SO, FIRST OF ALL, WE WERE OFFICIALLY INCORPORATED ON MAY 19TH, 1938.
AND ON SEPTEMBER 27TH, 1938 IS WHEN WE RECEIVED A $1.3 MILLION LOAN FROM THE REA, WHICH IS THE RURAL ELECTRIFICATION ADMINISTRATION.
TO BUILD OUR FIRST 1800 MILES OF LINE.
WE CONNECTED OUR FIRST 422 METERS AT OUR BERTRAM SUBSTATION ON OCTOBER 27TH, 1939.
PC WAS CREATED BY HILL COUNTRY.
TEXANS LED BY THEN CONGRESSMAN LYNDON B JOHNSON TO PROVIDE SAFE, RELIABLE, AND LOW COST POWER TO OUR COMMUNITIES.

AND OF COURSE, ONE IS THE CITY OF KYLE WHERE WE SERVE 21,924 METERS.
SO, UM, I ALSO WANNA SHARE THAT, UM, FOR OUR 85TH ANNIVERSARY, WE'VE HOSTED VARIOUS EVENTS AND ACTIVITIES TO CELEBRATE OUR EIGHTY FIVE EIGHTY FIFTH, UM, ANNIVERSARY, INCLUDING BIRTHDAY PARTIES WITH SENIORS WHO WERE ALSO TURNING 85.
ONE OF OUR VERY SUCCESSFUL EVENTS WAS HERE AT YOUR, HERE IN KYLE WITH THE KYLE AREA SENIOR ZONE, UM, GROUP.
AND, UM, IT WAS, IT WAS NICE CELEBRATING WITH THEM.
BUT I JUST ALSO WANNA SHARE THAT OUR RICH HISTORY INCLUDES BEING ROOTED IN SEVEN

COOPERATIVE PRINCIPLES.ONE OF THOSE CORE PRINCIPLES IS THE CONCERN FOR COMMUNITY, WHICH GUIDES OUR MISSION TO HELP MAKE A DIFFERENCE IN THE COMMUNITIES WE SERVE.
IN 2006, WE LAUNCHED OUR POWER OF CHANGE PROGRAM, WHICH TO DATE HAS PROVIDED MORE THAN $575,000 IN COMMUNITY GRANTS AND SUPPORTS OUR NON-PROFITS ACROSS THE TEXAS HILL COUNTRY.
OUR COMMUNITY GRANTS APPLICATIONS ARE AVAILABLE ONLINE AND ON OUR WEBSITE.

AND WHEREAS IN 2022 HAYES COUNTY FOOD BANK PROVIDED MORE THAN 1500 MEAL BOXES FILLED WITH A TURKEY AND TRADITIONAL HOLIDAY FOODS THAT HOUSEHOLDS IN NEED COULD PREPARE, UH, IN THE COMFORT OF THEIR OWN HOME.
AND WHEREAS THE HAYES COUNTY FOOD BANK HAS OFFICIALLY LAUNCHED ITS 17TH ANNUAL TURKEYS TACKLING HUNGER CAMPAIGN IN AN EFFORT TO RAISE FUNDS FOR THIS SPECIAL HOLIDAY MEAL PROGRAM.

SO DIABETES AWARENESS MONTH IS A TIME TO CELEBRATE PROGRESS, TO RE AND RESEARCH, SHARE INFORMATION, AND RAISE FUNDS FOR CONTINUED DIABETES RESEARCH AND ADVANCES, AND TO ENCOURAGE PEOPLE TO GET SCREENED TO ASSESS THEIR RISK OF DIABETES.
THE GOALS ARE TO COME TOGETHER TO SHARE, LEARN, CELEBRATE, AND PROMOTE HEALTHY CHANGES.
WHEREAS UNCONTROLLED DIABETES PUTS PEOPLE AT RISK FOR SERIOUS COMPLICATIONS BECAUSE GLUCOSE BUILDS UP IN THE BLOOD INSTEAD OF BEING USED FOR ENERGY.
THESE INCLUDE CARDIOVASCULAR DISEASE, STROKE, BLINDNESS, KIDNEY DISEASE, AND DIALYSIS, AND NERVE DAMAGE AND IMPUTATION.
WHEREAS OVER 37 MILLION AMERICANS

HAVE TYPE ONE OR TYPE OR TWO DIABETES, ANOTHER 97 MILLION HAVE PRE-DIABETES.AND WHEREAS AWARENESS BEGAN IN 1975, IT OFFICIALLY GOT RECOGNIZED IN 1981 BY PRESIDENT REAGAN.
WE OBSERVED THIS MONTH TO CELEBRATE THE LIFE SAVING BREAKTHROUGH OF INSULIN DISCOVERY IN THE 1920S.
AND THEN IN 1968, THE INVENTION OF THE INSULIN PUMP AND ADDITIONAL MEDICAL ADVANCES SUCH AS HUMAN INSULIN ANALOGS, DELIVERY SYSTEMS, CONTINUOUS GLUCOSE MONITORS, WHEREAS PRODUCING INSULIN IS TODAY A REMARKABLE SUCCESS STORY FOR SCIENCE.
STARTING FROM ANIMALS SOURCED INSULIN TO MODERN RECOMBINANT DNA TECHNOLOGY AND GENETIC ENGINEERING TO MAKE SAFER INSULIN.
ONGOING RESEARCH INNOVATIONS INCLUDE ARTIFICIAL PANCREAS SYSTEMS, BETA CELL REGENERATION, INCRETIN BASED THERAPY, AND GENE EDITING.

UM, AND SO NOW AT OUR NEW PUBLIC SAFETY CENTER, UM, HAVING THIS ROOM IS A VERY SPECIAL PLACE.

UM, THERE'S A, A LOT OF MULTIPLE INFRASTRUCTURE PROJECTS THAT WE HAVE IN THE WORKS THAT WE KNOW THAT WE NEED TO IMPROVE UPON.
AND SO CREATION OF A TOURS WILL HELP SET, UM, THE BASE TAX RATE AND THEN THE INCREMENTAL GROWTH FROM THERE TO HELP FUND THOSE PROJECTS AS WELL.
UM, WE HAVE BEEN HAVING EARLY DISCUSSIONS WITH HAYES COUNTY AND THEY ARE INTERESTED IN PURSUING A PARTNERSHIP AT THIS TIME.
AND SO IT'LL BE A, A SPLIT OF, OF A CERTAIN PERCENTAGE WHEN IT ALL COMES DOWN TO IT.
UH, FOR THOSE OF YOU THAT DO NOT KNOW, UM, AURS STANDS FOR A TAX INCREMENT REINVESTMENT ZONE.
AND THEN THE AREA SHOWN ON THE MAP HERE HAS APPROXIMATELY 378 PARCELS WITH 244 ACRES.

UH, SOME POSSIBLE PROJECTS THAT, UH, WE ARE LOOKING AT, UM, DOWNTOWN PARKING, WATER WASTEWATER IMPROVEMENTS FOR DOWNTOWN POSSIBLE FRONT STREET LINEAR PARK PORTIONS OF THE VIBE, TRAIL SIDEWALKS, TRAFFIC INFRASTRUCTURE ALONG THE EAST FM ONE 50 S-CURVE AND POSSIBLY ARCHITECTURAL FACADE IMPROVEMENTS.
AND THAT'S NOT AN EXHAUSTIVE LIST EITHER.

UM, SO WE ARE ASKING FOR Y'ALL TO PROVIDE US A DIRECTION IF Y'ALL WANT TO PURSUE IT.

SO THIS WILL PROVIDE FOR IMPROVED WATER OR WASTEWATER, POSSIBLY, UM, EXTENSION OF VIBE, TRAIL SIDEWALKS AND WHAT HAVE YOU.
AND ALSO, UM, WITH, WHEN WE CONSIDER THE DOWNTOWN MASTER PLAN, WE CAN BRING IT BACK TO Y'ALL, UM, POSSIBLY FUND SOME OF THOSE PROJECTS THAT ARE IDENTIFIED IN THERE AS WELL TO MAKE THE DOWNTOWN AT ITS CORE OF THE 12 BLOCK AREA, TO BE A, A MORE INVITING SPOT IN PLACE FOR PEOPLE TO ENJOY.
SO IT'D BE BASIC, UM, IN THAT SENSE OF EDUCATING THE PEOPLE THAT DON'T KNOW WHATT ARE, WHAT IT WOULD DO IS BY IMPLEMENTING SOMETHING LIKE THIS, ANY OF THE BUSINESSES THAT ARE BROUGHT TO DOWNTOWN, A LOT OF THOSE SALES REVENUES WOULD BE ADDED TO THAT SPECIFIC SQUARE AREA TO HELP WITH INFRASTRUCTURE OR ANY SIDEWALKS OR ANY IMPROVEMENTS OF LIGHTS IN THE FUTURE.
IT WOULD JUST BASICALLY STAY WITHIN THAT REGION.
SO AS PART OF THE FINANCING PLAN, SIR, UM, WE WOULD IDENTIFY PROJECTS THAT WOULD, THAT COULD BE CONSTRUCTED WITHIN THE BOUNDARIES OF THE TURS OR ADJACENT TO IT.
AND, UM, THE INCREMENTAL VALUE ADDED TO THE TAX WOULD GO SPECIFICALLY TO THOSE PROJECTS.
AND PART OF THE FINANCING PLAN, LIKE WE HAVE INT TWO IS ON YEAR TWO WE WILL DO A SPECIFIC PROJECT.
YEAR FIVE, ONCE THERE'S ENOUGH, UH, MONEY ACCRUED IN THERE, WE'LL DO ANOTHER PROJECT AND WHAT HAVE YOU.
SO MY LAST QUESTION WOULD BE REFERENCING THE CBD ONE AND CBD TWO, HOW WOULD THAT BE AFFECTED WITH THIS TURS? LIKE AS FAR AS, YOU KNOW, ANY, ANY BUSINESSES THAT WOULD BE ALIGNED WITH IT? I'M JUST TRYING TO THINK OUTSIDE THE BOX A LITTLE BIT.

SO THEY WOULD STILL GO ALL THROUGH ALL THEIR NORMAL PERMITS, SUBDIVISION SITE PLAN, UH, ELEVATION APPROVALS, BUILDING PERMITS AND ALL THAT.
BUT THE, UH, THE, THE GOOD THING ABOUT IT IS WE GET TO PUT IT SOCKET AWAY INTO THAT AREA FOR THOSE INFRASTRUCTURE PROJECTS.

HOW ARE WE GONNA DO AS SOON AS, YOU KNOW, IF THEIR PROPERTY STARTS INCREASING WITH THEIR TAXES, IS THERE ANY WAY THAT WE CAN KIND OF LIKE MOVE THEM OUT OF ANY TYPE OF, UM, INCREASE IN PROPERTY TAXES THAT THEY WILL HAVE TO PAY FOR THE, SO WE'RE WE, SO WE SET THE PROPERTY TAX RATE ALONG WITH, UH, WITH HEY CISD AND OTHER TAXING JURISDICTIONS.
UM, AND THOSE ARE ALWAYS GONNA BE PRETTY CONSISTENT.
IT'S JUST THE DIFFERENCE IN THE VALUE CHANGE THAT WE COLLECT.
SO IF, IF WHEN PROJECTS START DEVELOPING AROUND, SAY, MERRICK, KYLE, HARSON PARK AND WHAT HAVE YOU, UM, THERE MIGHT BE TO SOME EXTENT SOME VALUE INCREASE FOR ADJACENT PROPERTIES THAT ARE RESIDENTIAL, BUT IT'S NOT GONNA BE DUE TO THE CITY INCREASE.
AGAIN, THE, THE APPRAISAL DISTRICT IS THE ONE THAT SETS THOSE VALUES.
WELL, WHAT I WAS THINKING IS, I KNOW THE PROPERTY, THE PROPERTIES AROUND THESE RESIDENTIAL HOMES ARE GOING TO AND HAZE THE WHOLE TURT, AND THAT'S GOING TO INCREMENT THE APPRAISED VALUE OF THESE HOMES.
THEREFORE, THEN THEY WILL HAVE TO PAY FOR MORE TAXES.
THAT'S WHAT I'M THINKING ABOUT IS THE TAXES THAT WE'LL HAVE TO PAY IS GOING TO BE HIGHER DUE TO THE AREA BEING, YOU

IT DOES NOT AFFECT THE UNDERLYING ZONING THAT'S THERE.
SO ALL THE UNDERLYING ZONING STAYS THE SAME.
CB ONE, CB TWO I THINK WAS THE KIND OF THE QUESTION BEFORE, BUT YOU WOULD HOPE THAT THE TOURISTS WILL GENERATE, UM, INCREMENTED THAT CAN BE REINVESTED IN THE DISTRICT.
THAT WILL INCREASE ALL OF THE PROPERTY VALUES AND THE, UH, THE OWNERSHIP FOR ALL OF THE FOLKS THAT OWN PROPERTY WILL HAVE GREATER VALUES THAT'LL BE THERE.
THERE'S NOT A TAX, UH, REDUCTION, UH, WITH IT.
UH, BUT YOU WOULD HAVE MORE VALUE HOPEFULLY FOR THE PROPERTIES, PRIMARILY THE COMMERCIAL PROPERTIES THAT YOU WOULD SEE AROUND THERE.
THERE COULD BE SOME OF THAT WITH THE RESIDENTIALS, BUT THAT WOULD BE ADDITIONAL VALUE THAT THEY WOULD ALSO HAVE THERE AS WELL.
BUT THERE WOULDN'T BE ANY KIND OF TAX REDUCTION, UH, OR REBATE THAT WOULD BE ASSOCIATED WITH IT.
THAT'S THE THEORETICAL LOOK AT, I DON'T KNOW EXACTLY HOW INDIVIDUAL VALUES WOULD BE AFFECTED, BUT AS YOU GET NEW INVESTMENT, PRIMARILY NEW INVESTMENT THAT COMES INTO THE AREA THAT RAISES THE VALUES, THAT'S WHAT GENERATES THE INCREMENT, NOT NECESSARILY SO MUCH THE EXISTING HOMES THAT MIGHT BE IN THE AREA.
BUT THEY'RE THE, I'M, I'M REALLY EXCITED BECAUSE IF THIS IS ONE OF THE AREAS THAT I FEEL LIKE IT REALLY WILL BENEFIT FROM CREATING A TOUR.
SO THE TAXES GO BACK INTO THE AREA.
UM, I JUST HAD QUESTIONS ABOUT THE BOUNDARIES AND ARE WE GONNA BE PRESENTED A COUPLE OF FINANCIAL STRATEGIES THAT WE'RE GONNA BE USING FOR THAT? 'CAUSE I KNOW NOT ALL THE TOURS ARE THE SAME.
UM, IF Y'ALL PROVIDE THIS DIRECTION TO PURSUE, UH, RESEARCHING THIS TOUR AND BRINGING BACK ITEMS FOR YOU, WE'LL PRESENT Y'ALL ALL THE, THE DETAILS OF THAT, THE FINANCING PLAN.

WE TRIED TO LOOK AT THE PRIMARY BUSINESS DISTRICT OF DOWNTOWN ALONG CENTER STREET, BUT ALSO EXTENDING IT ACROSS TO 35 TO LOOK AT SOME PROJECTS THAT COULD HOPEFULLY LINK INTO THE DOWNTOWN AREA AND HAVE SOME COMPLIMENTARY INVESTMENTS.
SO A LOT OF THOSE ARE GREENFIELD PROJECTS.
THERE'S NOT A LOT OF PROPERTIES THERE CURRENTLY.
UH, BUT THOSE, THAT'S A PRIMARY THING WE'D WANNA LOOK AT.
IS THE BOUNDARIES ABOUT RIGHT.

IT'S NOT THE ONLY THING, IT'S JUST REALLY A STARTING BLOCK TO HELP US HAVE FUNDING.

UM, I HAVE A SHORT PRESENTATION I WANT TO GO THROUGH TO, TO KINDA WORK THROUGH THIS ISSUE WITH YOU.
WHEN I WAS BEFORE YOU IN SEPTEMBER, I NOTED AND GAVE YOU AN UPDATE ON OUR CONSTRUCTION OF ALL OUR ACTIVITIES.
AND I MENTIONED IN THAT PRESENTATION THAT WE HAD A $46 MILLION SHORTFALL IN THE, IN OUR ESTIMATES IN ORDER TO COMPLETE THE PROJECTS.
THAT $46 MILLION WILL GO TOWARDS THE COMPLETION OF OUR SEGMENT C PIPELINE, WHICH SERVES THE CITY OF KYLE AS WELL AS, UM, SAN MARCUS COUNTY LINE SPECIAL UTILITY DISTRICT.
AND ULTIMATELY HOW BUTA WILL RECEIVE SOME OF THIS WATER.
IT ALSO INCLUDES A NORTH INLINE ELEVATED STORAGE TANK, WHICH WILL, UH, BE ADJACENT TO THAT PIPELINE.
AND THEN FINALLY, ADMINISTRATIVE FACILITY FOR US TO HAVE A LOCATION FOR OUR STAFF FOR BOARD MEETINGS, ET CETERA.
OF THE $46 MILLION, KYLE'S SHARE OF THAT IS $13 MILLION.
IT'S 28.17% OF, UH, THE OVERALL COST.
THAT'S ALSO EQUALS HOW MUCH WATER KYLE GETS OUTTA THE ENTIRE PROGRAM IS SET BY THAT SAME PERCENTAGE.
THE REASONS FOR THE NEED ARE REALLY TWOFOLD.
ONE, CONSTRUCTION COSTS HAVE RAMPED UP CONSIDERABLY FROM WHEN WE INITIALLY STARTED THIS PROJECT IN 2017 WHEN WE DID OUR INITIAL ESTIMATES.
AND ALONG WITH THAT, THE LAND ACQUISITION COST HAVE INCREASED SIGNIFICANTLY THROUGH THAT TIME AS WE'VE SEEN RISING VALUES FOR OUR EASEMENTS THAT, THAT WE'VE ACQUIRED THROUGHOUT THE PROJECT.
SO JUST A QUICK REMINDER BECAUSE I KNOW SEGMENT C IS SO VITAL, UH, TO THE CITY OF KYLE AND, AND THE NEED TO GET THE WATER ONLINE HERE.
UH, THIS IS THE SAME SLIDE I PROVIDED IN SEPTEMBER THAT SHOWED OUR INTENT IS TO HAVE AT LEAST THE, THE FIRST PORTION OF THE SEGMENT C PIPELINE COMPLETED BY JANUARY OF 2025.
THAT WOULD INCLUDE A CONNECTION TO THE NEW, UH, KYLE DELIVERY POINT AT THE WATERSTONE DEVELOPMENT, AND THEN THE COMPLETION OF ALL OF IT SEGMENT C BY OCTOBER, THE END OF OCTOBER OF 2025, WHICH INCLUDE THE LINE ALL THE WAY UP TO THE, UH, FM 1626 PUMP STATION THERE IN FRONT OF THE HEB.
UM, SO THAT'S JUST A REMINDER OF WHY WE'RE PUSHING TO THIS FORWARD.
WHAT WE'RE PROPOSING TO UTILIZE THIS TIME IS WHAT'S CALLED A BOND ANTICIPATION NOTE.
PREVIOUSLY, WE'VE ISSUED BONDS THROUGH THE TEXAS WIRE DEVELOPMENT BOARD REVENUE BONDS TO DO THAT.
WE HOPE TO DO THAT SAME THIS TIME AROUND BECAUSE THAT AFFORDS US TO GET LOWER INTEREST RATES.
HOWEVER, ONE OF THE DRAWBACKS OF THE SWIFT PROGRAM WITHIN THE WIRE DEVELOPMENT BOARD IS THAT WINDOW

ONLY OPENS ONE TIME PER YEAR.AND SO THE SOONEST WE COULD GET ACCESS TO THOSE FUNDS WOULD BE NEXT NOVEMBER, SO NOVEMBER OF 2024.
UH, AS I SHOWED ON THE SLIDE PREVIOUSLY, WE'RE HOPING TO GET THE SEGMENT C PROJECT MOVING FORWARD BY AWARDING A CONSTRUCTION CONTRACT IN JANUARY.
SO WE WOULD LIKE TO FIND SOME BRIDGE FINANCING TO, TO DO THE GAP UNTIL WE GET TO THE SWIFT LOANS NEXT NOVEMBER.
AND SO THAT'S WHAT WE'RE PRO UH, PROPOSING HERE IS THE USE OF BOND ANTICIPATION NOTES IN ORDER TO BE THAT BRIDGE FINANCING MECHANISM.
THIS IS SOMETHING THAT, UM, WE ARE ALLOWED TO DO BY STATE LAW.
HOWEVER, OUR WATER SUPPLY CONTRACT BETWEEN US AND KYLE AND OUR OTHER SPONSORS DOES NOT SPECIFICALLY ALLOW THE USE OF A, OF A BOND ANTICIPATION NOTE OR A BAN.
AND SO ONE OF THE THINGS WE'RE GONNA REQUEST IS THAT WE MODIFY THAT AGREEMENT TO ALLOW FOR THE USE OF THOSE BANS.
WE'VE BEEN WORKING WITH SEVERAL BANKS TO IDENTIFY THE POSSIBILITY OF DOING THE SHORT-TERM PLACEMENT THROUGH THEM WITH THE IDEA THAT WHEN WE GET THE SWIFT LOAN, UH, NEXT YEAR, THAT THE, THE SWIFT LOAN WOULD WIPE OUT AND, AND PUT IN PLACE THEN THE LONG-TERM FINANCING FOR THE $46 MILLION IN TOTAL THAT WE'RE SEEKING.
UM, I MENTIONED THE FIRST STEP IS WE WILL NEED AN APPROVAL OF A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE WATER SUPPLY CONTRACT BETWEEN ALLIANCE WATER AND KYLE TO USE TO ALLOW US TO USE THE BANDS.
WE, UH, JUST TODAY CIRCULATED THE DRAFT LANGUAGE FOR THAT CONTRACT AMENDMENT TO CITY STAFF TO TO HAVE LEGAL COUNSEL REVIEW AND LOOK AT THE SECOND PART.
WE ARE HOPING TO HAVE READY FOR DECEMBER ACTION AS WELL BE A SEPARATE ACTION ITEM POTENTIALLY ON THE SAME AGENDA IF YOU CHOOSE TO MOVE FORWARD.
WORST CASE IT WOULD BE JANUARY, BUT THAT WOULD BE THE ACTUAL RESOLUTION TO AUTHORIZE THE MANAGER TO APPROVE THE BOND ANTICIPATION.
RIGHT NOW THE MARKET IS, IS CHANGING A LITTLE BIT, BUT WE'RE ASSUMING THE INTEREST RATE ON THE ONE YEAR BAN WOULD BE IN THE FIVE TO 6% INTEREST RATE RANGE.
SO, UH, WHEN WE GET TO THE SWIFT RATES AND ARE ABLE TO REFINANCE THAT, WE'VE BEEN SUCCESSFUL IN CLOSING IN THE THREE TO THREE AND A HALF PERCENT RANGE.
AND SO THAT'S WHY THAT'S SO, SO MUCH MORE ADVANTAGEOUS TO US WHEN WE GET TO THAT POINT IN TIME.
SO THIS WAS JUST AN UPDATE, UM, AND GET YOUR FEEDBACK BEFORE WE POTENTIALLY COME BACK TO YOU IN DECEMBER FOR MORE ACTION.

I THINK IT WOULD HAVE AN IMPACT BECAUSE IT IS AN INCREASE IN THE COST TO, TO GET THIS WATER DELIVERED TO THE CITY.
HAVE WE DONE ANY ANALYSIS ON THAT YET, BRAD? ADDRESS THAT, UH, WE HAVE NOT ANALYZED THAT WE ARE PREPARING TO ISSUE AN RFP FOR A CONSULTANT TO HELP US WITH THE COST OF SERVICE STUDY FOR OUR WATER AND WASTEWATER RATES.
OUR CURRENT RATES DO NOT CONTEMPLATE, UH, THIS IMPROVEMENT, THIS ADDITIONAL, UH, $13 MILLION.
SO THE RATES RIGHT NOW WILL NOT REFLECT THAT WHEN WE GO THROUGH THAT COST OF SERVICE STUDY, IT WILL INCLUDE THESE IMPROVEMENTS.
UM, THAT SAID, $13 MILLION IS A, IS COMPARATIVELY A SMALL AMOUNT TO LIKE THE WASTEWATER, UH, TREATMENT PLANT, WHICH IS A HUNDRED MILLION DOLLARS ESTIMATED.
SO IT, IT MAY HAVE SOME IMPACT, BUT WE DON'T BELIEVE THAT THE IMPACT WILL BE THAT GREAT COMPARATIVELY.
AND IT'S NOT, THIS IS A CHANGING OUR RATES.

SO THIS WOULD BE A PART OF OUR BUDGETING PROCESS FOR NEXT FISCAL YEAR, CORRECT? YES.

SO WE WILL BE PAYING FOR $13 MILLION INTEREST IN ONE YEAR.

AND DO WE NEED THE MONEY RIGHT NOW IN ORDER TO MOVE THE, THE SEGMENT C PROJECT FORWARD? WE, WE DO NEED THE MONEY, UM, IN ORDER TO BE ABLE TO CONTRACT, UH, AND GET THE CONSTRUCTION INITIATED.
AND WHERE DID WE DROP THE BALL OR NOT ANTICIPATE FOR THIS AMOUNT? WE, THE, THE DESIGN WAS FINISHED, UM, JUST RECENTLY.
AND SO THE UPDATED ESTIMATES THAT WE HAD FROM THE ENGINEER ARE WHAT CAUSED US, UM, TO, TO IDENTIFY THE SHORTAGE ALONG WITH THE ADDITIONAL COSTS WE'VE SEEN IN THE, UH, PROPERTY ACQUISITION.
AGAIN, WE'VE TYPICALLY UTILIZED THE SWIFT FINANCING FOR THAT, AND THAT THAT WINDOW ONLY OPENS ONE TIME PER YEAR.
AND SO WE, WE DID NOT HAVE THAT INFORMATION IN OUR HANDS IN FEBRUARY OF 2023 WHEN THAT LAST WINDOW OPENED UP TO BE ABLE TO GET TO THE SWIFT LOANS.
MY LAST QUESTION, I PROMISE, UH, MR. PEREZ PEREZ, IS THERE ANY WAY THAT I CAN,
UM, THEY ISSUED THE DEBT ON OUR BEHALF AND AS PART OF OUR O AND M EXPENSE, THE CITY REIMBURSES THEM, WHICH THEY THEN PAY THE PRINCIPAL AND INTEREST ON THE DEBT.
SO THE $13 MILLION APPROXIMATELY, THAT'S THE GAP AT THIS POINT.
THEY WOULD HAVE TO, TO FINANCE IT ON OUR BEHALF IN ADDITION TO THE OTHER PARTNERS.
AND THEN THE TOTAL GAP IS ABOUT 45 MILLION.
SO THEY WOULD HAVE TO DO THAT ON AN INTERIM BASIS AND UNTIL THE SWIFT FUNDS AVAILABLE.
SO IN THE INTERIM, WE WOULD BE PAYING THEM ON OUR $13 MILLION.
OUR, UH, I WOULD IMAGINE IT WOULD BE INTEREST ONLY.
SO WE WOULD BE PAYING OUR SHARE.
SO ROUGHLY IT'S ABOUT $1.3 MILLION IN ROUND NUMBERS THAT WE WOULD HAVE TO ABSORB IN OUR WA WATER UTILITY, UH, EXPENSES.
AS ASSISTANT CITY MANAGER SCHMITZ SHARED WITH Y'ALL, WE ARE UNDERGOING A COST OF SERVICE STUDY THAT WILL DETERMINE THE COST ALLOCATION FOR EACH CUSTOMER CLASS.
SO TO ANSWER YOUR, YOUR SPECIFIC QUESTION, COUNCIL MEMBER PARSLEY, WE CAN ABSORB IT IN OUR UTILITY SYSTEM, BUT THE DEBT HAS TO BE ISSUED BY THE ALLIANCE, IF I MIGHT AS WELL.

AND IT, IS IT ACCURATE TO SAY THAT THE PIPELINE IS BEHIND ON DELIVERY BASED ON WHAT THE EXPECTATIONS WERE OVER THE PAST COUPLE YEARS? I, I THINK FROM THE, FROM, CERTAINLY FROM OUR ORIGINAL SCHEDULE, YES, SIR.

BUT WAS THERE ANYTHING THAT WE DID ON THE CITY SIDE TO, TO TRY TO BE MINDFUL OF WHERE THIS WATER LINE WAS GOING WHEN APPROVING DEVELOPMENT? I'M, I'M NOT ASKING YOU, I'M ASKING STAFF.
I, I, I BELIEVE THAT, YOU KNOW, WE ALWAYS HAD THIS IN MIND, BUT THE, THE ISSUE IS, IS NO ONE ANTICIPATED THE VOLUME OF DEVELOPMENT AND THE, UH, JUMP IN LAND VALUES IN CENTRAL TEXAS THAT WE'VE EXPERIENCED OVER THE PAST EIGHT YEARS WHEN THIS, YOU KNOW, THIS PROJECT KIND OF KICKED OFF.
UH, YOU KNOW, NOBODY COULD HAVE ANTICIPATED ALL OF THAT.
UM, BUT YES, WE ARE VERY MINDFUL OF THE, THE ARAWA WATER LINE.
WE'RE WORKING RIGHT NOW WITH, UM, ARAWA ON OUR, UH, ROAD ROAD BOND PROJECT.
UM, WE'RE, WE'RE COORDINATING WITH THEM TO MAKE SURE WE CAN, UH, TAKE ADVANTAGE OF, UH, EASEMENT ACQUISITION AT THE SAME TIME.
WE'RE HAVING RIGHTAWAY ACQUISITION.

SO THE CITIES OF KYLE, SAN MARCUS, BUTA, AND KENYA REGIONAL WATER AUTHORITY.
AND THERE IS NOTHING IN THE CONTRACT THAT SPEAKS TO, UH, WHAT WOULD HAPPEN IN DELAYS OR, OR, YOU KNOW, THAT SORT OF THING.
I WILL SAY IN TERMS OF THE COST OVERAGES, I MENTIONED THAT KYLE SHARES 28.17%.
SO WE'RE HAVING THESE SAME CONVERSATIONS WITH, WITH ALL OF THE ENTITIES THAT ARE MEMBERS OF ALLIANCE WATER TO SEEK THIS ADDITIONAL FUNDING TO COMPLETE ALL OF THESE PROJECTS.
SO EVERYBODY IS IMPACTED FROM A COST PERSPECTIVE BY THIS COST INCREASE.
IT IS NOT LIMITED TO JUST ONE OF THE PARTNERS IN THE GROUP.
SO THE TOTAL NUMBER DOLLAR FIGURE THAT YOU GUYS ARE LOOKING TO SECURE IS 13 MILLION.
46 MILLION IS THE, UH, THE OVERALL TOTAL THAT WE ARE SEEKING IS THIS, UH, I GUESS THIS DELAY AND THE REASONS FOR THIS DELAY IS THIS SOMETHING THAT'S HAPPENED TO YOU GUYS BEFORE WITH THIS IS THE FIRST TIME WE'RE BUILDING OUT OUR INFRASTRUCTURE.
SO WE ARE STILL IN ACTIVE CONSTRUCTION OF THE, FOR OUR WATER TREATMENT PLANT OR OTHER PIPELINES.

THEY WOULD LOSE SOMETHING, BUT THEY DON'T, THEY HAVE MORE TO GAIN BY, SINCE WE ARE NOT THE DIRECT PROVIDER TO THEM AS WE ARE WHOLESALE ONLY.

SO, I'LL LET PAIGE EXPAND ON, UM, THE POSSIBILITY OF US BEING IN BREACH OF OUR CONTRACT FROM 2015.

WHAT THIS LETTER AGREEMENT IS DOING IS JUST FULFILLING THE AGREEMENTS THAT THE PARTIES HAVE ALREADY MADE.

UH, THIS PORTION OF THE ROAD IS TO BE CONSTRUCTED AND PAID FOR BY THE DEVELOPER AT COUNCIL'S DIRECTION.

AND EVEN THOUGH IT WOULD BE TEMPTING TO GO IN AND REMODEL, UM, THAT, THAT REALLY DOESN'T MAKE A WHOLE LOT OF SENSE.

THE CITY COUNCIL AUTHORIZED, UH, FUNDS FOR THAT PARTICULAR STUDY.
THE CITY MANAGER AND I HAVE, UH, ACQUIRED SEVERAL PROFESSIONAL SERVICES AGREEMENTS FROM SEVERAL COMPANIES AND TRIED TO FIND THE RIGHT FIT.
THEY COULD OFFER US THESE SERVICES AND BEFORE YOU DO NOT, WE HAVE AN AGREEMENT WITH, UH, MATRIX CONSULTING GROUP.
THEY DID THE 2017 STUDY FOR THE KYLE POLICE DEPARTMENT THAT COVERED BOTH STAFFING, FUTURE PROJECTIONS AND FACILITIES NEEDS.
