNSEL PAGE SIGNS.
CITY ATTORNEY FOR THE RECORD, THIS, UH, ORDINANCE WAS DRAFTED AT THE DIRECTION OF COUNSEL TO CHANGE THE BOUNDARIES OF THE NO BUILD ZONE AROUND THE GAS PIPELINE FROM 200 FEET TO THE AREA WITHIN THE BOUNDARIES OF THE EASEMENT FOR THE NATURAL GAS PIPELINE.
CAN YOU ANSWER ANY QUESTIONS, ANY COMMENTS OR MOTIONS? COUNCILOR HEISER? THANK YOU.
UM, THIS IS AN ISSUE OF PUBLIC SAFETY FOR ME.
UM, AS WE, AS WE'VE TALKED ABOUT A COUPLE OF TIMES NOW, UH, THERE'S REALLY NO PRECEDENT FOR THE SIZE OF THIS PIPELINE BEING 42 INCHES IN DIAMETER, UH, AND REDUCING IT IS ONLY BRINGING, UH, RESIDENTS AND FUTURE RESIDENTS CLOSER TO A POTENTIAL BLAST ZONE IF THERE WERE TO BE AN EXPLOSION WITH THE PIPELINE.
UM, WHILE IT MIGHT NOT BE A LIKELY THING TO HAVE HAPPEN FOR US TO MAKE THIS DECISION NOW, UM, SEEMS, UH, A LITTLE BIT SILLY AND, UH, UM, I WOULD LIKE COUNSEL TO CONSIDER, UM, NOT APPROVING THIS REDUCTION IN THE SETBACK FROM 200 FEET TO 100 FEET.
UM, CAN IS LEONIA, WHO WOULD KNOW WHERE THE GAS PIPELINES ARE THROUGHOUT THE CITY OF KYLE THAT BE LEON OR PUBLIC WORKS? I'M JUST CURIOUS WHERE ALL OF OUR PIPELINES ARE.
UM, AND, AND I WANNA MAKE CLEAR THAT AS IT STANDS NOW, THEY COULD BUILD STILL WITHIN 400 FEET.
UM, AND SO MY CONCERN IS DO, LIKE, ARE ARE WE GONNA LIVE IF, IF IF THERE'S AN EXPLOSION? AND IT'S, AND THIS IS NOT TOWARDS YOU, MY MY QUESTION FOR YOU IS, IS THE AREA ACROSS THE STREET FROM THE HEROES MEMORIAL WHERE THERE IS, UM, SOME DEVELOPMENT PROPOSED? IS THERE A PIPELINE THERE? COUNCIL MEMBER? I'M NOT FAMILIAR WITH ALL THE GAS LINES WITHIN THE CITY LIMITS, BUT I DO KNOW THAT THERE, WE DO HAVE A LOT OF GAS LINES AROUND THE CITY LIMITS, BUT THERE ARE ONLY FOUR INCH, SIX INCH LINES.
I THINK THIS ORDERS WAS ONLY INTENDED TO ADDRESS THE MUCH, MUCH LARGER GRASSLAND.
THAT'S, UH, KINDER MORGAN PUT IN.
UM, THE, UH, THERE IS A LINK TO MAP THAT, UH, WE HAVE IN OUR G I S SYSTEM THAT WILL DIRECT YOU TO, UH, THE MAJOR LINES I THINK, THAT ARE IN THE, THAT, THAT ARE WITHIN THE CITY.
I GUESS MY, I GUESS MY QUESTION, I DON'T KNOW WHO IT'S TO MAYBE TO BEAR, UM, IF, IF, IF THERE'S AN EXPLOSION ON A 42 INCH LINE, IS 400 FEET GONNA MAKE A DIFFERENCE? THANK YOU FOR ASKING THAT QUESTION,
UM, MAYBE NOT, BUT IF THERE'S A CHANCE THAT IT WOULD, IS THAT A RISK THAT WE'RE GONNA TAKE HERE AFTER THIS DECISION WAS MADE, UH, INITIALLY THAT THE CITY DECIDED IT DECIDED THE SETBACK SHOULD BE AT 200 FEET.
THAT'S WHAT THE ORDINANCE CALLS IT.
I DON'T THINK THAT'S TRUE EITHER, BUT, UM, IT DOESN'T DEFINE IT EITHER WAY.
[01:45:01]
SO MY ONLY CONCERN IS WITH THE LANDOWNER.AND IF, IF THEY DIDN'T, IF THE CITY DIDN'T WANT THAT TO BE USABLE LAND, THEN THERE SHOULD BE SOME TYPE OF REIMBURSEMENT FOR THAT.
AND IF THAT'S BY WAY OF A SETBACK OR BY WAY OF AN EASEMENT, I THINK, UM, THE WAY THAT WE ARE TREATING THE LANDOWNER SEEMS TO BE A LITTLE BIT UNFAIR.
I BELIEVE THIS ONLY AFFECTS TWO LANDOWNERS.
UM, AND IN THE EVENT THAT THEY, HE SELLS IT AND IT'S DEVELOPED, THEY, YOU CAN STILL DEVELOP WITHIN THAT 400 FEET.
SO I UNDERSTAND THE CONCERN AND MY, MY SUGGESTION TO THAT IS TO HAVE THE CITY PURCHASE ALL OF IT.
THEN IF WE DON'T WANT BUILDING ON TOP OF PIPELINES SUCH AS A 42 INCH FOR, FOR KINDER MORGAN, THEN I SAY LET'S JUST PURCHASE IT.
OTHERWISE, WHY ARE WE LIMITING THE LANDOWNER ON WHAT HE CAN DO ON HIS LAND, UH, FOR REASONS OF PUBLIC SAFETY? AND THEY'RE JUST BECAUSE, UM, WELL, LET ME BACKTRACK.
THIS LAND CAN BE USED FOR OTHER PURPOSES, UH, PER CONVERSATION WITH PLANNING AND ZONING.
YEAH, I'M, BUT WE CAN'T DICTATE WHAT IT CAN BE USED FOR.
SO THERE ARE MANY OTHER USES FOR, FOR AS CURRENTLY CONSTRUCTED FOR THIS LAND.
WELL I THINK THAT'S COMPLETELY UP TO THE LANDOWNER.
AND WITH THAT SAID, I'D LIKE TO MAKE A MOTION TO APPROVE AGENDA ITEM NUMBER 31.
MOTION MADE BY COUNCIL MEMBER FLORE SCALE.
IS THERE A SECOND? SECOND TO HEAR THE VOTES.
UH, SECONDED BY COUNCIL MEMBER ZUNIGA.
IS THERE DISCUSSION ON THE MOTION? I JUST, I I HEARD A STATEMENT THAT THIS ONLY AFFECTS TWO LANDOWNERS.
IS THAT, IS THAT WHY YOU, YOU THINK THIS ONLY AFFECTS TWO LANDOWNERS? WELL, I THINK WHEN THERE WAS A PRESENTATION GIVEN, IT WAS, UH, THAT IT, IT AFFECTS THE LAND AS FAR AS TA WHAT WE'VE TAKEN AS A CITY, UM, DOES NOT AFFECT MORE THAN TWO LANDOWNERS.
AM I INCORRECT? THE, THE KEN MORGAN PIPELINE GOES FROM THE FAR WEST SIDE OF KYLE ALL THE WAY THROUGH, I DON'T KNOW, MAYBE HALF 10 LANDOWNERS TO I 35 UNDERNEATH SIDE 35.
AND THEN ALL THE WAY OUT EAST IT PROBABLY AFFECTS 20.
THIS, THIS CHANGE PROBABLY AFFECTS 20 DIFFERENT LANDOWNERS.
IT IS, IT IS A SIGNIFICANT AMOUNT.
I KNOW YOU'RE THINKING ABOUT ONE 'CAUSE HE'S THE ONE THAT BROUGHT IT UP TO YOU.
WELL, I THOUGHT THIS WAS, THIS IS A MASSIVE, MASSIVE CHANGE IN OUR POLICY.
AND IF I HAD A MAP, I COULD LOOK AT THAT.
SO I HONESTLY VOTED ON THIS THINKING, YOU KNOW, I, I DIDN'T HAVE, I THINK THE ADEQUATE RESEARCH ON PIPELINES, AND I DON'T THINK ANY OF US IN HERE IS ANY EXPERT ON PIPELINES AND GAS LINES AND ANY OF THAT.
UM, HOWEVER, I WAS READING ABOUT THE IMPACT THAT WEATHER HAS ON THESE PIPELINES AND LAND MOVEMENT.
AND AFTER RECEIVING SEVERAL CONCERNED RESIDENTS EMAILS ABOUT THIS PIPELINE, I CANNOT FULLY GO BACK TO SUPPORT MOVING THE EASEMENT FROM 200 TO 100.
SO I WON'T BE IN SUPPORT OF THIS DECREASE OF THE EASEMENT.
[32. Discussion and possible action of a Request for Qualifications for the design of the future sportsplex in Brick & Mortar District. ~ Ashlee Bradshaw, Council Member]
AGENDA ITEM NUMBER 32.DISCUSSION OF POSSIBLE ACTION OF A REQUEST FOR QUALIFICATIONS FOR THE DESIGN AND FUTURES, UH, OF THE FUTURE SPORTSPLEX IN THE BRICK AND MORTAR DISTRICT.
SO BACK IN 2021, THE POST ACT BOARD, WHICH OVERSAW THE DEDICATION OF THE 2020 PARKS BOND MONEY APPROVED A SPORTSPLEX TO GO INTO WHAT WAS THEN CALLED UPTOWN, NOW CALLED BRICK AND MORTAR.
AND SINCE WE WERE JUST CONVEYED THE LAND LAST WEEK, I THINK THAT NOW IS A GREAT TIME TO GET THE BALL ROLLING ON DESIGNING THE SPORTSPLEX.
I PERSONALLY FEEL LIKE IT WOULD BE BEST TO DO IT IN A, IN THE FORM OF A TASK FORCE WHERE WE HAVE DEDICATED COUNCIL MEMBERS AND DEDICATED COUNCIL MEMBERS WORKING WITH STAFF AND GETTING THINGS DONE EFFICIENTLY.
BUT I AM OPEN TO HOWEVER YOU ALL WOULD LIKE TO MOVE FORWARD WITH GETTING THE BALL ROLLING.
SO WE, THE LAND WAS CONVEYED LAST WEEK, IS THAT RIGHT? OR THE LAST DOCUMENT SIGNED OR 1111 ACRES, UH, WERE CONVEYED TODAY.
THERE ARE TWO OTHER PARCELS THAT WE'RE WORKING ON.
[01:50:01]
WELL, I WANNA SAY I APPRECIATE COUNCIL MEMBER BRADSHAW FOR BRINGING THIS FORWARD EXACTLY ON THE DAY IT WAS CONVEYED.I THINK THAT WAS REALLY WHAT WE'VE BEEN WAITING ON ALL THIS TIME.
SO WASTING NO TIME, I'M IN SUPPORT.
DOES ANYONE HAVE THOUGHTS ON THIS PROPOSAL? COUNCIL MAYOR PROTO, I, I LIKE THE IDEA AS WELL.
NOW I KNOW WE'VE HAD SOME ISSUES OR WE'VE HAD SOME DISCUSSIONS ABOUT TASK FORCE THEMSELVES, BUT IF YOU SEE SOME OF THE PROJECTS THAT WE'VE HAD IN THE PAST, WHAT IT DOES IS IT NARROWS IT DOWN, UH, WITH A GROUP OF INDIVIDUALS TO, OF COUNCIL.
BUT IF WE WERE TO GO WITH THIS ROUTE OF A TASK FORCE TO DO IT CORRECTLY, TO WHERE WE INFORM ALL OF COUNSEL AND INCLUDE EVERY SINGLE ONE OF US IN THE FINAL DECISION MAKING.
BUT IF YOU HAVE THAT TASK FORCE OF THE THREE INDIVIDUALS, YOU CAN KIND OF NARROW DOWN THE SCOPE AND GIVE EACH ONE A RESPONSIBILITY.
AND YOU CAN ACTUALLY COME UP WITH A CONCEPT DESIGN.
NOW, IF YOU WANT TO DO IT ALL AS COUNSEL, YOU GOTTA REMEMBER YOU'RE GONNA HAVE SEVEN DIFFERENT OPINIONS, OKAY.
THE WAY IT LOOKS AND SO FORTH ON THIS END.
WHAT KIND OF SPORTS DO WE WANT? YOU KNOW? UM, SO THAT'S ANOTHER THING.
I KNOW SOME PEOPLE MAY SAY, WELL, I THINK SOCCER IS, IS MUCH NEEDED, RIGHT? WELL, UH, MY SON PLAYS LACROSSE, SO MAYBE, YOU KNOW, COULD WE LOOK AT GETTING A LACROSSE FIELD? SO I, UM, I, I'M ALL OPEN FOR THE IDEA OF A TASK FORCE.
'CAUSE IT, IT WOULD NARROW DOWN THE SCOPE OF, OF THREE INDIVIDUALS WORKING TOGETHER AND COMING UP WITH CONCEPTS OF THE DESIGN OF LIKE WHAT SPORTS WE, EVEN IF WE HAVE TO DO A SURVEY OF LIKE, WHAT KIND OF FIELD WILL WE LOOK AT, WE CAN NARROW DOWN THOSE THREE INDIVIDUALS TO, TO BRING IT BACK TO COUNCIL, AND THEN COUNCIL CAN THEN LOOK AT IT AND GIVE THEIR INPUT AND THEN GO FROM THERE.
I THINK IT'S A MATTER OF COLLABORATION AND WORKING TOGETHER ON THIS, UM, IS WHAT I SAW WHEN I WALKED IN TO COUNCIL IN 2020.
A LOT OF DECISIONS WERE ALREADY MADE ABOUT THE HEROES MEMORIAL, UH, OR THE, THE, THE CONCEPT ALSO FOR THE PUBLIC SAFETY CENTER OR THE POLICE STATION.
SO, UM, BUT IT'S STILL JUST HAVING THAT INPUT AS FAR AS WHAT, WHAT THESE COULD GO WITH AND GETTING AN IDEA OF WHAT KIND OF A SPORTS FLEX WE WANNA LOOK AT, UH, AS A WHOLE.
ARE WE GONNA DO INDOOR OR IS IT GONNA BE ALL FIELD? AND WHAT DOES THE FIELDS LOOK LIKE? WHAT DOES THE STADIUM LOOK LIKE? UM, WHAT TYPE OF SPORTS ARE WE GONNA WANT TO ENCOURAGE? WOULD IT BE A POSSIBLE THAT, I EVEN TALKED TO MARIANA ABOUT THIS ONCE, MAYBE FINALLY HAVING THE CITY LEAGUE OF, OF DIFFERENT TYPES OF SPORTS, YOU KNOW, TO BRING IN THAT KIND OF REVENUE.
SO IT JUST, YOU KNOW, IT'S, IT'S ALL OPEN.
SO I, UM, I LIKE THAT IDEA, MS. BRAD.
SO WHO FROM STAFF DO WE THINK NEEDS TO PARTICIPATE IN THIS? OBVIOUSLY, YOU KNOW, MARIANA WOULD BE A GIVEN THERE, THIS IS A REALLY IMPORTANT PROJECT, BUT IS THERE ANYONE ELSE THIS CAN YOU THINK OF THAT WOULD YOU'D WANT TO INCLUDE? I THINK JERRY NEEDS TO BE INCLUDED.
NOW ARE YOU ASKING FOR THE TASK FORCE ITSELF? WELL, THE TASK FORCE IS, IS GONNA BE JUST THE COUNCIL.
BUT IN TERMS OF THE STAFF MEMBERS WHO ARE, WHO ARE, WHO ARE A PART OF IT, IF WE'RE FOLLOWING THE OLD MODEL, THAT IS WE CAN DO WHATEVER WE WANT.
I DON'T REMEMBER IF WE ACTUALLY SET A POLICY FOR TASK FORCES.
I THOUGHT WE DID AT ONE POINT IN TIME.
I DON'T, YOU YOU HAVE A POLICY.
IT IS NOT CODIFIED IN THE CODE OF ORDINANCES.
SO WE'LL NEED TO PULL THAT UP TO LOOK AT THE, THE PROCESS THERE.
UM, ABOUT HOW YOU ENGAGE THE TASK FORCE.
WELL, SO HERE, HERE'S MY GENERAL FEEDBACK, WHICH IS WHY I'M THANKFUL FOR COUNCIL MEMBER BRADSHAW FORCING THE AGENDA.
THE VOTERS APPROVED THE MONEY TO BE SPENT EXPECTING A SPORTSPLEX, UH, THREE YEARS AGO, ALMOST TO THE DAY.
SO THE DELAY HAS BEEN, FIRST WE HAD TO WAIT A YEAR TO GET THE COUNTY'S PARTICIPATION.
SO THAT WAS A REALLY WISE, UH, PAUSE SO THAT WE COULD GET THIS THING FULLY FUNDED, WHICH HAPPENED.
AND THEN WE ALSO HAD TO WAIT FOR THE LAND TO BE CONVEYED AS A PART OF A RETAIL ROADS AGREEMENT, WHICH, SO IT'S A MULTI-STEP PROCESS, WHICH IS WHY IT'S TAKEN SO LONG.
BUT NOW EVERY STEP HAS FALLEN, EVERY DOMINO HAS FALLEN AND THE DOORS OPEN FOR US TO PURSUE THIS.
AND SO IN MY OPINION, NOW WE NEED TO PUT ALL GAS AND GET THIS THING DONE, UH, IMMEDIATELY.
SO I'M, I JUST WANNA MAKE SURE STAFF UNDERSTANDS LIKE THIS IS, THIS IS A VOTER APPROVED REGIONAL SPORTSPLEX, THE LAND IS CONVEYED, THE MONEY IS THERE AND, AND WE NEED TO, WE NEED TO GIVE SERIOUS ATTENTION TO THIS BECAUSE THIS, THIS, THIS IS AN IMPACT PROJECT THAT WILL HAVE SIGNIFICANT BENEFITS TO THE COMMUNITY.
WE DON'T HAVE REALLY GOOD SPORTS FIELDS IN THE CITY OF KYLE.
IT'S QUITE INFERIOR IN MANY WAYS.
NOT TO KNOCK ON ANY OF THE SPORTS FIELDS THAT WE HAVE, BUT IT'S, THIS IS A OPPORTUNITY TO INCREASE QUALITY OF LIFE IN KYLE, MAJORLY UNDERSTOOD.
AND, AND IF THE, UH, COUNCIL WANTS TO PROCEED WITH THIS, THIS WILL GO
[01:55:01]
ON MY ACTION ITEM MATRIX AND WE'LL MAKE SURE WE BRING IT BACK AND GET THIS, GET THIS DONE FOR YOU.UM, BUT I DO THINK IF THE COUNCIL WANTS TO APPOINT A TASK FORCE, IT PROBABLY NEEDS TO COME BACK AS A SEPARATE ITEM THAT YOU WOULD THEN, THEN APPOINT THAT TASK FORCE.
AND I DON'T, I DON'T KNOW THE POLICY OFF TOP, TOP OF MY HEAD.
YEAH, WE NEED TO LOOK AT THE, BUT BUT WE ALSO NEED TO BRING BACK THE R F Q, WHICH IS THE REALLY, THE WAY THIS IS, THIS IS POSTED AS WELL.
SO THAT WE CAN START THAT PROCESS AT SIMULTANEOUSLY SO WE'RE NOT DELAYING TIME.
AND WE COULD CERTAINLY, UH, DRAFT THE R F Q AND FRANKLY JUST RELEASE THE R F Q AND THEN FORM THE TASK FORCE TO REVIEW THE SUBMISSIONS.
SO UNLESS, AND ALSO ACTUALLY I, I'M, I'M, I'M GONNA TAKE ISSUE WITH THE, THAT WE HAVE TO BRING IT BACK TO DO THE SAME THING OVER AGAIN.
WE, I UNDERSTAND THAT THERE ARE, THERE'S A POLICY, BUT IF WE WANNA APPOINT THREE, THREE MEMBERS OF US TO A TASK FORCE THAT'S WITHIN THE SCOPE OF THAT POLICY, A HUNDRED PERCENT.
I DON'T KNOW IF WE'RE POSTED FOR THAT.
NO, WE JUST, WE DON'T, YEAH, WE DON'T, WE DON'T HAVE IT POSTED FOR THAT ITEM TO A, TO APPOINT A TASK FORCE.
WE DON'T BECAUSE THE AGENDA JUST SAYS DISCUSSION.
SO WOULD THAT BE CONSIDERED THE ACTION? BUT IT SAYS OF A REQUEST FOR QUALIFICATIONS FOR THE DESIGN.
SO WOULD THE ACTION BE APPOINTING, UM, POSSIBLE TASK FORCE TO LOOK INTO THE REQUEST FOR QUALIFICATIONS? IS THAT WHAT WE'RE HE'S RIGHT INTO THE DESIGN.
I THINK WE FUTURE, WE HAVE TO, BUT OUT OF AN ABUNDANCE OF CAUTION, AS LONG AS IT'S HAPPENS ALONGSIDE THE R F Q, WE WON'T LOSE ANY TIME.
AND IT, AND IT, IT'S NOT POSTED FOR A TASK FORCE.
AND SO THERE'S, THERE'S NO HARM THERE.
BUT, UM, DO YOU WANNA MAKE THE MOTION FOR, TO BRING BACK AN R F Q? SURE.
I WOULD LIKE TO MAKE A MOTION TO DIRECT STAFF TO, UH, PUT TOGETHER AN R F Q FOR D TO DESIGN OF A SPORTSPLEX IN THE BRICK AND MORTAR DISTRICT.
AND IF WE COULD HAVE THIS, ACTUALLY I'LL EMAIL YOU, BUT IF WE COULD HAVE IT ON THE NEXT AGENDA FOR A TASK FORCE, THAT WOULD BE GREAT.
AND THE R F Q RIGHT? WELL, AND THE R F Q.
IS THAT ENOUGH TIME FOR YOU? FOR THE R F Q? RIGHT.
I, I, WE CAN CERTAINLY BRING IT BACK AND HAVE THE COUNSEL APPROVE THE RELEASE OF THE R F Q IF THAT'S WHAT YOU'RE LOOKING FOR.
THIS IS DIRECTION I NEED JUST TO GO AHEAD AND RELEASE THE R F Q AND GET THAT STARTED.
I'LL BE HAPPY TO START THAT NOW, JUST BASED ON THIS DIRECTION.
AND THEN JUST BRING BACK THE TASK FORCE ITEM FOR YOU TO, TO, TO APPOINT THE TASK FORCE.
WELL THE TASK FORCE SHOULD LOOK AT THE R F Q AS WELL.
'CAUSE THIS IS A SPORTSPLEX THAT HAS SO MANY DIFFERENT LAYERS TO IT.
SO LET'S BRING THE R F Q AND THE TASK FORCE BACK AT THE NEXT MEETING SO THAT WE CAN LOOK AT IT.
SO THE MOTION BY COUNCIL MEMBER, UH, BRADSHAW, SECOND BY THE MAYOR THAT WE, UH, BRING BACK AN R F Q AND A AND A ITEM FOR THE SELECTION OF A TASK FORCE FOR THE REGIONAL SPORTSPLEX AT THE NEXT MEETING.
IS THERE DISCUSSION ON THAT MOTION? HOLD IN FAVOR, SAY AYE.
[33. Hold a discussion and consider directing the City Manager to provide a report to the City Council that identifies options for requiring new developments to have at least 50% of their landscaping designed with a focus on water conservation. ~ Daniela Parsley, Council Member]
UP.CONSIDER DIRECTING THE CITY MANAGER.
PROVIDE A REPORT TO THE CITY COUNCIL THAT IDENTIFIES OPTIONS FOR REQUIRING NEW DEVELOPMENTS TO HAVE A, AT LEAST 50% OF THEIR LANDSCAPING DESIGNED WITH A FOCUS ON WATER CONSERVATION CUSTOMER PARSLEY.
UM, SO THE ITEM IS BASICALLY WHAT IT, THE LANGUAGE SAYS.
I KNOW WE JUST PASSED A LANDSCAPING ORDINANCE.
UM, HOWEVER, I THINK WE ARE IN A SITUATION WHERE WE ARE NOT ACTUALLY REQUIRING ANYTHING FROM DEVELOPERS.
AND I DON'T KNOW THE LEGALITY OF THIS AND HOW MUCH WE CAN REQUIRE FROM NEW DEVELOPMENTS THAT ARE COMING.
BUT WHAT I WOULD LIKE TO SEE IS IF WE COULD DIRECT BRAND OR DIRECT STAFF TO LOOK INTO THE POSSIBILITY OF US REQUIRING, NOT JUST SUGGESTING, BUT REQUIRING FROM ANY NEW DEVELOPMENT THAT THEY BRING AT LEAST 50% OF THE LANDSCAPING TO BE WATER CONSERVATION FRIENDLY, TO INCLUDE ANY OF THE, LIKE, ARTIFICIAL TURF OR SCAPE, SOMETHING LIKE THAT, THAT WILL REQUIRE LESS USE OF WATER.
WE JUST HAD DISCUSSION ABOUT SPRINKLERS AND THE ONE, THE ONES THAT ARE VIOLATING THE MOST ARE COMMERCIAL PROPERTIES AND THE IRRIGATION SYSTEMS THAT ARE IN COMMON AREAS FOR RESIDENTIAL.
SO I THINK WE DO NEED TO ADDRESS ANYTHING COMMON IN THE FUTURE.
SO I DON'T KNOW IF THAT'S SOMETHING THAT YOU ALL ARE AMICABLE TO ANY DISCUSSION ON THAT PROPOSAL.
I, I'M NOT SO SURE THAT THE 50% IS THE NUMBER THAT I'M ON, BUT I THINK YOUR, YOUR, YOUR ITEM HERE ABOUT, UH, HAVING, SEEING WHAT WE CAN DO TO INCREASE WATER CONSERVATION AND FU FUTURE DEVELOPMENTS IS ABSOLUTELY INAPPROPRIATE ITEM TO HAVE.
WE NEED, WE NEED SOME RESEARCH, WE NEED OPTIONS TO BE BROUGHT BACK THE WAY THAT STAFF HAS BEEN DOING IT.
[02:00:01]
MAYBE, IF THE, THE MOTION WAS JUST GENERALLY TO HAVE THEM BRING BACK SOME OPTIONS FOR HOW TO MAKE OUR, UH, DEVELOPMENT PROCESSES MORE ROBUST FOR WATER CONSERVATION.I, I, I'M REALLY THANKFUL YOU BRINGING THIS FORWARD.
I, I DON'T KNOW WHAT LEGALLY CAN BE DONE, WHICH IS WHY I WAS THINKING I DON'T WANT TO, LIKE, YOU KNOW, WHEN WE CANNOT LEGALLY ASK FOR A SPECIFIC ARCHITECTURAL DESIGN, I WOULD LIKE TO SEE IF, YOU KNOW, IF STAFF CAN BRING SOME IDEAS BACK OF THINGS THAT WE COULD REQUIRE, IF WE CAN REQUIRE MAYOR PRO TIM.
I THINK IT ALSO COULD BE A COMBINATION OF WORKING WITH OUR ECONOMIC DEVELOPMENT TEAM AND THEN MAYBE, UH, PLANNING AND ZONING COMMISSION TO WHERE IF THEY WOULD LOOK AT SOME OF THE DEVELOPMENTS THAT WOULD WANT TO COME TO KYLE TO SEE IF THEY, UM, ARE WILLING TO PARTICIPATE IN, IN HARVEST WATER AND SO FORTH IN GREEN INFRASTRUCTURE.
LIKE THE INFORMATION I GAVE, UH, DANIELLE WHEN I DID RESEARCH LIKE THIS ONE HERE, UM, THIS DEVELOPMENT HERE IN SANTA ANA, CALIFORNIA, THEY USE, UM, BARRELS THROUGHOUT THEIR WHOLE ENTIRE APARTMENT COMPLEX AND THEY COLLECT WATER ON THAT AND THEY USE THAT FOR A LOT OF THEIR WATERING, FOR THEIR INFRASTRUCTURE, FOR THEIR, THEIR GRASS AND SO FORTH.
I WONDER IF, IF IT'S A MATTER OF LOOKING INTO WHENEVER DEVELOPERS COME OUR WAY TO SAY THIS IS KIND OF WHAT OUR NEW CONCEPT IS.
'CAUSE OBVIOUSLY WE ARE IN A SERIOUS DROUGHT.
WE ARE TAKING OUR WATER CONSERVATION VERY, VERY SERIOUS.
SO I THINK IT'S JUST LIKE WHAT DANIELLE IS COUNCILMAN PARTIALLY TRYING TO GET AT IS WHAT CAN WE DO TO START THINKING OUTSIDE THE BOX? YOU GOTTA BUILD IT FIRST BEFORE YOU THINK OUTSIDE OF IT.
UM, TO SEE HOW WE CAN BE ABLE TO, TO WORK WITH DEVELOPERS TO SEE WHAT THEIR PLANS ARE FOR WHEN IT COMES TO CONSERVING WATER AND HOW THAT CAN HELP WHENEVER WE DO GET RAINSTORMS, WHAT WE CAN DO ON THAT END.
AND JUST TO ADD REALLY QUICKLY TO WHAT MAYOR PERAN WAS MENTIONING, I I WOULD LOVE THE RAIN, RAIN BARRELS OR ANY RAIN RECLAIMED SYSTEM IF WE GOT ANY RAIN.
RIGHT? BUT RIGHT NOW WE HAVE TO PLAN ON NO RAIN.
SO, BUT TO THAT POINT, LIKE IT'S BEEN SAID, 'CAUSE I ALWAYS THOUGHT, MAN, RAINWATER COLLECTION IN A RESIDENCE MAKES SO MUCH SENSE, BUT THEN IT'S LIKE, OH, THAT'S GONE WITHIN A WEEK.
AND THEN YOU'VE GOT THE WHOLE SUMMER.
BUT THE POINT IS, WE CAN'T JUST SIT HERE AND SORT OF SPIT.
WE NEED SOMEBODY TO REALLY, BECAUSE, AND I LOVE WHAT MAYOR PRO TEM SAID ABOUT ECONOMIC DEVELOPMENT BECAUSE IT'S, IT'S MAYBE THERE'S ORDINANCES AND RULES LIKE Z ESCAPING OR, YOU KNOW, YOU KNOW, REQUIRING CERTAIN THINGS.
BUT MAYBE IT'S ECONOMIC DEVELOPMENT TOO.
LIKE IT'S WHERE WE'RE TRYING TO INCENTIVIZE, BUT WE NEED A PACKAGE.
SO THAT KIND OF BRINGS ME BACK TO PLANNING AND ZONING COMMISSION CUSTOMER HEISER.
I MEAN, I LOOKED OVER, YOU WEREN'T RAISING YOUR HAND, SO EXCITED TO SPEAK.
OH, I EARLIER I WAS, UH, NEARLY, UH, THIS IS, I MEAN THIS IS THE WATER CONSERVATION PRESENTATION WE WERE GIVEN BY KATHY TWO MEETINGS AGO.
AND WHAT WE FOLLOWED UP WITH YOU ALL WITH BRIAN AND STAFF ON LAST WEEK DURING THE WATER PRESENTATION, WHAT WAS IT? TUESDAY? YES, SIR.
UM, ON PAGE, PAGE FOUR OF THE WATER CONSERVATION PROGRAMS, UM, PRESENTATION, IT LISTS OUT ALL THE THINGS THAT WERE A, A HANDFUL, I THINK LIKE EIGHT OR NINE DIFFERENT THINGS THAT WE COULD DO WITH DEVELOPMENT TO TRY TO CONSERVE WATER EXACTLY TO WHAT YOU'RE TALKING ABOUT.
UM, COUNCIL MEMBER SBI IS TO BRING DIFFERENT TYPES OF DEVELOPERS HERE WHO WOULD BE MORE CONSCIOUS ABOUT CONSERVATION AND MAYBE EVEN SOLAR AND THINGS, UH, OF THAT NATURE.
UM, AND THERE'S ALSO A LOT OF INFORMATION IN HERE ON, UH, THE RAIN BARREL PROGRAM THAT THE CITY TRIED YEARS AGO.
BUT, UM, YOU KNOW, I LIVED IN LOS ANGELES FOR, UH, NINE YEARS AND A PLACE WHERE THERE'S JUST A PERPETUAL FEAR OF NOT HAVING ENOUGH WATER.
AND WATER CONSERVATION IS SOMETHING THAT IS JUST DRILLED INTO PEOPLE'S MINDS.
AND I THINK THAT WE NEED TO GET MORE INTO THAT MINDSET OF, UM, THIS ISN'T JUST, UM, AN AS NEEDED THING THAT WE NEED TO BE CONSERVING, UH, PRACTICING CONSERVATION, UH, YEAR ROUND EVERY YEAR FOR THE REMAINDER OF OUR LIVES.
UM, SO I, I FEEL LIKE THIS IS SOMETHING THAT WE TALKED ABOUT, WE'RE GONNA GET SOME FOLLOW UP ON, UH, AS TO WHICH OF THE FIVE OPTIONS THAT WERE PRESENTED TO US ON PAGE 24 IS WHICH OF THEM WERE THE MOST VIABLE AND WHICH WERE THE ONES THAT WE COULD, UH, ENACT THE QUICKEST? AND I KNOW THAT COUNSEL VOTED TO MOVE FORWARD WITH THESE SEVEN ZERO I I WAS JUST WONDERING FROM THOSE OPTIONS, OR
[02:05:01]
FOR STAFF TO LOOK INTO WHAT CAN WE DEMANDI, I MEAN, AGAIN, UM, I THINK IF YOU'RE ASKING ME TO COME BACK WITH SOME OPTIONS FOR YOU TO LOOK AT IT, WE CAN, WE CAN TRY TO GIVE YOU SOME, A RANGE OF OPTIONS THAT YOU COULD LOOK AT IMPLEMENTING THAT ARE SOMETHING WE VET WITH OUR LEGAL TEAM OR PLANNING TEAM.
WE COULD BRING THAT BACK TO YOU.
I DON'T HAVE THAT FOR YOU TODAY.
SO I WAS JUST GONNA SAY, WHY DON'T WE CONSIDER GIVING THIS AS AN ASSIGNMENT TO PLANNING AND ZONING TO HAVE THEM WORKSHOP IT SO THAT THEY CAN REALLY LOOK MORE CAREFULLY AT CONSERVATION, UH, DEVELOPMENT CLADDING.
'CAUSE WE WON'T HAVE TO LOOK INTO THE LEGALITY OF DEMANDING THINGS 'CAUSE THAT'S WHERE, THAT'S EXACTLY WHAT I WOULD LIKE TO DO.
IT IS NOT JUST, HEY, I WOULD LIKE TO SUGGEST YOU TO BRING A RAIN BARREL.
NO, THE CITY OF KNA REQUIRES FOR YOU TO DO AT LEAST 50% OFF OR SOMETHING.
I MEAN, I WANNA KIND OF PULL AWAY FROM THE GRASS.
I, I THINK WHATEVER WE DO, TAKING IT THROUGH P AND Z, GETTING SOME RECOMMENDATIONS FROM THEM AND THEN BRINGING IT TO THE COUNCIL WOULD BE A, A GOOD, UM, IDEA.
IT'S GONNA BE A, A, A CODE CHANGE.
WE CAN CERTAINLY AS A STAFF, TAKE THE LEAD ON TAKING A LOOK AT SOME OPTIONS, BRING IT TO P AND Z AND THEN BRING IT BACK TO YOU GUYS.
DO YOU NEED ANY MOTION FOR THAT? YEAH, WE SHOULD GIVE A MOTION TO DIRECT THE PLANNING AND ZONING COMMISSION TO LOOK INTO THIS.
DO YOU WANNA PUT IT TOGETHER?
I'M JUST PUTTING HER ON THE SPOT.
YOU THINK THAT GENERALLY THAT P AND Z WOULD BE, WOULD LIKE TO TAKE THIS ON? WE'LL, WHATEVER COUNCIL THINKS IS HELPFUL.
I'D LIKE TO MAKE A MOTION TO DIRECT THE PLANNING AND ZONING COMMISSION TO BEGIN RESEARCHING AND WORKSHOPPING THE, UH, VARIOUS WAYS TO HELP US IMPROVE OUR, UH, WATER CONSERVATION EFFORTS AS A RESULT OF EXISTING AND NEW DEVELOPMENT, UH, TO INCLUDE, BUT NOT LIMITED TO, UH, ORDINANCE REVISIONS AND, UH, INCENTIVES AND PROGRAMS THAT BRING ABOUT THE DESIRED CHANGE.
SECOND MOTION BY THE MAYOR, SECONDED BY MAYOR PRO TEM.
IS THERE DISCUSSION ON THAT MOTION? ALL IN FAVOR SAY AYE.
COMMISSIONER ERMAN, YOU GOT HOMEWORK? ALL RIGHT,
[34. Hold a discussion and consider directing the City Manager to provide the City Council with a report on the city’s reclaimed water master plan. ~ Daniela Parsley, Council Member]
NEXT UP IS AGENDA ITEM 34.WHOLE DISCUSSION CONSIDERED DIRECTING CITY MANAGER TO PROVIDE CITY COUNCIL WITH A REPORT ON THE CITY'S RECLAIMED WATER MASTER PLAN.
COUNCIL MEMBER MEMBER PARSLEY.
I HAD A RESIDENT REACH OUT SAY THAT WE WERE NOT TAKING WATER CONSERVATION SERIOUSLY.
AND I'M LIKE THINKING, I THINK EVERY MEETING HAS SOMETHING ABOUT WATER CONSERVATION.
BUT, UM, SO I, I WAS GOING BACK TO 2022 AND I SAW THAT WE WERE TALKING ABOUT THE RECLAIMED WATER MASTER PLAN.
MY, I MY WISH WAS TO HAVE SOMETHING BACK BEFORE WE FINISHING, BEFORE WE FINISHED BUDGET IN ORDER TO SEE IF WE HAD ANY RECOMMENDATIONS TO IMPLEMENT OR START WORKING ON WHAT CAN WE DO TO START USING OUR RECLAIM WATER MASTER PLAN.
HE MENTIONED THAT WE MAY GET A FEE, UM, WE MAY GET SOMETHING BACK BY THE NEXT MEETING.
WE'RE EXPECTING TO HAVE IT BACK ON THE 19TH.
DO YOU KNOW IF BY THE 19TH WE WILL HAVE A RECOMMENDATION ON HOW TO START IMPLEMENTING THE PLAN? I AM NOT SURE.
LEON, BARBARA, CITY ENGINEER COUNCIL MEMBER.
WE, UH, WE'VE BEEN WATCHING AND REVIEWING THAT MASTER PLAN FOR THE LAST MONTH OR TWO AND, UH, THERE'S SOME MAJOR RECOMMENDATIONS ON THE COST FOR IMPLEMENTING A, A RECLAIMED MASTER, A WATER PLAN.
BUT JUST TO LET YOU KNOW, WE ARE WORKING ON IT RIGHT NOW FOR, FOR EXAMPLE, SOME OF THE LINES THAT WE'RE TRYING TO UPGRADE.
WE'RE ADDING RECLAIMED WATER LINES TO THOSE.
WE STILL HAVEN'T GOTTEN TO THE PLANT YET WITH OUR RECLAIMED WATER LINES.
UH, LAST REPORT, I GOT THAT WHEN I LOOKED AT THE MASTER PLAN.
WE NEED AN 18 INCH LINE FROM THE PLANT OUT TO SERVE, START SERVING THAT, UH, USING THAT RECLAIMED WATER.
AND WE HAVEN'T EVEN GOTTEN TO THE PLANT YET.
WE HAVE A COUPLE OF DESIGN PROJECTS UNDERWAY.
WE JUST BARELY STARTED ON 'EM.
AND AS WE REPLACED THAT IN UPSIDE, THAT EXISTING WASTEWATER LINE, WE'RE GOING TO ADD RECLAIM LINES TO THAT.
SO WE ARE WORKING ON IT, IT'S JUST THAT IT'S GONNA TAKE SOME TIME TO GET TO THE PLANT, THEN WE HAVE TO BUILD A PUMP STATION AND, UH, IT'S GONNA TAKE QUITE A BIT OF TIME AND SOME MONEY TO DO THAT.
BUT, UH, WE WILL PLAN TO BRING YOU A REPORT, UH, NEXT COUNCIL MEETING AND GIVE YOU A STATUS WHERE WE ARE WITH A PLAN.
[02:10:01]
SURPRISED AT SOME OF THE NUMBERS THERE SIGNIFICANTLY HIGH.LOOK, IF IT'S ABOUT RECLAIM WATER AND WE CAN USE IT TO FILL OUR PONDS AT PARKS, I THINK IT WILL BE WORTH, WELL WORTH IT.
I DON'T KNOW IF, I THINK IDEALLY IF WE ARE TALKING ABOUT, YOU KNOW, REDOING SOME OF OUR STREETS, IT WILL BE NICE WHEN, IF WE HAVE TO INCREASE INCHES FOR PIPELINE TO KIND OF TIE TOGETHER.
SO I KNOW BRIAN PUT SOMEBODY ON, UM, THE BUDGET TO OVERSEE MAYBE ENGINEERING PUBLIC WORK.
SO IT WILL BE GOOD TO HAVE THAT RECOMMENDATION.
I WOULD LOVE TO START, YOU KNOW, IMPLEMENTING SOME OF THESE THINGS.
AND IF IT COSTS MONEY, YOU KNOW, I'M PRETTY SURE IT WILL BE WELL WORTH IT IN FEW YEARS.
SO, SO DO WE WAIT FOR THIS NEXT, NEXT MEETING? COUNCIL MEMBER? WE HAVE THE REPORT.
WHAT WE HAVE BEEN WANTING TO DO IS THERE'S AN AMENDMENT THAT'S GONNA BE COMING FROM THE CONSULTANT FOR THE ADDITIONAL WORK THAT WE ASKED THEM TO DO.
SO WE WERE TRYING TO WRAP THAT UP AT THE SAME TIME.
SO HOPEFULLY WE'LL HAVE THAT WRAPPED UP ALSO.
BUT AGAIN, THAT'S, THERE'S COST THERE TOO.
ANYONE ELSE? ALRIGHT, THANK YOU.
[35. Consider and Possible Action to direct City Manager and staff to revise nuisance ordinance regarding sale of used vehicles and abandoned items within City limits. ~ Miguel A. Zuniga PhD, Council Member]
I'M 35, CONSIDERING POSSIBLE ACTION TO DIRECT CITY MANAGER AND STAFF TO REVISE NUISANCE ORDINANCES REGARDING SALE USED VEHICLES AND ABANDON ITEMS WITHIN THIS, UH, CITY LIMITS CUSTOMER ZUNIGA.I MIGHT HAVE TO POSTPONE THIS ONE, BUT, UM, JUST TO GIVE COUNCIL MEMBERS THE GIST OF THIS, UH, WE HAVE AN ORDINANCE, UH, SECTION 47 31, AND WE HAVE ENFORCEMENT IN THAT ORDINANCE SECTION 47 2 1 1.
AND, UH, BACK IN JULY THERE WAS A, A USED VEHICLE THAT WAS PUT ON THE INTERSECTION OF POST ROAD AND ONE 50.
AND IT WAS BY THE SAME, UM, CELLAR.
AND THREE WEEKS LATER THEY PUT ANOTHER USED VEHICLE THERE.
SO, UH, RESIDENTS REACHED OUT AND SAID, CAN THAT GET REMOVED? AND SO I DID CALL CODE ENFORCEMENT ABOUT HAVING IT REMOVED.
UH, THEY WENT OUT, I THINK THEY LEFT A TICKET AND THEY TRIED TO REACH THE OWNER TO MOVE IT.
BUT LEGALLY, UM, THE ORDINANCE THAT WE HAVE, UM, ALLOWS 10 DAYS FOR A VEHICLE THAT IS USED OR ANYTHING THAT'S A NUISANCE, UH, TO BE TOWED AWAY.
SO WHAT I WOULD LIKE TO SEE WOULD BE A SHORTER TIME, UM, FRAME BECAUSE IN THE CASE OF USED VEHICLES, THERE TYPICALLY IS NOT AN OWNER.
SO IF WE FOLLOW THE ORDINANCE TO HAVE A 10 DAY CERTIFIED BY MAIL, UH, LETTER TO THE OWNER OF THAT VEHICLE, WHICH IN THIS CASE I DON'T THINK THIS METHOD WOULD WORK, IT WOULDN'T ACCOMPLISH WHAT YOU'RE TRYING TO ACCOMPLISH.
UH, BECAUSE THERE WOULD BE NO OWNER.
AND 10 DAYS CERTIFIED MAIL JUST SEEMS LIKE A VERY CONVOLUTED WAY, UH, TO REACH SOMEONE.
UM, NOT OPPOSED TO SOMEONE'S TRYING TO SELL SOMETHING, THERE'S LOTS OF WAYS TO DO IT, BUT LEAVING IT ON THE SIDE OF THE ROAD WHERE IT CAN CREATE A OBSTRUCTION OR IT CREATES A NUISANCE, UM, IT DOESN'T BEAUTIFY OUR CITY.
SO I THINK THAT WE REALLY, WE SHOULD LOOK AT THIS ORDINANCE, UM, AND SEE HOW WAS THOSE 10 DAYS SELECTED AND CAN WE NARROW THAT DOWN AND HAVE SOME BREVITY IN THE ORDINANCE SO THAT SITUATIONS LIKE THIS CAN BE DEALT WITH A BIT FASTER.
AND I, I CAN ALSO GO THROUGH ANOTHER EXAMPLE OF MATTRESSES THAT WERE LEFT ON PRIVATE PROPERTY.
AND IN ORDER TO HAVE THOSE MATTRESSES REMOVED, UH, BY OUR ORDINANCE, WE WOULD HAVE TO FIRST FIND THE LANDOWNER, SEND THEM A LETTER BEFORE WE PICK UP THOSE MATTRESSES.
I, I JUST THINK THAT, THAT, THAT'S, THAT'S A SLOW WAY OF, OF SOLVING THE PROBLEM.
UM, IN TERMS OF VIOLATIONS, THOSE ARE JUST MY THOUGHTS.
SO IF WHATEVER WE CAN DO TO BEAUTIFY THE CITY AND HOPEFULLY AL ALSO ADD A FINE TO PEOPLE THAT WASTE ON RESOURCES.
UH, IN THIS CASE IT WAS THE, THE SAME PERSON SELLING TWO USED VEHICLES WITHIN A THREE WEEK PERIOD, WHICH CAUSED TWO FOLLOW-UPS AND THE CHIEF CODE ENFORCEMENT ALL TO WASTE THEIR TIME TO TRY TO FIND THAT PERSON, MAKE PHONE CALLS, GO OUT AND VISIT.
UM, I THINK E EVENTUALLY THE, THE CAR
[02:15:01]
SELLER JUST MOVED THE VEHICLE ON HIS OWN.SO, BUT IT WAS OBVIOUSLY A WASTE OF RESOURCES.
MAYOR COUNSEL PAGE SIGNS FOR THE RECORD, I CAN GIVE YOU A LITTLE BIT OF INFORMATION ABOUT, SO YOU HAVE YOUR ORDINANCE THAT GIVES YOU TOOLS FOR ADDRESSING THE SITUATION YOU DESCRIBED.
THERE'S ALSO SOME TOOLS IN STATE LAW THAT GIVE YOU A FASTER METHOD OF MM-HMM.
IF IT'S A, IF IT'S BLOCKING A ROAD OR IF IT'S PUBLIC SAFETY HAZARD, THAT CAN BE REMOVED RIGHT AWAY.
UM, IF IT'S AN ABANDONED VEHICLE, SO AN ABANDONED VEHICLE IS ONE THAT'S BEEN PARKED IN A PUBLIC PLACE ILLEGALLY FOR 48 HOURS, THEN THAT CAN BE REMOVED AND THERE'S A PROCESS FOR, FOR DOING THAT.
BUT IT CAN BE REMOVED AFTER 48 HOURS.
AND THEN THERE'S A PROCESS THAT THE LAW ENFORCEMENT HAS TO GO THROUGH TO NOTIFY THE PROPERTY OWNER.
SO THEY HAVE AN OPPORTUNITY TO GET IT RETURNED.
AND IF IT'S A JUNK VEHICLE THAT'S INOPERABLE, THEN THAT'S A 72 HOUR PERIOD FOR REMOVAL.
SO STATE LAW GIVES SOME SHORTER TIMEFRAMES THAT YOU, YOU JUST, THEY'RE NOT, THEY'RE NOT DRAFTED IN THE ORDINANCE.
'CAUSE CODE EN ENFORCE, UH, CODE ENFORCEMENT AND LAW ENFORCEMENT CAN GO LOOK IN STATE LAW TO FIND THOSE SHORTER TIMEFRAMES.
UM, UH, VISITED WITH THE CHIEF BRIEFLY TODAY ABOUT, ABOUT THE, HE'S AWARE OF, OF ALL OF THESE, UM, TOOLS THAT ARE AVAILABLE, THE ONE THAT'S IMMEDIATE REMOVALS AVAILABLE FOR SOMETHING THAT'S A PUBLIC SAFETY HAZARD.
UM, IT LOOKS LIKE THE SHORTEST TIMEFRAME AFTER THAT IS A 48 HOUR PERIOD IF IT MEETS THE DEFINITION OF ABANDONED VEHICLE.
AND AFTER THAT, IT'S A 72 HOUR PERIOD.
IF IT'S A JUNK VEHICLE, IF THERE'S ANOTHER TOOL, IF YOU WANT US TO LOOK AT WHETHER THERE'S A SHORTER TIMEFRAME THAT MAY BE AVAILABLE, THEN WHAT'S IN STATE LAW, WE CAN DO SO VISIT WITH THE POLICE DEPARTMENT ABOUT WHAT TOOLS WORK BEST FOR THEM.
SO THE USED VEHICLE DOESN'T FIT INTO ANY OF THOSE CATEGORIES.
IT'S STILL PROPERTY THAT SOMEONE OWNS AND IT'S NOT, UM, IT'S NOT BROKEN.
SO WELL AN ABANDONED VEHICLE THAT IS PARKED ILLEGALLY, A A VEHICLE THAT'S PARKED IN A PUBLIC PLACE ILLEGALLY FOR 48 HOURS IS A, IS AN ABANDONED VEHICLE.
IT DOESN'T HAVE TO BE AN OPERABLE.
AND WHENEVER I TALK ABOUT ENFORCING CRIMINAL STATUTES OR OTHER STATUTES, I LIKE TO COORDINATE WITH THE LAW ENFORCEMENT POLICE DEPARTMENT JUST TO MAKE SURE WE'RE ALL UNDERSTANDING IT THE SAME WAY SO THAT WE ACHIEVE YOUR GOAL OF MAKING SURE THE CITY'S BEAUTIFIED IN PUBLIC PLACES ARE USED APPROPRIATELY.
SO, UM, BUT WHAT I HAVE SEEN IS THAT IT'S 48 HOURS IS PROBABLY THE SHORTEST TIMEFRAME FOR REMOVAL UNLESS IT'S A SAFETY HAZARD.
AND IF COUNSEL WANTS US TO DETERMINE IF THERE'S A SHORTER TIMEFRAME, WE, WE CAN DO SO VISIT WITH THE POLICE DEPARTMENT TO DO SO.
MY, THE, THE THING WAS HERE THAT THE VEHICLE WAS LEFT AT LEAST TWO DAYS.
'CAUSE UH, I WAS, I WATCHED IT AT SIX IN THE AFTERNOON AND TWO DAYS LATER IT WAS STILL THERE.
UH, AT THAT POINT IT COULD HAVE BEEN TOWED.
HAD WE, YEAH, IT, IT JUST, UH, AGAIN, I I THAT IT'S, I GUESS THAT IS CORRECT UNDER THE ABANDONMENT STATUTE.
SO, SO HOW DO WE DO BETTER? I MEAN, HOW DO WE DO BETTER TO SERVE THE COMMUNITY AND, AND MOVE THESE THINGS THAT ARE NUISANCE NUISANCES, I GUESS THAT 'CAUSE OUR ORDINANCES HAS A LOT OF LEEWAY FOR, FOR A CERTIFIED LETTER.
'CAUSE A LOT OF THINGS HAVE TO GO RIGHT IN ORDER FOR SOMEONE TO RECEIVE A CERTIFIED LETTER, THE JUDGE HAS TO SIGN IT, THE PERSON HAS TO RECEIVE IT, THE ADDRESS HAS TO BE RIGHT.
THE POST HAS, SOMEONE HAS TO SIGN IT, THEY RECEIVED IT.
AND I JUST THINK THAT THAT'S, THAT, UH, CREATES A LOT OF FACTORS.
WELL, STATE LAW GIVES TOOLS THAT YOU DON'T HAVE TO GIVE THE CERTIFIED LETTER BEFORE YOU GO MM-HMM.
YOU, YOU PROVIDE THE CERTIFIED LETTER AFTER IT'S REMOVED.
SO, SO HOW DO WE BUMP UP THAT OTHER OPTION THAT 48 HOURS IS STATE LAW ALLOWABLE? IT'S IN STATE LAW.
IT'S A TOOL THAT THE POLICE DEPARTMENT CAN USE IF THE, ALL THE CRITERIA ARE MET AND WHAT, WHAT IS, WHAT I'M NOT SURE ABOUT IS THEY HAVE TO MAKE SURE ALL THE ELEMENTS ARE MET, BUT BEFORE THEY CAN ENFORCE THE LAW.
SO, UM, I MEAN, IF, IF IT WAS REMOVED WITHIN 48 HOURS, WHETHER IT WAS COMPLIANT, THE PERSON VOLUNTARILY COMPLIED OR THE POLICE DEPARTMENT HAD TO TOW, THAT'S PROBABLY ABOUT THE SHORTEST TIMEFRAME.
[02:20:01]
YEAH.AND THEN I GUESS THE OTHER, THE, THE OTHER CONCERN THERE WAS THE PERSON DIDN'T LEARN THEIR LESSON AND PUT ANOTHER USED VEHICLE THERE TWO WEEKS LATER.
UM, SO HOW DO WE, HOW DO WE, HOW DO WE LESSEN THAT OPPORTUNITY FROM THE FIRST INSTANCE? UM, YEAH, I CAN'T, I CAN'T SPEAK TO THAT SIDE OF IT, BUT, WELL, WE CAN TAKE A LOOK AT OPTIONS FOR YOU AND IF THAT'S THE REQUEST THAT WE BRING YOU BACK OPTIONS AND, AND WE, SO WE CAN CERTAINLY, WE CAN CERTAINLY TRY TO TAKE A LOOK AT SOME OPTIONS AND BRING THEM BACK TO YOU.
I, I DON'T HAVE AN ANSWER FOR YOU TODAY UNFORTUNATELY, BUT WE CAN LOOK AT IT AND TRY TO BRING SOMETHING BACK.
I'D LIKE TO GET MORE, MORE BACKGROUND ON WHAT THE CITY BOARD RESEARCH ON THIS ORDINANCE MAYOR PRO.
ALRIGHT, SO LET ME, LET ME INTERVENE.
UH, COUNCILMAN, UM, YOU, LET'S START OFF WITH THIS LAST QUESTION.
SO WHAT HAPPENS IF THIS PERSON DOESN'T LEARN THEIR LESSON? IS THAT WHAT WE'RE SAYING? I MEAN, DO WE, IT'S LIKE I'VE ALWAYS SAID ABOUT A LOT OF OTHER THINGS.
EDUCATION, RIGHT? DO WE NEED A WORKSHOP? IT'S EDUCATING, IT'S EDUCATING THE RESIDENT ABOUT WATER USAGE.
IT'S EDUCATING PET OWNERS TO BE A GOOD PET OWNER AND NOT LEAVE YOUR DOG OUTSIDE IT.
IT'S ALL EDUCATING, MAKING SURE THAT WE LET PEOPLE KNOW THAT IF YOU'RE ON THE SIDE OF THE ROAD AND YOU'RE SOLICITING MONEY, THAT'S AN ORDINANCE THAT WE HAVE IN PLACE.
WHAT I'M HEARING YOU SAY IS, OKAY, THIS IS AN EYESORE FOR MY RESIDENTS OR MYSELF.
WHEN I SEE A CAR FOR SALE OR A TRUCK FOR SALE, WHAT CAN WE DO TO GET RID OF THAT EYESORE? IS THAT WHAT WE'RE GETTING AT? 'CAUSE IT'S A, IT'S A NUISANCE AND SO FORTH.
YOU CAN GO ABOUT THE PROCEDURE THAT WE HAVE BY NOTIFYING THEM AND IF IT'S A 48 HOUR OR A 10 DAY GRACE PERIOD OR WHATEVER IT IS, IT'S NOTIFIED ON THERE.
SO THEN WE GET INTO THE LEGAL ASPECTS AND THE FINANCIAL ASPECTS OF THIS REAL QUICKLY.
WHO ARE WE GOING TO GET TO TOW THIS? WHERE'S IT GONNA GO? HOW MUCH IT'S GONNA COST THE CITY? AND IF WE DAMAGE THIS VEHICLE, EVEN THOUGH IT'S INOPERABLE OR IT WORKS, WE DAMAGE THIS PRODUCT, WE DAMAGE THIS VEHICLE.
WHO'S GONNA BE SOLELY RESPONSIBLE FOR, 'CAUSE YOU COULD HAVE PEOPLE OUT THERE THAT SAYS, YOU KNOW WHAT, I'M GONNA PARK MY USED CAR OUT THERE AND THE CITY'S GONNA TOW IT, AND THEN I'M GONNA ASSUME BECAUSE THEY DAMAGED SOMETHING.
WE HAVE TO LOOK AT THE ALL ASPECTS OF IT ALL.
SO I GUESS LOOKING AT THE ORDINANCE ITSELF, AND, AND I THINK WHAT YOU'RE ASKING FOR IS TO SEE WHERE WE AT, TO WHERE, WHEN IT COMES TO USED VEHICLES, WHERE WE AT, TO WHERE THEY CAN OR CANNOT PLACE IT.
AND IF THERE'S A CERTAIN TIME LIMIT, WE CAN LOOK TO SEE WHERE WE'RE AT ON THE CITY ON THAT END.
IT, IT COULD BE ANY ITEM, IT COULD BE A DISHWASHER.
SOMEBODY WILL PUT IT OUT THERE AND PUT A FOR SALE SIGN ON IT.
SO WHAT I'M SAYING IS Y'ALL LIKE TO TAKE PRO ACTION.
SO I I'M, I'M BRINGING SOMETHING THAT'S, THAT, THAT HAS BEEN RIGHT.
I ASK THE OFFICER TO COME SPEAK.
COUNCIL MEMBER HEISER HAS A FLOOR.
BRIAN, DO YOU NEED A MOTION TO, TO RESEARCH INTO THIS? 'CAUSE THIS IS, I DON'T THINK THIS IS A GOOD USE OF ANYONE'S TIME TO DELIBERATE THINGS THAT WE HAVE NO IDEA ABOUT.
LET'S LET LEGAL EXPERTS GIVE MIGUEL AND US SOME OPTIONS TO CONSIDER POTENTIALLY AT THE NEXT MEETING OR TWO MEETINGS FROM NOW.
I THINK YOU NEED TO
SO WOULD SOMEONE LIKE TO TRY TO MAKE A DIRECT STAFF TO, UH, GIVE US SOME LEGAL OPINION? I THINK THIS WAS, THIS WAS A DISCUSSION BEAR.
I ENJOYED HAVING THIS DISCUSSION UP HERE.
I WANNA HEAR A LITTLE MORE FROM EVERY COUNCIL MEMBER AND, AND FROM THE OFFICER THERE.
DON'T ANYONE, I'M NOT IN A RUSH RIGHT NOW.
MIGUEL, I DON'T THINK ANYONE DISAGREES WITH YOUR DESIRE TO MAKE A CHANGE.
I KNOW, BUT I WANT TO HEAR THE OFFICER'S PERSPECTIVE.
ALRIGHT, COUNCIL MAYOR PARSLEY, I WOULD LIKE TO MAKE A MOTION TO DIRECT STAFF TO LOOK INTO THE NUISANCE ORDINANCE AND PROVIDE FEEDBACK OR RECOMMENDATIONS TO ADDRESS THE ISSUES BROUGHT UP BY COUNCIL MEMBER SUNGA.
MOTION BY COUNCIL MEMBER PARLEY, SECONDED BY MAYOR PRO.
TIM, NO, THAT, UH, WE LOOK INTO THE NUISANCE ORDINANCE AS DISCUSSED AND BRING BACK SOME POTENTIAL RECOMMENDATIONS FOR HOW STRENGTHEN IT.
IS THERE DISCUSSION ON THE MOTION COUNCILOR FLOORS COUNT.
ALSO, CAN WE LOOK INTO WHAT IS REQUIRED TO SELL CARS? UM, I,
[02:25:01]
I KNOW THE SAFE TEXAS PROBABLY HAS SOMETHING SAYING THAT IF YOU'RE GONNA BE SELLING X AMOUNT OF USED CARS, THAT JUST AS A WAY TO BE PRECAUTIOUS AND, AND YOU ADD ADDITIONAL INFORMATION AS IF YOU DIDN'T HAVE ENOUGH ON YOUR PLATE ALREADY.BUT INFORMATION LIKE THAT WOULD SEEM NON-BIASED.
AND, AND, AND A LITTLE MORE STRAIGHT.
CAN I ASK YOU, SO THERE'S A LICENSE PLATE ON THE VEHICLES, SO YOU'RE ABLE TO GET MORE INFORMATION THAN A NORMAL PUBLIC CITIZEN COULD GET.
UM, WOULDN'T YOU BE ABLE TO FIND THE OWNER THROUGH LICENSE PLATE AND PHONE NUMBER OFFICER? AND, AND I DON'T HAVE YOUR NAMES.
I I'LL ADDRESS YOU BY YOUR NAME.
UH, JAMES JONES, COMMANDER KYLE POLICE DEPARTMENT FOR THE RECORD? UH, YES, WE DO HAVE ACCESS TO INFORMATION THROUGH A LICENSE PLATE RETURN THAT OFFICERS DO HAVE THE ABILITY TO RESEARCH INFORMATION.
AND IF A VEHICLE'S TOWED BY A TOW TRUCK, UM, HAVE YOU EVER SEEN DAMAGES BY THE TOW TRUCK LIFTING A VEHICLE AND IMPOUNDED IT? I MEAN, THEY'RE PROFESSIONALS.
THEY, THEY WOULD KNOW HOW TO JACK UP A CAR AND MOVE IT.
I'VE SEEN TOW TRUCK DAMAGED VEHICLES.
THEY DAMAGED BY, I GUESS THE POOL, THE, THE, UH, ESPECIALLY SOME LOW PROFILE VEHICLES.
I'VE SEEN 'EM DAMAGE THOSE CARS.
UH, IN WHAT SITUATION WOULD YOU NOT MOVE A VEHICLE THAT'S BEEN LEFT ON THE SIDE OF THE ROAD THAT'S FOR SALE? UM, SO WE DO HAVE THE ABILITY IF A VEHICLE'S LEFT ABANDONED IN A RIGHT OF WAY, UM, WE CAN DO WHAT WE CALL RED TAG.
WELL, WE'LL MARK IT FOR 48 HOURS AND THEN WE CAN COME BACK AND IMPOUND THE VEHICLE THROUGH OUR IMPOUND PROCESS.
UM, FOR AN IMMEDIATE ONE, THAT WOULD BE, IF THE VEHICLE WAS A ROAD HAZARD, IT WAS CAUSING A DANGER TO THE PUBLIC OR ON THE ROADWAY, WE COULD IMMEDIATELY REMOVE THAT.
UM, BUT THOSE WOULD BE THE ONLY TWO OPTIONS.
HOW WOULD YOU BE CERTAIN THE RED TAG STARTS THAT TIME INITIATED? THAT THE RED TAG'S NOT LOST, OR THE OWNER SAYS, I NEVER SAW THE RED TAG THERE.
UH, WHEN THE RED TAG IS PLACED ON THE VEHICLE, IT'S PLACED IN A CONSPICUOUS PLACE AND THEN THE OFFICER APPLYING THE RED TAG WOULD NOTIFY, UH, THE DISPATCHERS THAT THEY HAVE APPLY THE RED TAG AND THAT 48 HOURS WOULD START THEN.
HAVE Y'ALL EVER USED A 10 DAY, UH, CERTIFIED MAIL PROCESS TO REACH SOMEBODY? UH, I CAN'T ANSWER THAT.
THANK YOU FOR THE ANSWER TO MY QUESTIONS.
I'M JUST TRYING TO GET MORE DETAILS.
ANY FURTHER DISCUSSION? ALL IN FAVOR SAY AYE.
ALL OPPOSED? ALRIGHT, MOTION CARRIES SEVEN TO ZERO.
[37. Consider and possible direction regarding widening CR 202 entrance. ~ Travis Mitchell, Mayor]
UP.CONSIDERING POSSIBLE DIRECTION REGARDING WIDENING C O TWO CR 2 0 2 ENTRANCE IS MY ITEM.
I THINK AS COUNCIL'S AWARE, THERE'S BEEN SOME DISCUSSION, UH, BETWEEN COUNCIL MEMBERS AND, UH, WITH SOME OF THE FOLKS WHO LIVE OUT AND ABOUT IN OUR COMMUNITY ABOUT THE POTENTIAL FOR WIDENING THE COUNTY ROAD.
I THINK IT'S PRETTY CLEAR BASED ON THE TRAFFIC PATTERNS THAT, UH, WIDENING WOULD BE BENEFICIAL THERE.
UH, HOWEVER, UH, AS HAS BEEN NOTED, THE UH, PRIMARY, UH, GROUP THAT IS ASKING FOR THAT WIDENING AND WHO WOULD BENEFIT FROM THAT WIDENING, UM, SUCCESSFULLY PROTESTED THEIR ANNEXATION IN 2019.
SO I'VE HAD A CONVERSATION WITH THEM ABOUT IF THE CITY'S GOING TO INVEST RESOURCES TO INCREASE THE WIDTH OF THEIR, UH, ENTRANCE, UH, WOULD THEY CONSIDER TRADING, UH, ANNEXATION FOR THAT? THEY WANTED TO KICK THAT AROUND.
UH, I MENTIONED THAT TO 'EM LAST WEEK AND SAID, I WOULD PUT THIS ITEM ON AT THEIR REQUEST.
UH, THEY STILL HAVE NOT ARRIVED AT A CONCLUSION.
SO I WANT TO PERSONALLY, THAT WAS A, THAT WAS GONNA BE A, A FACTOR FOR ME.
SO I THINK, I THINK A HUNDRED PERCENT IF THEY WANTED TO BE ANNEXED, THEN WE SHOULD HAVE THE DISCUSSION AS WE WOULD WITH ANY, UH, RESIDENT, ESPECIALLY DOWN ONE 50.
THOSE THAT INTERSECTION IMPROVEMENTS MATTER.
BUT IF THEY DECIDE THAT THEY DON'T WANT TO BE ANNEXED, UH, THEN I DON'T, I DON'T THINK THAT IT'S OUR OBLIGATION.
SO, DOES ANYBODY HAVE ANY PROBLEMS WITH ME TABLING THIS? ALRIGHT, I'M, I'M GONNA TABLE AND IF SOMETHING CHANGES, I MIGHT BRING IT BACK.
[38. (First Reading) An Ordinance of the City of Kyle amending Chapter 2 - Administration, Article III. - Boards, Committees and Commissions, Division 5. - Arts and Cultural Commission Section 2-114 Renaming to Arts and Cultural Board; Section 2-116 Removing One ex officio member; and Section 2-122 regarding staff liaison. ~ Amber Schmeits, Assistant City Manager]
[39. Consider and possible action to adopt the Arts & Cultural Commission's FY 2023-2024 proposed budget. ~ Travis Mitchell, Mayor and Bear Heiser, Council Member]
NEXT UP.I'M GONNA READ 'EM BOTH TOGETHER, BUT WE CAN DO, DO WHATEVER WE WANT WITH THE VOTES.
ORDINANCE OF THE CITY OF KYLE TEXAS MEETING, CHAPTER TWO, ADMINISTRATION, ARTICLE THREE BOARDS, UH, COMMITTEES OF COMMISSIONS, DIVISION FIVE, ARTS AND CULTURAL COMMISSION, SECTION TWO DASH 114 RENAMING, UH, TO THE ARTS AND CULTURAL BOARD SECTION, UH, TWO DASH 116, REMOVING ONE EX OFFICIO MEMBERS SECTION TWO DASH 1 22 REGARDING STAFF LIAISON.
THIS IS, UH, THE ITEM THAT WE POSTPONE BECAUSE WE, I THINK WE HAD DECIDED THAT WE AGREED THAT WE DIDN'T WANNA NECESSARILY REMOVE THE CULTURAL TERM OR CULTURAL ASPECTS THAT MAYBE THAT WASN'T RIGHT.
BUT WHAT WE FORGOT TO DO WAS FIX THE OTHER TWO ISSUES THAT I THINK COUNCIL DID AGREE ON, WHICH WAS THE EX OFFICIO MEMBER, UH, AND THE, UH, CHANGING OF THE STAFF LIAISON FROM THE, UH, LIBRARY BOARD DIRECTOR TO THE CITY MANAGER DESIGNEE.
SO I WANTED TO BRING THIS BACK, UH, AND HAVE US, UH, TAKE THOSE TWO ITEMS,
[02:30:01]
UH, UP.DOES ANYBODY HAVE ANY OBJECTIONS TO THOSE TWO CHANGES, WHICH I FELT LIKE WE ALL AGREED ON? ALL RIGHT, SO IF, IF, IF, IF WE MOTION AND VOTE ON THIS JUST AS A MOTION AND VOTE, THAT WILL BE THE EFFECT.
MAKE A, LIKE TO MAKE A MOTION, MAYOR TO APPROVE AGENDA.
WELL, THAT MY, MY QUESTION IS IF WE MAKE THE MOTION, DO WE NEED TO MAKE IT MORE SPECIFICALLY THAN A MOTION TO APPROVE? 'CAUSE WE THOUGHT, I THINK EVERYBODY THOUGHT WE'D ALREADY MADE THIS CHANGE ONCE, SO I DON'T WANNA FIND US IN THIS SAME POSITION.
UH, IF YOU WANT TO APPROVE THE AGENDA ITEM AS LISTED, JUST A POINT OF CLARIFICATION.
THIS, UM, ORDINANCE DOES ALSO CHANGE THE NAME FROM COMMISSION TO BOARD.
THAT'S THE NAME JUST FITS WITHIN.
BUT A MOTION TO OUR DEFINITIONS, BUT A MOTION TO APPROVE IS ALL, ALL THAT IS NEEDED.
CORRECT? WE DON'T HAVE TO CHANGE THE ALL RIGHT, GO AHEAD, MAYOR PRO TEM.
ALRIGHT, MAYOR, I'D LIKE TO GO AHEAD AND MAKE A MOTION TO APPROVE AGENDA ITEM NUMBER 38.
SECOND BY THE MAYOR THAT WE APPROVE.
IS THERE DISCUSSION ON THAT MOTION? ALL THOSE IN FAVOR SAY AYE.
ALL OPPOSED? ALRIGHT, MOTION CARRIES.
ALRIGHT, NEXT UP IS AGENDA ITEM 39, CONSIDERING A POSSIBLE ACTION, UH, TO ADOPT THE ARTS AND CULTURAL COMMISSION'S FISCAL YEAR 20 23, 20 24.
THIS IS THE, THE REQUEST THAT WAS MADE AS Y'ALL KNOW, THAT, THAT THE, UH, THE UH, BUDGET THAT WE JUST PASSED INCLUDED $65,000.
UH, WE PASSED ON FIRST READING THAT IS, IT INCLUDED $65,000 FOR THE ARTS AND CULTURAL BOARD.
UH, AND, UH, THEY, BUT WE DID NOT GIVE THEM ANY DIRECTION ON HOW TO SET FORWARD THEIR BUDGET.
IT'S THE ONLY BOARD THAT HAS A BUDGET PROPOSED.
UH, WE APPROVED THEIR BUDGET LAST YEAR.
THIS IS VERY SIMILAR, ALTHOUGH IT DOES INCREASE THE ART AROUND THE CITY AMOUNT, UH, TO 40,000.
SO IT'S A HIGH PREMIUM, THE BUDGET IN TERMS OF THE DOLLARS ON ART, YOU'LL SEE THE FIRST, UH, SEVERAL, UH, ARE, UH, COMPLETELY ART FOCUSED, UH, 8,500 FOR END OF ART, UH, SUMMER ART FESTIVAL, 40,000 FOR ART AROUND THE CITY TO ART EXHIBITS.
UH, YOU KNOW, SO APPROXIMATELY 85% OF THE DOLLARS ARE DEDICATED TOWARDS ART.
THERE ARE SOME DOLLARS IN THERE THAT ARE ANCILLARY, UH, TOWARDS SOME OF THE CULTURAL EVENTS WHERE THERE'VE BEEN SOME DISCUSSIONS.
BUT I THINK THOSE NUMBERS ARE PRETTY SMALL.
AND SO MY OPINION IS THAT WE NEED TO GIVE THE ARTS AND CULTURAL BOARD SOME DIRECTION, AND I WOULD LIKE TO APPROVE THEIR BUDGET AND PUT THOSE DOLLARS WITH THEM, ALLOW FOR THEM TO MEET, TO FILL UP THEIR BOARD AND TO START FIGURING OUT WHAT CHANGES THEY WANNA MAKE INCLUDE, YOU KNOW, THEY DOESN'T MEAN IT'S THE ONLY THING.
THEY CAN ALWAYS COME BACK AND REQUEST ADDITIONAL FUNDS OR GIVE US DIFFERENT, DIFFERENT KINDS OF FEEDBACK, BUT AT LEAST THIS, UH, SETS THE TONE AND GETS IT OFF OUR DESK AND ALLOWS FOR IT TO BE, UH, ON THE DESK OF THE, THE BOARD THAT WE HAVE APPOINTED.
SO IS THERE A DISCUSSION ON THAT CUSTOMER FORCE COUNT? YEAH.
UM, WE RECEIVED THESE NUMBERS AND THIS INFORMATION, UH, TWO HOURS AGO BABY AND I HAVE NOT HAD ENOUGH TIME TO LOOK THROUGH IT.
AND SO I, I WON'T BE VOTING YES FOR THAT UNTIL I GET MORE TIME TO BE ABLE TO, TO LOOK THROUGH IT.
IS THERE FURTHER DISCUSSION? COUNCIL MAYOR RECHO, I WILL SAY THAT, I KNOW WE'VE HAD THIS CONVERSATION, BUT THE INTENTION FOR THE ARTS COMMISSION WAS TO BUY AND IMPLEMENT ART.
AND I WOULD REALLY, I'M HAPPY TO APPROVE THE BUDGET, BUT I WOULD REALLY LOVE TO SEE THE FOCUS OF THAT BE ON THAT.
I THINK THE, I THINK THIS BUDGET REFLECTS THAT IT'S $40,000 FOR ART IN, IN THIS YEAR.
SO THEIR THEIR INTENTION IS TO BRING BACK YEAH.
BUT THERE IS ALSO SIX OTHER LINE ITEMS. RIGHT, BUT IT'S, THEIR, THEIR, THEIR SCOPE AS APPROVED BY US IS WIDER THAN JUST TO PURCHASE ART.
THIS, THIS BUDGET IS AGAIN, YOU KNOW, THE MAJORITY OF IT IS ART, UH, FOCUSED AND ABOUT PROCURING ART.
I I FORGOT YOU'RE ON THIS ITEM AS WELL.
DO YOU HAVE THOUGHTS? IS THERE A MOTION ON THE TABLE? NOPE.
I'D LIKE TO MAKE A MOTION TO APPROVE ITEM 39.
UH, CONSIDER IMPOSSIBLE ACTION TO ADOPT THE ARSON CULTURAL BUDGET FOR 2023.
IS THERE A DISCUSSION ON THE MOTION? ALLS FAVOR SAY AYE.
ALRIGHT, MOTION CARRIES FIVE TO ONE.
DO WE HAVE ANYTHING ELSE FOR EXEC? NO SIR.
