GOOD EVENING, COUNCIL MAYOR.

MY NAME'S EDWARD COLEMAN.

I'M THE, UH, MANAGING MEMBER OF FM 1 58 LAND LTD.

FIRST OFF, I WOULD LIKE TO COMMEND THE CITY, UH, COUNCIL FOR BEING ABLE TO OBTAIN THE SIX LOTS FROM THE QUAIL RIDGE SUBDIVISION SO THAT GO FORTH ROAD CAN BE BUILT.

I THINK IT'LL BE A GREAT ASSET TO THE COMMUNITY.

THAT BEING SAID, THE PROJECT IS GOING TO HAVE A SIGNIFICANT IMPACT ON THE DRAINAGE IN THE AREA BECAUSE FM ONE 50 EIGHT'S PROXIMITY TO THE PROJECT, IT IS CRITICAL THAT WE BE PART OF THE CONVERSATIONS TO ASCERTAIN THAT THE DRAINAGE WILL NOT NEGATIVELY IMPACT OUR LAND.

THUS FAR, OUR PRIOR REQUESTS HAVE BEEN KEPT.

APP TO BE KEPT APPRAISED OF THE PLANNING HAVE BEEN IGNORED.

MOVING FORWARD, WE WOULD ASK THAT THOSE INVOLVED IN THE PLANNING INCLUDE US THAT IN THE FUTURE SO THAT PROBLEMS MAY BE DISCUSSED AND AVOIDED AS PART OF THE PLANNING PRO PROCESS CRITICAL TO THE DISCUSSIONS.

FM 1 58 LAND IS IN THE MIDDLE OF AN ONGOING RECLAMATION PROJECT, MEANING THAT THE LAND THAT WAS PREVIOUSLY MINED IS IN THE PROCESS OF BEING RECLAIMED AS A DEVELOPABLE PIECE OF LAND.

THE CITY STAFF, THE CITY COUNCIL MEMBERS, THE DEVELOPERS, MICHAEL SCHROEDER ASSOCIATES ASSOCIATED ENTITIES ARE BEING PUT ON NOTICE THAT NO ONE HAS BEEN GIVEN PERMISSION TO DIVERT OR DISCHARGE ANY STORM STORMWATER ONTO FM ONE 50 EIGHT'S LAND.

TEXAS LAW SPECIFICALLY PROHIBITS THE ILLEGAL DIVERSION OF WATER ONTO A NEIGHBORING PROPERTY.

THE DAMAGES THAT FM 1 58 WOULD SUFFER AS A RESULT OF ANY, ANY ILLEGAL DIVERSION OF WATER WOULD DESTROY THE PROPERTY AS TO BOTH ITS CURRENT STATUS, AS WELL AS THE ABILITY TO CONTINUE THE RECLAMATION OF THE PROJECT FOR THE LAND, WHICH IS, WHICH IS AS A PERMITTED QUARRY OPERATOR I AM ENTITLED TO DO UNDER THE LAW.

ACCORDING TO THE LASALLE MUD DISTRICT NUMBER ONE MEETING THAT TOOK PLACE ON JANUARY 11TH, 2024, THE CITY OF KYLE IS WORKING WITH LASALLE MUD AND LIMESTONE CREEK DEVELOPERS TO UPDATE THE AGREEMENT REGARDING ROADWAY AND DRAINAGE IMPROVEMENTS IN THIS AREA.

THE TWO CURRENT AGREEMENTS THAT YOU HAVE IN PLACE NOW SPELL OUT THE DIVERSION OF WATER AND SHOW THE STORMWATER BEING POINT SOURCED ONTO FM 1 58 LAND.

ONCE AGAIN, ACCORDING TO TEXAS WATER CODE 11.068, THIS IS AN ILLEGAL ACT AT AT, AT THIS ADVANCED STAGE OF DEVELOPMENT.

THE CITY OF COWS ENGINEERS HAVE TOLD US THAT THEY DO NOT KNOW WHERE THEY WILL DRAIN THE LIMESTONE CREEK STORM WATER.

ADDITIONALLY, WE HAVE PRESSED THE DEVELOPER'S ENGINEER DOUCETTE ENGINEERING, AND THEY DO NOT HAVE A SOLUTION TO THE LASALLE MUD OR LIMESTONE CREEK DRAINAGE.

IT'S HARD TO BELIEVE THAT NO PLAN IS IN PLACE AT THIS TIME FOR THE DISCHARGE OF THE STORM WATER.

WE HAVE STUDIED THE AREA WITH MY ENGINEERS AND ATTORNEYS TO UNDERSTAND OUR RIGHTS AS AN IMPACTED QUARRY OPERATOR, PROPERTY OWNER, THE CITY STAFF, THE COUNCIL, THE DEVELOPERS MIKE SCHROEDER GROUP, UH, SHOULD BE ADVISED THAT A FALLING BY THE AVERTING STORM WATER THE WAY THAT THE FORMER CITY MANAGER DESCRIBED IT IN A CITY COUNCIL MEETING ON DECEMBER 15TH, 2020, ITEM NUMBER 24, THE ADDITIONAL AND, AND ADDITIONAL PLANS THAT WE HAVE OBTAINED THAT DESCRIBED THE LASALLE BERM IS A DIVERSION BERM.

YOU'LL, YOU'LL RUN THE RISK OF, OF COMPROMISING THE ENTERPRISE GAS PIPELINE GATE DISTRIBUTION FACILITY LOCATED

INSIDE THE LASALLE DIVERSION BERM.

AND TWO, IT WILL FLOOD IT 300 ACRES OF OUR VALUABLE LAND THAT I PLAN TO DEVELOP IN THE FUTURE.

WE ARE NOT HERE TO BE A ROADBLOCK TO DEVELOPMENT.

HOWEVER, WE CANNOT AND WILL NOT ALLOW THE CITY OF COO OR THE DEVELOPERS TO ILLEGALLY DIVERT AND POINT SOURCE THEIR STORM WATER ONTO FM 1 58 LAND AND DESTROY OUR VERY VALUABLE PROPERTY FOR THE BENEFIT OF OTHER PARTY'S CONCERN.

BASICALLY, WE ARE ASKING THAT EVERYONE BE NEIGHBORLY AS THE COMMUNITY CONTINUES TO GROW.

WE BELIEVE THAT OPEN COMMUNICATION AND PROPER PLANNING THAT UH, PROPER PLANNING, DEVISING, PRO DEVASTATING PROBLEMS CAN BE AVOIDED AND, AND ALL WHILE ALLOWING THE SUCCESSFUL DEVELOPMENT.
